HomeMy WebLinkAbout1975-05-28 I I I 30~ Bozeman, Montana 28 May 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building. 28 May 1975, at l:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer, Commiss- ioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, City Manager Fryslie. Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meetingwith a prayer and the following proceedings were had: Minutes of the regular meeting held on Wednesday. 21 May 1975. were approved as read. Consideration of Bids - Truck and Garbage Packer The Commission was referred to the opening of bids for one 26,000 lb. Standard G.V.W. Rating Truck and Rear Loading Refuse Compaction Unit on 21 May 2l 1975. Following a discussion. it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that they delay action on the consideration of the bids for a period of one week. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Consideration of Construction Bid - SID No. 548 The engineers representing consultants. Thomas, Dean & Hoskins. Inc.. having completed their study of the bid submitted by Long Construction of Billings for the construction of paving Arnold. Henderson and Colter Streets. Graf's Third Addition; and having prepared a final tabulation of the bid. recommended that the bid be awarded to Long Construction of Billings on the basis of their bid in the amount of $99.446.00 contingent upon the sale of the bonds. The Commission concurred with the recommendation of the engineers. also concurred in by the City Manager. and it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that Long Con- struction be awarded the bid in the amount of $99.446.00 contingent upon the sale of the bonds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Sale of Bonds The City Manager stated that according to the affidavit of publication. this was the time and place set for the bond sale of Special Improvement District Nos. 548 and 550. The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated that the amount of bonds to be sold for each district would be the same as the advertised amount and announced that the City was ready to conduct the bidding on the bonds of SID No. 548 in the amount of $125.000.00 A sealed bid submitted by D. A. Davidson & Company, Great Falls, Montana, along with a good faith check in the amount of $6.250.00 as prescribed by the Notice of Sale, and being the only bid submitted. bid 8.20% plus a premium of $12.50. Following discussion. it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they delay action on the sale of the bonds for Special Improvement District No. 548 for a period of one week and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none It was then announced that the City was ready to conduct the bidding on the bonds of SID No. 550 in the amount of $75,000.00. A sealed bid submitted by D. A. Davidson & Company, Great Falls. Montana. along with a good faith check in the amount of $3,750.00 as prescribed by the Notice of Sale. and being the only bid submitted, bid 8.20% plus a premium of $9,50. Following a discussion. it was moved by Commissioner Taylor, seconded by Commissioner Lehrldnd, that they delay action on the sale of the bonds for Special Improvement District No. 550 for a per- iod of one week and the motion was carried by the following Aye and No vote: .those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Hearing. Intent to Create SID No. 553 - Storm Drainage. Langohr Ave.. Portion Westridge, Lot 1 Blk. 9 Resolution No. 1734, Creating SID No. 553 Figgins Addition. This was the time and place set in Commission Resolution No. 1732 to hear pro~ests to the creation of Special Improvement District No. 553. Affidavit of publication of Notice and the Clerk's mailing certificate. stating all property owners had been notified as required by law. were presented. There were no written protests on file. and no one appeared to protest verbally. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that Commission Resolution No. 1734 creating Special Improvement District No. 553 for the purpose of construction and installation of 30G Storm Drains on Langohr Avenue, a portion of Westridge Drive and across Lot 1. Block 9 of Figgins Addition to the City of Bozeman, entitled: COMMISSION RESOLUTION NO. 1734 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA. CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT No. 553 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCi!NG AND INSTALLING A STORM DRAINAGE SYSTEM INCLUDING NECESS- ARY STORM DRAINAGE PIPE, MANHOLES. INLETS, DITCHES, AND OTHER NECESS- ARY APPURTENANCES TO STORM DRAINAGE. TOGETHER WITH ALL TRENCH EXCAVATION AND BACKFILL IN LANGOHR AVENUE, A PORTION OF WESTRIDGE DRIVE. AND ACROSS LOT 1 OF BLOCK 9, ALL IN THE FIGGIN'S ADDITION TO THE CITY OF BOZEMAN. MONTANA. as prepared by the City Attorney be passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vande- venter, Commissioner Taylor and Mayor Sedivy; those voting No. none. Amendmcnt to Zoning Code - Revision of R-O District - Gallatin Farm Burcau This was the time and place set for a public hearing to consider an amendment to the Bozeman Area Zoning Code dealing with the Residential (R-O) District. This proposed revision of the Resi- dential Office District is a follow-up to a zoning change request submitted by the Gallatin Farm Bureau in September. 1974. It was felt that further revision of the R-O District was necessary to eliminate certain objectionable uses in order that the creation of an R-O District would be compatible with surrounding residential districts. The Zoning Commission, having reviewed the proposed revision unanimously voted to recommend approval of this amendment of the Residential Office District of the Zoning Code provided that the staff make changes in Section 12.3 and 12.4 that would not tie these regular districts to a specific zone. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they concur in the recommendation of the Zoning Commission and approve the amendment of the Residential Office District of the Bozeman Zoning Code and that the City be instructed to draw up an ordinance changing Section 12.3 and 12.4 of the Bozeman Zoning Code. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor. Commiss- ioner Lehrkind and Mayor Sedivy; those voting No. none. Sidewalk and Curb Program for 1975 The City Engineering staff completed a limited "Safety Only" sidewalk program on Bozeman's north- east side along with some curb replacement on Babcock and Mendenhall Streets. and sidewalks along North Seventh Avenue from Durston to Oak Street for the year 1975. Following discussion, it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind. that they table the 1975 program for curb replacement on Babcock and Mendenhall Streets for a period of one week for inspection. further study and contact with additional property owners. then to be brought back for further consideration and a final decision on Wednesday. 4 June 1975 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. being Commissioner Taylor. It was then moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that the City en- gineering staff's recommendation for repair of a limited "safety only" sidewalk program within Bozeman's northeast side for 1975 be approved and that the sidewalk program along North Seventh Avenue from Durston to Oak Street be delayed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Van- deventer. and Mayor Sedivy; those voting No, none. Application for Raffle License - Babe Ruth Baseball - 16 June 1975 The City Manager presented an application from the Babe Ruth Baseball organization along with the required fee of $11.25 for a raffle to be held on 16 June 1975. Upon recommendation of the City Manager. it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that they approve the appli- cation for the raffle. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Ad10urnment There being ~o further business to come before the Commission at this time. it was moved by Comm- issioner Vandeventer. seconded by Commissioner Taylor. that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Taylor.
