Montana 23 July 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building. 23 July 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Comm- issioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, City Manager Fryslie. City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 16 July 1975. were approved as read. Hearing Conditional Use Permit to Construct Metal Quonset Structure - C. Robinson This was the time and place set for a public hearing to consider the request of Clayton Robinson for a Conditional Use Permit to locate a metal quonset structure on a tract of land lying in the SW\. SE~ of Section 31, Township 1 South. Range 6 East. M.P.M.. Gallatin County, Montana. After review of the staff findings and consideration of public testimony. the Zoning Commission voted unanimously to recommend approval of the conditional use permit based upon the following condi- tions. 1. That the petitioner generally clean up the site and either fence or store in the proposed building all open storage. 2. That if signing is to be erected, it should be a very simple flush. non-illuminated building sign and shall meet the approval of the City Building Inspector. Following discussion. it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Commission concur in the recommendation of the Zoning Commission and approve the Conditional Use Permit to locate a metal building adjacent to the Bridger Center Subdivision with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Hearing. Rezone R-4-T to R-O, College & 19th Avenue - Eugene Graf. Jr. (Montana Farm Bureau Federation) This was the time and place set for a public hearing to consider the request of the Montana Farm Bureau Federation, to Rezone approximately fourteen acres of land in the Northwest Quarter of the Southwest Quarter of Section l2, Township 2 South. Range 5 East. M.P.M.. Gallatin County. Montana from Residential-4-Transitional to Residential-Office. said land is located at the corner of West College Street and South 19th Avenue. Having reviewed the Planning Staff report and hearing public testimony, the Zoning Commission voted to recommend approval of the zone change for the above mentioned land. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Commission concur in the recommendation of the Zoning Commission. and approve the request to rezone the area from R-4-T to R-O. The motion was carried by the following Aye and No vote: thooe voting Aye being Commissioner Vandeventer. Commissioner Lehrkind. Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No. none. Consideration of Bids - Bleachers for the Recreation Complex The Commission was referred to the opening of bids for the installation of bleachers at the Recreation Complex. The bids having been studied in detail by the Recreation Director and the engin- eering staff, it was found that the bid price exceeded the funds available and recommended that all bids be rejected. Following a discussion, the Commission concurred in the recommendation of the Recreation Director. engineering staff, also concurred in by the City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that all bids for the installation of the bleachers at the Recreation Complex be rejected. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. and Mayor Sedivy; those voting No. none. Authority to Call for Bids - Mower for Park Department The Park Department has need for a new Hydrostatic Driven Rotary Lawn Mower and the City Manager requested that the purchase be authorized. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the purchase as requested be authorized and the Clerk of the Commission be directed to issue a "Call for Bids"'for the purchase of the new Rotary Lawn Mower. to be opened on 6 August 1975 and the motion was carried by the following Aye and No vote: those voting aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. I I I I I I 327 Ordinance No. 955. Appropriation Ordinance for Provisional Passage. Hearing 6 August 1975 The City Manager reviewed the proposed budget for the fiscal year ending 30 June 1975. and Ord- inance No. 955 was presented. entitled: ORDINANCE NO. 955 AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIRMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA. FOR THE FISCAL YEAR ENDING 30 JUNE 1976. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that Ordinance No. 955 be provisionally passed and adopted and that 6 August 1975. be set as the date for the public hearing. and the motion was carried by the following aye and no vote: those voting Aye being Comm- issioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind. Commissioner Taylor and Mayor Sedivy; those voting No. none. Request to Conduct a "Funrun" 20 July 1975 - Big Sky Winddrinkers A letter received from Andy Blank. Race Director of Big Sky Winddrinker requesting permission to conduct a "Funrun" on 30 July 1975 at 6:00 p.m. was presented. It was moved by Commissioner Vande'" venter. seconded by Commissioner Taylor. that permission be granted the Big Sky Windrinkers to conduct the "Funrun" on 30 July at 6 :00 p.m. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Co~issioner Vollmer and Mayor Sedivy; those voting No, none. Proposed Widening of North Tracy Avenue - Mendenhall to Villard Street. Medical Art Center The request from Don Nell of the Medical Arts Center to widen North Tracy Avenue from Mendenhall Street to Villard Street. having been continued for further study. was again presented for disQISsion and a final decision. A memorandum from the engineering staff giving the price for widening of three blocks on North Tracy Avenue was nBd by the City Manager. The City Manager recommended that with the funds available at this time. the proposed widening of North Tracy Avenue from Mendenhall Street to Villard Street not be considered at this time since it is not a critical request. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the Commission con- cur in the City Managers recommendation not to widen North Tracy Avenue from Mendenhall Street to Villard Street and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. and Mayor Sedivy; those voting No. none. Application for Temporary Beer License - Gallatin Empire Lions Club. A request from the Gallatin Empire Lions Club for permission to obtain a City Beer License for the weekend of 26-27 July 1975. along with the required fee. was presented It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the Gallatin Empire Lions Club. having met all requirements. be granted a license to sell beer at the North Grand Park on the weekend of 26-27- July. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No, none. Application for one-half Year Wine License - Story Motors The City Manager presented an application and the appropriate fee of $50.00 for a six month wine license for the Story Motors located at 1211 East Main Street. and recommended approval thereof. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the application for the wine license be approved and the Director of Finance be instructed to issue the retail wine license and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Report - Director of Public Service The City Manager commented on the report of the Director of Public Service and recommended approval thereof. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the report of the Director of Public Service be approved and ordered filed and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. 328 Ordinance No. 954. Setting Salaries for 1975-1976 Ordinance No. 954. the Annual Salary Ordinance covering the salaries of the Head of Departments and employees who are direct appointees of the Commission was presented. entitled: ORDINANCE NO. 954 AN ORDINANCE OF THE CITY OF BOZEMAN. MONTANA. FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS. AND THE EMPLOYEES OF THE CITY COMM- ISSION OF THE CITY OF BOZEMAN AS REQUIRED BY LAW. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that Ordinance No. 954 be passed and adopted and the motion-was carried by the following Aye and No vote; those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
