Following a thorough discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner
Vollmer. that the items as listed with the exception of the Shallow Pool Insert be approved. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
Commissioner Lehrkind. Commissioner Vandeventer. and Mayor Sedivy; those voting No being Commiss-
ioner Taylor.
The Shallow Pool Insert is a top priority item. The size and cost to be researched by the
Architect and the information returned to the City Commission as soon as possible.
Adiournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Vollmer. seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,

The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building, 26 March 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer. Comm-
issioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. City Manager Fryslie. Assistant City
Manager Wolf. City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.

Continued Hearing - Rezoning at Peach and Wallace ~ C. W. Sparks
The request for a zone change from R-5 to M-l on Tracts land 2 in Block 6 of the Babcock and
Davis Addition, said property belonging to Mr. C. W. Sparks, having been continued for a period of one
week for view of the area and further study of the application. was presented for a continued hearing,
consideration and a final decision.
Several interested persons were again present to oppose the zone change and present a petition
signed by 44 property owners and residents who also opposed the zone change.
Mr. Sparks was present to discuss the area in question and answer any questions that might arise.
Following a thorough discussion. the hearing was closed. In compliance with the recommendation
of the Bozeman Zoning Commission. it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that they approve the requested zone change from R-5 to M-1 on Tracts 1 and 2 in Block
6 of the Babcock and Davis Addition. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor. Commissioner
Lehrkind and Mayor Sedivy; those voting No. none.
Park Improvement Program (Bond Issue Funds and BOR)
The proposed Park Improvement Program. involving Bond Issue Funds and Bureau of Outdoor Recrea-
tion Funds, having been continued for a period of two weeks for additional study, was again presented
for discussion and a final decision.

Following a discussion. the City Manager/instructed to program the large cover for the multi-
purpose arena at Bogert Park as the final project for obligation. It was moved by Commissioner Van-
deventer, seconded by Commissioner Taylor. that they approve the entire Park Improvement Program with
the exception of the Paving (parking and road area) at Bogert Park and Lindley Park and that an appli-
cation be submitted to the Bureau of Outdoor Recreation for matching funds. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor.

Request to Hang Banner Across North Seventh Avenue - Montana Lundstrom Crusade. 15 Apr. thru 4 May
A letter received from the Lundstrom Crusade requesting permission to place street banners across
North Seventh Avenue and East Main Street from 15 April through 4 May 1975 was presented.
Because of the problems created by banners not being removed within the specified length of time.
it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that future requests to place
banners across North Seventh Avenue and Main Street be approved with the stipulation that a $25.00
deposit per banner be required and returned to the organization only if the banner is removed within
one week after the final date of the activity. Within the stipulations as provided, the Lundstrom
Crusade was authorized to erect their banners on North Seventh Avenue and East Main Street. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor.

No. none.
Request to Put Tree in Planter on Main Street in Front of Chamber of Commerce ~ Vernon Koelzer
Mr. Vernon Koelzer of the Beaver Pond appeared before the Commission to request permission to
place a planter with a tree in it in front of the Chamber of Commerce on a trial basis. Mr. Koelzer's
purpose is to see if the citizens of Bozeman feel that this has an aesthetic value to the downtown area.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that Mr. Koelzer be
given permission to place the planter in front of the Chamber of Commerce on a trial basis. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commiss-
ioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
Larry Wallace - County Sanitation Official - Garbage Slide Show
Larry Wallace, County Sanitation Official, appeared before the Commission to present slides
showing the garbage nuisance in the City of Bozeman. He stated that some sort of action should be
taken so that the nuisance would not become a health hazard. The Commissioner thanked Mr. Wallace

for his presentation and requested his assistance in taking action on the matter.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.

A letter from Mr. J. H. Morrow. Attorney at Law. on behalf of the Estate of " Marguerite B.
Roecher. deceased. was presented along with a check in the amount of $3.000.00" for the. benefit of/the
Bozeman Public Library. to be used in the purchase of books at a rate of $500.00 per year for a period
of six years.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer.'that an expression
of gratitude be addressed to Mr. J. H. MOrrow. Attorney at Law on behalf of the Marguerite B.
Roecher Estate. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor
Sedivy; those voting No, none.
Consideration of Farmers' Market to be Established on City Property
A letter addressed to the City Commission by several board of directors of the Farmers' Market
proposing to establish a farmers' market to provide an attractive opportunity for the sale of
locally grown garden produce and crafts was presented. Bogert Grove appeared to be the most
suitable location for the proposed Farmers' Market.
Following a discussion. it was moved by Commissioner Vandeventer. seconded by Commissioner
Taylor, that consideration of the proposed Farmers' Market be continued for a period of one week to
be brought to the Commission for final action on Wednesday. 9 April 1975. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor.
Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Neighborhood Facility Committee Discussion
Several members of the Neighborhood Facility Planning Committee appeared before the Commission
to discuss the proposed Neighborhood Facility Planning and to present a preliminary type of proposal.
Following a discussion. it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer.
that an expression of gratitude be extended to the Committee for the presentation of the proposed
Neighborhood Facility. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and
Mayor Sedivy; those voting No. none.
Confirmation of Fire Fighters - Vern Backman & Dale Hanson. effective 1 April 1975
The Fire Chief reported that Fire Fighte~ Vern Backman and Dale Hanson had satisfactorily
completed the required one year probationary period and recommended that they be confirmed as
regular fire fighters. effective 1 April 1975. The City Manager concurred in the recommendation of
the Fire Chief and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that
