The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 25 June 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer. Comm-
issioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Acting City Manager Wolf. City
Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday. 18 June 1975. were approved as read.
Hearing. Commission Resolution No. 1737 - Intent to Create SID No. 555, Sanitary Sewer Portions Figg;ns
Commission Resolution No. 1740 - Create SID No. 555. Addition
This was the time and place set in Commission Resolution No. 1737. to hear protests to the
creation of Special Improvement District No. 555. Affidavit of publication of Notice and the Clerks
mailing certificate. stating all property owners had been notified as required by law were presented.
There were no protests on file and no one appeared to protest verbally. It was moved by Comm-
issioner Vollmer, seconded by Commissioner Vandeventer. that Commission Resolution No. 1740 creating
Special Improvement District No. 555 for the construction of Sanitary Sewers in a portion of Figgin's
Addition to the City of Bozeman. entitled:

CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM-
PROVEMENT DISTRICT NO. 555 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF
CONSTRUCTING AND INSTALLING A SANITARY SEWER TRUNK LINE TO SERVE A
PORTION OF FIGGINS ,ADDITION TO BOZEMAN, MONTANA. MORE SPECIFICALLY
DESCRIBED AS FOLLOWS: A TEN (10) INCH SANITARY SEWER AND NECESSARY
APPURTENANCES IN SOUTH THIRD AVENUE BETWEEN HILL STREET AND RAGY
BOULEVARD AND A TEN (10) INCH SANITARY SEWER AND APPURTENANCES IN
KAGY BOULEVARD BETWEEN SOUTH THIRD AVENUE AND SOUTH TRACY AVENUE
IN THE CITY OF BOZEMAN. THE CONSTRUCTION AND INSTALLATION OF SAID
SANITARY SEWER TRUNK LINE TO INCLUDE ALL TRENCH EXCAVATION AND
BACKFILL. BEDDING MATERIAL, SEWER PIPE. MANHOLES. NECESSARY WYES.
AND OTHER NECESSARY APPURTENANCES
as prepared by the City Attorney be passed and adopted. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner
TayLor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none.
Annexation Agreement - Waddell Construction. Utility Connection Agreement
An Annexation and Utility Connection Agreement by and between the City of Bozeman and Waddell
Construction Company for permission to connect a tract of land south of the North Quarter corner of
Section 6, T2S, R6E. of the Montana Principal Meridian, Gallatin County. Montana, at no cost to the
City of Bozeman was presented.
Following a discussion, the Commission concurred with the recommendation of the Acting City
Manager, and it was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the
Annexation and Utility Agreement. having been executed by Waddell Construction Company, be approved
and the Mayor and Clerk of the Commission be authorized to sign for the City and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss-
ioner Taylor. Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Unnumbered Resolution ~ Purchase Road Oil from Montana Highway Department 1975-1976
An unnumbered resolution authorizing the purchase of not to exceed 25.000 gallons of Road Oil
during the fiscal year 1 July 1975 to 30 June 1976, for use by the Street Department in repairing
pavement and for sealing certain sections of existing pavement within the City from the Montana
Highway Department was presented as follows:

WHEREAS the City of Bozeman will have need during the fiscal year
1 July 1975 - 30 June 1976, for road oils for use in repa~r~ng
streets and for sealing certain sections of existing pavement with-
in the City. and
WHEREAS the City of Bozeman does not have proper facilities for
handling and storing the needed quantities of oils. and
WHEREAS the Montana State Highway Department does have storage
facilities and normally does have quantities of the required
types of oils stored in Bozeman from which it can supply the
quantities needed by the City of Bozeman,
NOW. THEREFORE. BE IT RESOLVED:
That an emergency does exist relative to the procurement of Road
Oils by the City of Bozeman and the City Manager is hereby auth-

