Municipal Building, l8 June 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer. Comm- issioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Acting City Manager Wolf. City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer, and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 11 June 1975, were approved as read. Opening of the Bids for Sidewalk & Curb P~ogram for the year 1975 This was the time and place set for opening bids for the repairing and reconstruction of mis- cellaneous sidewalks and curbs and for curb replacement on Babcock Street and Mendenhall Street. Affidavit of publication of "Notice to Bidders" was presented. and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. The following bids were then opened and read: T & H Contractas. Inc.. Bozeman Robert A. Taylor Construction. Bozeman $38,030.50 43,683.20 The bids were referred to the city engineering staff for final tabulation. consideration and recommendation. Maturity date. and principal amount of bonds issued in Special Improvement District No. 548, entitled: COMMISSION RESOLUTION NO. 1738 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE. MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 548. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that Commission Resolution No. 1738 be passed and adopted and the motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. Principal Amount and Interest SID No. 550 The Acting City Manager presented Commission Resolution No. 1739, setting the date. maturity date, and principal amount of bonds issued in Special Improvement District No. 550, entitled: COMMISSION RESOLUTION NO. 1739 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that Commission Resolution No. 1739 be passed and adopted and the motion was carried by the following Aye and No Vote; those voting Aye being Commissioner Taylor, Commiss ioner l,ehrkind. This was the time and place set for a public hearing to consider the~plication ~f Elton L~ and C. May Bogart for a zoning change from RS-l to AS for all of Block 3 of Bogart's Subdivision No.]. said property being located north of Bozeman off Springhill Road adjacent to-the City Sewage Tre~- men t Plant. The Zone change would permit the estab1ishement of a tree nursery and oth~r plantings, together with structures for processing and onpremises sales and the construction of a single-famil~ r~sidence and two advertising signboards. The Bozeman Zoning Commission, having reviewed the report of the Planning Staff, recommended approval of the zone change from "RS-l to AS." The Commission concurred with the recommendation of the Bozeman Zoning Commission. and it was moved by Commissioner Lebrkind. seconded by Commissioner Vollmer, that they approve the zone classi- fication change from RS-l to AS, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Hearing - John D. Haynes- Request for Zone Change from R-/+ to B-3, property loc~ted at 213 So. Willson The request from John D. Haynes. to change the zone classification from "R-4 to B-3" for the I I I I I I 31rJ South 17 feet of Lot 6. all of Lot 7, and the North 3 feet of Lot 8 in Block E in the Alderson Addition. said property being located at 213 South Willson Avenue, was called for hearing. After reviewing the report of the planning staff and having considered the comments by the petitioner. the Zoning Commission voted unanimously to recommend denial of the request to change the zone classification from "R-4 to B-3." Following a thorough discussion. the Mayor declared the hearing on the South 17 feet of Lot 6. all of Lot 7 and the North 3 feet of Lot 8 in Block E in the Alderson Addition. said property being located at 213 South Willson Avenue, from "R-l+ to B-3" closed. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that they concur in the recommendation of the Zoning Commission and deny the request to change the zone classification from "R-4 to B-3." Those voting Aye were Commissioner Taylor. Commissioner Vandeventer; those voting No being Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy. It was then moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that they approve the zone classification change from "R-4 to B-3" for the South 17 feet of Lot 6, all of Lot 7 and the North 3 feet of Lot 8 in Block E in the Alderson Addition. said property being located at 213 South Wi.llson Avenue. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. And Mayor Sedivy; those. voting No. being Commissioner Taylor. Authorize Water Department to Purchase Copper Pipe - Approximately $3,355.00 The water department has need for copper pipe. and the Acting City Manager requested authori- zation to purchase the copper pipe at an approximate cost of $3,355.00. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Acting City Manager be granted authorization to purchase the copper pipe at an approximate cost of $3.355.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Con~issioner Vandeventer, COffinlissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Authorize Water Department to Purchase 30 Water Meters - Approximately $1,350.00 The Water Department has need for 30 5/8 X 3/4 MHF Hersey water meters at an approximate cost of $1.350.00, and the Acting City Manager requested authorization to purchase the meters. