Municipal Building, 14 May 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Frys1ie, Assistant City Manager Wolf and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held on Wednesday, 7 May 1975, were approved as read. Continued Bond Sale - S.1. D. No. 551 - $28.000.00 - Howard G. Lewis - 7 3/4% The City Manager announced that this was the time and place set for the continuation of the bond sale for Special Improvement District No. 551 in the amount of $28.000.00. Howard G. Lewis having presented his good faith check in the amount of $1,400.00 as prescribed by the Notice of Sale, and being the only bidder, bid 7 3/4% as the lowest effective interest rate accruing to the City of Bozeman. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they concur in the recommendation of the City Manager also concurred in by the Director of Finance, that the sale of the bonds for Special Improvement District No. 551 be awarded to Howard G. Le\"is. Bozeman. at 7 3/4% and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No. none. Sijewalk-.--lE"ee ~lanting Proposal - lL Evans &.-.::!.:.~: Office Machines - Vari~ A Jetter received from Robert Evans and J. & H. Office Equipment requesting a variance to the City code to allow them to plant two trees in front of the properties located at 119 and 121 West Main Street was presented. Greg Morgan and Robert Evans were present to explain their request for a variance to the City Code. The City Manager raised the question of whether this was the opportune time to do this type of thing in vie'" of the upcoming Downtown Redevelopment programs. Mr. Morgan stated their reason for requesting the variance was that they felt this was a demonstration to determine whether the planting of trees was the proper type of beautification. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, tba-t-the-y.be granted ,-- a variance of the City code to plant two trees in front of the property at 119 and 121 East Main Street on an experimental basis. Park Recreation Program - a) b) Hawk Tennis Team Use of fiouth Side Courts ._-'--'- Tennis Gl inic Proposal - 29uth Side Courts a) The City Manager complied with the request of the City Commission and had contacted the Recreation Board to review the schedule of the Tennis Courts. upon review by the Board Members, they agreed to leave their recommended schedule the way it was approved at the April 19, 1975 meeting. I I I 2B7 b) The Tennis Clinic proposal for the South Side Courts was presented. The City Manager informed the Commission that there are some policy problems that need to be resolved. Always in the past the City has declined any proposal to undertake an income producing activity on City property. I Allan Green. Chairman of the 'Community Recreation Board and A. Glen White, Recreation Director, were present to explain the program. Montana State University Tennis Coach, Jerry Peach. was present to discuss the tennis clinic. Following an extended discussion. it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they table the Tennis Clinic proposal for a period of one week for further study and a final decision on Wednesday. 21 May 1975. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. Commissioner Taylor. Request for Sanitary Sewer S.1. D. - C. V. Henderson subdivision A petition received from Mr. C. V. Henderson. petitioning the City of Bozeman to create a special improvement district for the purpose of construction of sanitRry sewers in said subdivision was presented. The Commission concurred in the recommendation of the City Manager, and it was moved by Comm- issioner Vollmer, seconded by Commissioner Vandeventer. that they instruct the City Attorney to draw up the resolution of intention to create the district for the sanitary sewer construction as soon as the City' staff furnishes the necessary information. Commission Resolution No. 1733 - Intent to Create S. 1. D, No. 554, Paving Figgins Addition - Hearing 4 June 1975 COMMISSION RESOLUTION NO. 1733 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA. DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN. MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 554 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC~CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO ON MORROW STREET. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Bozeman Lions club - Parade 17 June 1975 A letter received from the Bozeman Lions Club. Inc.. requesting permission to hold a parade in connection with the N.I.R.A. on Tuesday, 17 June 1975, was presented. The parade is to begin on South Church Avenue at Bogert Park and proceed north to Main Street and west on Main Street to Eleventh Avenue to the Montana State University parking lot at Lincoln Avenue where it will disband. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that permission to conduct the parade be granted and the motion was carried by the following Aye and No vote: those Vandeventer and Mayor Sedivy; those voting No, none. voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Certify Examination of Depository Securities In compliance with the provisions of Section 16-2618. R.C.M.. 1947, Mayor Sedivy and Commissioner Vollmer proceeded to examine the receipts of Depository Bonds and Securities held by the Director of Finance as security for City funds deposited in Bozeman banks. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the securities be approved and a list of these be set forth in full in the minutes of the meeting.
