A. 05:37:02 PM 15341 – Oak Meadows Subdivision (Block 4/Lot 1 & Block 5/Lot 1) Master Site Plan
Application – (Brekke/Kohtz)
South of Oak Street between North 12th and North 14th Avenues
A master site plan application requesting a five‐year entitlement for building, parking, landscaping, open‐
space and parkland layout on the two property lots.
05:37:19 PM Allyson Brekke begins presentation of the project.
05:44:51 PM Applicant given an opportunity for presentation – applicant does not have anything to add.
05:45:14 PM Board begins questions for staff and applicant.
05:45:23 PM Mark Hufstetler questions if they will be seeing the building designs for this project. Allyson
Brekke responds that the buildings will come in individually, so she feels that no, they may not see the
buildings. However, if both buildings came in together, it may come before the DRB.
05:46:24 PM Mark Hufstetler questions the access to the South. He is curious how the City oversees the
construction of the access when divided between multiple owners and whether the property owner to the
West will be bound by the decisions made regarding this project. Ms. Brekke responds that an easement
must be acquired between all property owners. In terms of construction, engineering will be reviewing it.
She replied that in terms of access for the property to the West, that they will be using the shared access
easement. He questions if that property owner came to them with a plan that did not access that easement,
what would happen. Ms. Brekke states that the easement is there, so she doesn’t see how it would be
beneficial not to use it – and the city would likely guide future development to use it.
05:49:07 PM Lessa Racow questions if the site plan and landscape plan will be installed before the buildings.
Ms. Brekke responds that the landscape pieces in Phase 2 will not be installed. With regards to Phase 1, the
landscaping will be in place before the building is occupied, or it would need to be financially guaranteed.
Applicant responds regarding landscaping, however he does not use microphone and is inaudible.
05:50:46 PM Charlie Franklin questions if the trail on the west side will be asphalt or dirt and it appears that
the trail just ends at the access road, so he wants to know how people who use the trail will be protected.
Ms. Brekke states that it is owned by the City and will be asphalt. She states that the goal will be for it to link
in to the existing trail along Oak Street. Discussion continues regarding how the trail links into other existing
trails.
05:52:48 PM Melvin Howe questions if the shared access is an alley or a street. Ms. Brekke responds that it
will be a bit of both. It is a bit smaller than a standard street. Applicant responds with the intentions of how
the roads will map out. Discussion continues regarding roads.
05:55:02 PM Bill Rea questions if there are parking concerns with the project. Ms. Brekke responded in
detail regarding parking calculations.
05:57:53 PM Bill Rea questions how the applicant will maintain the property for Phase 2, or if it will be a
construction yard for an extended period of time. Ms. Brekke stated that there are regulations regarding
shielding construction equipment and storage. Applicant responds that Phase 2 will follow Phase 1 quickly. If
it didn’t, then the builder would grade the land, spread some wild seed and move out until the next project
begins.
06:00:14 PM Mr. Hufstetler questions the area to the south of the project. Applicant responds that it’s all
being budgeted within the Larkspur Commons project. Additional discussion of the roads being put into
place there.
06:02:16 PM Questions for applicant and staff end. Brought back to the board for motion, discussion and
vote.
06:02:39 PM Walter Banzinger moves to recommend approval of application 15341, per staff comments.
Mark Hufstetler seconds the motion.
06:02:57 PM Board discussion.
06:03:17 PM Mark Hufstetler states that this is a good project and straight forward. He likes the building
placement. He feels it will set up a nice street scape. He is concerned that the access road won’t be
complete all the way through 14th at the time the project is approved due to phasing, but it’s not a major
concern. Applicant responds – but does not use a microphone, so is inaudible. However, Mr. Hufstetler
stated that this concerned are eased by applicant response and he supports the proposal.
06:04:45 PM Lessa Racow said she agrees with Mr. Hufstetler’s comments. She thinks that this project will
make the street scape on Oak more continuous. She thinks the trail system and pedestrian access is a plus.
She thinks the shared access would be beneficial not only to the project, but to the community. She
supports the landscape design and quality. Her only concern (jestfully) is that it’s Oak Meadows and there’s
not an Oak tree in the plan.
06:06:07 PM Charlie Franklin agrees with the previous comments. He agrees that commercial use is better
for this property and supports the landscaping and reduced parking and hopes the plaza area will be well
used.
06:06:53 PM Melvin Howe questions what the 5 year entitlement period is. Ms. Brekke explains.
06:07:43 PM Walter Banzinger agress with the previous comments and that the use is good for this
property. He states that since they will not see the building plans, that he hopes they will be liberal with the
UDO and add some character to the street and not just echo the other buildings already there, but be
respectful of the neighborhood.
06:08:48 PM Bill Rea states that he is glad to hear the City has some regulations in place regarding Phase 2
following too far beyond Phase 1. But his concerns were relieved with Ms. Brekke’s comments previously.
He states concern with the 12th and Oak intersection as a result of this project.
06:10:03 PM Vote on the motion on the table.
Board votes unanimously in approval of the project.
E. 06:11:01 PM FYI/Discussion
06:11:11 PM Bill Rea requested information from staff on the idea of the City Commission reclaiming projects. Ms.
Brekke responds in detail about reclaiming projects.
Deputy Mayor Andrus responds with more detail regarding reclaiming a project.
06:15:53 PM Lessa Racow requested an update on the Golden Gate Condominium project. Ms. Brekke responded with
the status of the project.
