The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building, 11 June 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm-
issioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Acting City Manager Wolf, City
Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 4 June 1975. were approved as corrected.
Continued Hearing, Resolution No. 1733. Intent to Create SID No. 554 - Paving in Figgins Addition.
Having continued hearing on Special Improvement District No. 554 for a period of one week
pending further review of the district and to determine the exact portionof those owners who are
presently living there and in favor of the district and the amount of the district which is still
owned by the contractors was presented for further discussion, consideration and a decision.
After a great deal of discussion, the Mayor declared the hearing closed. It was moved by Comm-
issioner Vandeventer, that they instruct the City Attorney to draw up a resolution creating Special
Improvement District No. 554. The motion died for lack of a second.
It was then moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the city
staff. the contractors and the property owners meet and work out a satisfactory solution for all
concerned and that the resolution creating Special Improvement District No. 554 be tabled and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Vollmer, Commissioner Taylor and Mayor Sedivy; those voting No being Commissioner
Vandeventer.
Authorization to Purchase 30 5/8 X 3/4 MHF Hersey Water Meters - Approximately $1.350.00
The water department has need for 30 5/8 X 3/4 MHF Hersey Water Meters at an approximate cost
of $1,350.00 and the Acting City Manager requested authorization to purchase the meters.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the request to
purchase the water meters be granted and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Comm-
issioner Lehrkind and Mayor Sedivy; those voting No, none.
Request - F.A.S.T. Conduct 4th of July Parade
A letter received from Stuart Whitehair, Chairman of Future Americans Serving Tomorrow, request-
ing permission to conduct a parade on the Fourth of July at 3:00 p.m. was presented. The parade will
begin at the Senior High School parking lot and proceed down Main Street to Lindley Park where it will
disband and a celebration will be held.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that they be granted
permission to conduct the parade and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, Commissioner
Vollmer and Mayor Sedivy; those voting No, none.
Ben Whittle: Rooming House on South Grand Avenue - Complaints
Ben Whittle of 616 South Grand Avenue appeared before the Commission to protest the remodeling
of a one-family dwelling to a boarding house at 612 South Grand Avenue. His reason for protesting
the boarding house was because of overparking. overcrowding and inconvenience.
Following an extensive discussion. it was moved by Commissioner Vollmer, seconded by Commiss-
ioner Vandeventer. that action be deferred for further information and a final decision at a later
date. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those
voting No. none.
Continuation License Bond - Midland Electric Company - $5,000.00
In compliance with Chapter 15 of the Bozeman Municipal Code. the Electricians bond of Midland
Electric in the amount of $5.000.00 was presented. The building inspector had recommended approval
of the bond and the City Attorney approved the bond as to form. It was moved by Commissioner Vande-
venter, seconded by Commissioner Taylor, that the electricians bond in the amount of $5.000.00 be
approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No. none
Request - Sign Variance. Bozeman AMC Jeep. 624 West Main Street
A letter received from Bozeman AMC - Jeep requesting a variance to place some signs, lights
and polces at the Bozeman AMC Dealership located at 624 West Main Street and formerly known as the

Artic Circle Drive In was presented.
Following considerable discussion, it was moved by Commissioner Taylor. that a variance to
place signs, lights and poles at 624 West Main Street be denied. The motion died for lack of a
second.
Upon recommendation of the Acting City Manager, it was moved by Commissioner Lehrkind, se-
conded by Commissioner Vollmer. that they grant the request for a variance to install eight 4 X 8
redwood posts around the exterior of the dealership and to place a four foot wide sign made out I
of exterior plywood around the face of the building and to deny the permit for putting up the lights.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Vollmer. and Commissioner Vandeventer; those voting No being Commissioner
Taylor and Mayor Sedivy.
Application for Kennel License - Richard Milledge. 1414 So. 4th Avenue - Joan Bates, 404 No. l7th
An application received from Richard Milledge, 1414 South Fourth Avenue, requesting a kennel
license in accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code. to-
gether with the required fee was presented.
Morris Klare. 1430 South Fifth Avenue was present to protest issuance of the kennel license
because of causing a nuisance and thus violating Section 5.16.070 of the Bozeman Municipal Code.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that action to
issue a kennel license to Richard Milledge of 1414 South Fourth Avenue be delayed for a period of
one week to further investigate the area in question. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner
Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
An application received from Joan Bates. 404 North Seventeenth Avenue. requesting a kennel
license in accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, to-
gether with the required fee was presented.
The City Manager and the Chief of Police stated they were not aware of any reason to deny the
kennel license and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that
the application be approved and the Director of Finance be instructed and directed to issue a lic- I
ense in accordance therewith. The motion was carried by the fo110wirgAye and No vote: those voting
Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer
and Mayor Sedivy; those voting No. none.
Re~est - Montana National Bank of Bozeman for "No Parking" Areas.
A letter received from the Montana National Bank. requesting a "No Parking" variance on North
Third Avenue and West Mendenhall Street adjacent to the New Drive-In facility was presented.
In concurrence with the recommendation of the City Engineer, also concurred in by the Acting
City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that the "No
parking" variance on North Third Avenue and West Mendenhall Street be granted as modified by the
City Engineer in compliance with the Uniform Traffic Code. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner
Vandeventer. Commission Vollmer and Mayor Sedivy; those vo~ing No. none.
Extension of Conditional Use Permit - West Main Shopping Center (Sabol)
Joe Sabol appeared before the Commission on behalf of the West Main Shopping Center to request
an additional ninety day extension of a conditional use permit to build a shopping center in Block 3
(except Lot 1) and all of Block 4 in Kirk's Subdivision No.4 to the City of Bozeman.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the request for the
additional ninety days extension of the Conditional Use permit be granted and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer,
Commissioner Vandeventer and Commissioner Taylor. those voting No being Mayor Sedivy.
Report - Police Court I
The City Manager commented on the report of the Police Court and recommended approval thereof.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the report of
the Police Court be approved and ordered filed. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor,
Commissioner Lehrkind and Mayor Sedivy; those voting No. none.
Lovelace Realty Incorporated - Sidewalk Abatement. 14-20 West Main Street
A letter received from Winifred S. Lovelace of Lovelace Realty Incorporated. requesting an ex-
tension on the sidewalk repair at 14-20 West Main Street, with the provision that the contractor re-

1ieves any sidewalk hazard temporarily with what is known as a "Skim Coat" was presented.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that they grant
the request for the sidewalk( abatement with the provisions that the contractor relieve any side-
walk hazard with a "Skim Coat" on a temporary basis. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner
Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Beer License - Lions Club. Weekend of l4-l5 June 1975
A request from the Lions Club for permission to obtain a City Beer License for the weekend of
14-15 June 1975. along with the required fee was presented.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that the Lions Club
having met all requirements, they be granted a license to sell beer at the North Grand Park on the
weekend of 14-15 June and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer
and Mayor Sedivy; those voting No. none.

The Acting City Manager checked the claims and found them to be true and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance be instructed to
issue warrants in payment. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer.
that the claims be approved as presented and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer.
Commissioner Taylor and Mayor Sedivy; those voting No. none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those
voting No. none.