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the request to purchase the water meters be granted. and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lerhkind. Comm- issioner Vollmer and Mayor Sedivy; those voting No. none. Approve Contract Documents for SID No. 548 - Paving and Storm Drain, Graf's Third Addition The contract documents for the construction of SID No. 548, First Phase, Paving Arnold, Hender- son and Colter Streets in Graf's Third Addition, was presented. The Acting City Manager recommended that the contract documents be approved in the amount of $99.446.00. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the contract be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozema~ and that Long Construction, Bozeman, be authorized and directed to proceed with the construction of SID No. 548 and the bid security be returned to Long Construction, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, ComHI- issioner Vandeventer, Commissioner Lehrkind. Fourth Avenue The application from Richard Milledge, 1414 South Fourth Avenue, for a Kennel License, having been delayed for a period of one week to further investigate the area in question, was again presented for discussion and a final decision. Mr. Milledge was present to discuss the kennel license and to answer various question$. A petition signed by a number of interested persons protesting the license was also presented. Following a thorough discussion and in concurrence with the recommendation of the Chief of Police, also concurred in by the Acting City Manager, it was moved by Commissioner Lehrkind, seconded by Commi.ssioner Vollmer. that the request be denied, based upon the dogs creating a nuisance and the motion was carried by the following Aye and No vote: those voting Aye being Commiss ioner Lehrkind, COllnm- issioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Applicatio\ for Beer License - Lions Club, 21-23 June 1975 A request for the Lions club for permission to obtain a City Beer License for the weelend of 21-23 June 1975, alsong with the required fee, was presented. 31G It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that the Lions 01ub, having met all requirements, be granted a license to sell beer at the North Grand Park on the weekend of 21-23 June, 1975, and the motion was carrie~ by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. The Acting City Manager presented an application from the Universal Athletics and the Country Kitchen, along with the required fee of $lO.OO for a raffle license, for the purpose of holding a I raffle on 22 June. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they approve the application for the raffle to be held on 22 June, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. Reques~First National Bank to Use l2.~rt's Grove Bancl-2...tand - 23 July 1975. A letter received from the First National Bank of Bozeman, requesting permisston to use Bogert's B,md Stand on 23 July at 7:00 o'clock p.m. to hold a free admission presentation of the "Emporer's New Clothes and Other Stories" performed by the Musical Theatre Wagon, was presented. The First National Bank will cover all expenses involved with this performance and will not charge admission for attendance. It was moved by Commissioner Lehrkind, seconded by Commissioaer Vollmer, that they be granted permission to use Bogert's Band Stand. as indicated above. and that a letter be addressed to the First National Bank commending them upon arranging for the presentation of the concert. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commiss- ioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Ap['rove Contr~ct with Morriso~aie!,le for Engineering of Bl~achers - Recreatio.!l Comple~. An Agreement between Morrison-Maierle, Inc., Helena, Montana. and the City of Bozeman. whereby the engineer agrees to provide engineering services as described in detail in the Contract for Engineering Services of the Bleachers at the Recreation Complex was presented. Upon concurrence of the Acting City Manager, it was moved by Commissioner Vollmer. seconded by I Commissioner Vandeventer, that they enter into the AgrEment with Morrison-Maierle for engineering services for the bleachers at the Recreation Complex and that the Mayor and Clerk of the Commission .. be authorized and directed to sign the Agreement for the City of Bozeman, and the motion was carried by the following Aye and Nl vote: those voting Aye being Commissioner Vollmer, Commissioner Vande- venter. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Consideration of Walks and Curbs Bids The City Engineering staff, having completed their study of the bids for construction of Walks and Curbs for 1975, recommended that T & H Construction be awarded the bid for the sidewalk and curb construction on the basis of their low bid in the amount of $38.030.50. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the bid be awarded to T & H Construction on the basis of their bid, it being the lowest and best bid submitted and equaling or exceeding the specifications as contained in the "Call for Bids". The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Tay- lor. Commissioner Lehrkind, Commissioner Vollmer and Hayor Sedivy; those voting No. none. Repor~~t the Director of Public Service The Acting City Manager commented on the Report of the Director of Public Service and recommended approval thereof. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the Report of the Director of Public Service be approved and ordered filed. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Ad j ou_~~T!!