orized to purchase from the Montana State Highway Department, from
its stocks in storage in Bozeman approximately twenty-five thousand
(25,000) gallons of road oil. this to be purchased from time to
time during the fiscal year 1 July 1975 to 30 June 1976, as needed
by the City of Bozeman for repair and sealing of existing pavements,
and these quantities of road oils to be purchased at cost plus normal
handling charges. Said purchase is to he made from HB254 and SB362
"Cas Tax Funds."
PASSED AND ADOPTED BY the City Commission of Bozeman, Montana, at a
regular meeting of said Commission held on the 25th day of June 1975.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the unnumbered
resolution be passed and adopted and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner
Vandeventer and Mayor Sedivy; those voting No, none.
Beer License - Bozeman Softball Associatio~ 28-30 June 1975
A request from the Bozeman Soft Ball Association for permission to obtain a City Beer License
for the weekend of 28-30 June 1975, along with the required fee, was presented.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the Bozeman Soft-
ball Association, having met all requirements, be granted a license to sell beer at the North Grand
Park on the weekend of 28-30 June. and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lerhkdin. Commissioner Vollmer, Commissioner Vandeventer. Commissioner
Taylor and Mayor Sedivy; those voting No, none.
Request [or Curb Cut Variance - William Hubber, 725 South Tracy Avenue
A letter from William Rubber of 725 South Tracy Avenue. requesting a Curb Cut Variance from ten
feet to twenty feet to facilitate offstreet parking was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that they concur with
the recommendation of the Acting City Manager and approve the twenty foot curb cut variance. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.

No. none.
Petition - Alley Lighting between No. 10th and 11th Avenue from Villard to Durston Road
A petition signed by twenty property owners or interested persons petitioning the City of Bozeman
to establish a Special Improvement Lighting District between North Eleventh Avenue and North Tenth
Avenue from Villard Street to Durston Road was presented.
Following a discussion. the Commission concurred with the recommendation of the Acting City
Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they
instruct the City Attorney to draw up the resolution of intention to create the district as soon as
the City staff furnishes the necessary information. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind.
Commissioner Vollmer and Mayor Sedivy; those voting No. none.
.Request for Alley Improvement - Bressler and Associates
A letter received from Bressler and Associates on behalf of Vaughans. Country West. WaitE and
Company, McCraekens, R. Evans. and Phillips Book Store requesting alley improvement next to parking
lot improvements north of their respective business between Black Avenue and Rouse Avenue was presented.
Following a thorough discussion, it was moved by Commissioner Taylor, seconded by Commissioner
Lehrkind. that the engineering staff be granted authorization to give approval of the improvements
upon receiving final engineering plans from Bressler and Associates. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind.
Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Bicentennial Sign Request - Wes Bressler, Horizons Chairperson
A letter received from Wesley R. Bressler. Horizon Chairperson, Gallatin County Bicentennial
Committee requesting the erection of one or more signs for Bozeman, Announcing its designation as
"Bicentennial Community" was presented.
Following a thorough discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner
Vollmer, that the City of Bozeman contribute to the erection of one sign to be installed on the inter-
change. five hundred feet west of the West Interchange off ramp. and that Bozeman announce its desig-
nation as a "Bicentennial Community." The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Commissioner
Taylor and Mayor Sedivy; those voting No. none.

Renewal of Gambling Licenses - Bingo & Raffle
The Acting City Manager presented the following Applications and appropriate fees for a gambling
license for the purpose of operating card tables and annual bingo license.

being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind.
and Mayor Sedivy; those voting No. none.
Request for Water Department to Purchase 30 New Water Meters - Approximately $1.350.00
The Water department has need for 30 5/8 X 3/4 MHF Hersey water meters at an approximate cost of
$1.350.00 and the Acting City Manager requested authorization to purchase the meters.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that the request be
granted and, the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy;
those voting No, none.
Request to Conduct Flag Sale - Kiwanis. 1-3 July 1975
A letter received from the Bozeman Kiwanis Club requesting permission to conduct an American
Flag Sale on 1~3 July 1975 as a fund raising project to support its community service project was
presented.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the Kiwanis
Club be granted permission to conduct the fund drive as set forth. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commission~Tay1or.

Proclamation ~ Kiwanis Flag Day Sales, 1-3 July 1975
Honor America, 4 July 1975
In concurrence with the request of the Kiwanis Club, Mayor Sedivy proclaimed 1-3 July as "Kiwanis
Flag Sale Days" in the City of Bozeman. and urged all citizens to help the Bozeman Kiwanis Club, the
Bridgers Kiwanis Club and the Retired Senior Volunteers by purchasing an American Flag to kindle or
renew a spirit of patriotism and to make possible continued support of community programs.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the Commission
endorse the Mayors proclamation as requested and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer.
Commissioner Vandeventer and Mayor Sedivy; those voting No. none.
Mayor Sedivy proclaimed Friday, 4 July 1975, as "Honor America" day and called upon all citizens,
community and religious leaders, business and labor. schools and veterans organizations to recognize
this special day with appropriate programs and ceremonies.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the Commission
endorse the Mayors proclamation and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Comm~
issioner Taylor; those voting No, none.
