The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building. 30 July 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Comm-
issioner Vandeventer. Commissioner Lehrkind, City Manager Fryslie. Ass't. City Manger Wolf. City
Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 23 July 1975. were approved as read.
Authorize Absence of Commissioner Taylor on 30 July and 6 August 1975
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that in compliance
with Section 11-3245. R.C.M.. 1947, the absence of Commissioner Taylor. from the meetings of 30 July
and 6 August be authorized and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy;
those voting No, none.
Human Resource Development Council Presentation - Low Rental Housing
Nell Avery and Bill Phillips representatives of the Human Resource Development Council appeared
before the Commission to report on a Local Housing Agency and to ask the City of Bozeman to establish
a Local Housing Agency in Bozeman. More information will be available for the Commission by 6 August.
The Commission thanked the representatives for their presentation and tabled action on establish-
ing a Local Housing Agency in Bozeman for a period of one week for further study.
Commission Resolution No. 1741 - Create Special Improvement District Revolving Fund for SID No. 548

A RESOLUTION PURSUANT TO STATUTORY PROVISIONS. SETTING OUT THAT THE
CITY COMMISS ION UNDERTAKES AND AGREES TO ISSUE ORDERS ANNUALLY AUTH-
ORIZING LOANS OR ADVANCES FROM THE REVOLVING FUND TO MAKE GOOD ANY
DEFICIENCY IN PRINCIPAL AND INTEREST ACCOUNT TO THE EXTENT FUNDS ARE
AVAILABLE AND TO PROVIDE FUNDS FOR SUCH REVOLVING FUND BY MAKING TAX
LEVY AND LOANSAS THE COMMISSION DETERMINES NECESSARY.

It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that Commission
Resolution No. 1741 creating Special Improvement District Revolving Fund for Special Improvement
District No. 548 be passed and adopted and the motion was carried by the following Aye and No vote:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA.
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A
SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 556 FOR THE PURPOSE OF OP-
ERATING AND MAINTAINING A LIGHTING DISTRICT TO LIGHT THE NORTH-SOUTH
ALLEY IN BLOCK ONE OF THE BRUNTON-PALFFY REARRANGEMENT OF A PORTION
OF DURSTON SUBDIVISION. SAID LIGHTING SYSTEM TO BE INSTALLED AND
PAID FOR BY THE MONTANA POWER COMPANY UNDER AUTHORITY OF AND IN CON-
FORMANCE WITH SECTION 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED
CODES OF MONTANA, 1947.

District No. 556 for the purpose of operating and maintaining a light system to light the north-south
alley in said Block 1 in the City of Bozeman. and to be installed by the Montana Power Company was
presented.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that Commission
Resolution No. 1743 be passed and adopted and Wednesday. the 20th day of August. be the date set
for public hearing and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those
voting No. none.
Authority to Purchase 30 5/8 " Water Meters
The Water department has need for 30 5/8" Water meters at an approximate cost of $1.350.00 and
the City Manager requested authorization to purchase the meters.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the request
be granted and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting
No, none.
Authority to Call for Bids - Curb Project Babcock and Mendenhall Streets, Open 13 August 1975
Plans and specifications covering the curb project on Babcock and Mendenhall streets as prepared
by Thomas. Dean & Hoskins. Inc.. consulting engineers was placed before the Commission.
In concurrence with the consulting engineers. the City Manager recommended that the plans and
specifications as presented be approved and that a call for construction bids be authorized.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that the plans and
specifications be approved and the Clerk of the Commission be authorized and directed to publish a
"Call for Bids" for the construction of curbs on Babcock and Mendenhall Streets with an opening
date of 13 August 1975 and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. being Comm-
issioner Vandeventer.
Petition for SID - Property East of South 19th Avenue lying between Babcock & College Streets
A petition received from Property owners of property lying between Babcock and College Streets
east of 19th Avenue in the City of Bozeman petitioning the City of Bozeman to Create a Special
Improvement District for the purpose of installation of a sewer system was presented.
The Commission concurred in the recommendation of the City Manager, and it was moved by Comm-
issioner Vollmer. seconded by Commissioner Vandeventer, that the Commission instruct the City Attorney
to draw up a resolution of Intention to create the district for sewer installation as soon as the
City staff furnishes the necessary information. The motion was carried by the following Aye aDd No
Vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Lehrkind
and Mayor Sedivy; those voting No. none.
Application for Beer License - Lions Club, 2-3 August 1975
A request from the Gallatin Empire Club for permission to obtain a C~ty Beer license for the
weekend of 2-3 August. along with the required fee was presented.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the Gallatin
Empire Lions C\ub. having met all requirements. be granted a license to sell beer at the North Grand
Park on the weekend of 2-3 August, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No. none.
Report - Chief of Police
The City Manager commented on the report of the Chief of Police and recommended approval thereof.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the report of the
Chief of Police be approved and ordered file and the motion was carried by the following Aye and No

Retirement Letters - Henry Wruck. Effective 1 August 1975
Eugene G. Kenned~Effective 1 August 1975
A letter addressed to the Bozeman Fire:fighters Relief Association from Henry D. Wruck and Eugene
G. Kennedy and requesting disability retirement from the Bozeman Fire Department, effective 1 August
1975. a copy of which was sent to the City Manager, was read to the Commission.

Adiournment
There being no further business to come before the commission~ this time. it was moved by
Commissioner Vollmer. seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
