The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building. 7 May 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commiss-
ioner Vandeventer, Commissioner Taylort Commissioner Lehrkind. City Manager Fryslie, Assistant City
Manager Wolf. City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 30 April 1975, were approved as corrected.
Consideration of Construction Bids - SID's 550t 551 and 552, Intermountain Construction - $97t854.37
The engineers representing consultants. Thomas. Dean & Hoskinst Inc.. and the city engineer
having completed their study of the bids submitted for the construction of Watermains. SID No. 550.
Graf's 3rd & Figgins Addition; Sanitary Construction SID No. 551. (Second Phase) Graf's 3rd Addition;
and Water and Sewer Construction, SID No. 552, Cutting Street, having prepared a final tabulation of
the bids recommended that the bid be awarded to Intermountain Construction. Bozeman, on the basis of
their low bid in the amount of $97.854.37, contingent upon the sale of the bonds.
The Commission concurred with the recommendation of the engineers. also concurred in by the City
Manager. and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that Inter-
mountain Constructiont Bozemant be awarded the bid on the basis of their low bid in the amount of
$97,854.37. contingent upon the sale of the bonds. and that the bid security of the unsuccessful
bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind,
and Mayor Sedivy; those voting No. none.
Consideration of Bids - Bituminous Plant Mix Material. Pioneer Ready Mix. Bozeman
The Commission was referred to the opening of bids for the purchase of 5.700 tons Bituminous
Plant Mix to be used for street maintenance and reconstruction. to be paid out of Gas Tax Funds, HB42-
436. The City staff having completed their study of the bids recommended that Pioneer Ready Mix,
Bozeman. be awarded the bid for Bituminous Plant Mix Materials on the basis of their low bid.
The City Manager concurred in the recommendation of the City Staff and recommended that they
award the bid to Pioneer Ready Mix. but that they decrease the amount of Bituminous Plant Mix from
5.700 tons to 4.600 tons due to the fact that the original amount exceeds the amount of Gas Tax
money available. which is approximately $53,000.00.
It was moved by Commissioner Vandeventert seconded by Commissioner Taylort that Pioneer Ready
Mix be awarded the bid for 4.600 tons Bituminous plant Mix Material on the basis of the same price
quoted on 5,700 tons. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer.
and Mayor Sedivy; those voting No. none.
Sale of Bonds: SID No. 551 - $28tOOO.00 b) SID No. 552 - $31.000.00
The City Manager stated that according to the affidavit of publication. this was the time and
place set for the bond sale of Special Improvement District No. 551 and 552.
The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated
that the amount of bonds to be sold for each district would be the same as the advertised amount and
announced that the City was ready to conduct the bidding on the bonds of SID No. 551 in the amount of
$28.000.00.
There were no sealed bids and there was no one present to bid on bonds of SID No. 551 in the
amount of $28.000.00.
It was then announced that oral bids for the purchase of SID No. 552 bonds in the amount of
$31.000.00 in accordance with the "Notice of Sale" of bonds would be received.
Jack Brant, having presented his good faith check in the amount of $1.550.00 as prescribed by
the "Notice of Sale" and being the only oral bidder. bid 7% as the lowest effective interest rate
accruing to the City of Bozeman. The City Manager stated the bid of 7% by Jack Brant of Bozeman was
acceptable add it was moved by Commissioner Tay10rt seconded by Commissioner Lehrkind. that the sale
of the bonds for Special Improvement District No. 552 be awarded to Jack Brant at 7% and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner
Lehrkind. Commissioner Vandeventer. Commissioner Vollmer. and Mayor Sedivy; those voting No. none.
It was then moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Commissi~
authorize the City Manager to negotiate a sale for the bonds of SID No. 551 and bring the results of
the negotiations back to the City Commission for their consideration. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Comm-
issioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none.

Hearing, Zone Change AS and RS-l to M-l-T, Baldwin-Bowman
This was the time and place set for a public hearing to consider the request of Robert Baldwin
and Darrell Bowman for a zone classification change from AS and RS-l to M-l-T on a tract of land lo~
cated on the northwest corner of the intersection of Bridger Drive and Flour Mill Road No.9. ex-
tending westerly a distance approximately 1230 feet along Bridger Drive with a depth of 320 feet
therefrom. and extending northerly along Flour Mill Road No.9 a distance of 975 feet to include the
Osborne Subdivision.
Following discussion. it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer,
that they concur in the recommendation of the Zoning Commission and approve the zone classification
change from AS and RS-l to M-l-T zone. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commiss-
ioner Lehrkind and Mayor Sedivy; those voting No, none.
Authority to Purchase Six Fire Hydrants - Approximately $2,300.00
The Fire department has a need for six fire hydrants at an approximate cost of $2.300.00. It was
moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that they concur in the recommend-
ation of the City Manager and approve the purchase of six fire hydrants in the estimated amount of
$2,300.00 and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer. and Mayor Sedivy;
those voting No, none.

A labor Management Relation Course has been scheduled to be held in Denver. Colorado. on 13-16
May 1975 and the City Manager requested authorization for Assistant City Manager Wolf to attend the
course and. it being in the public interest. his expenses be paid from the appropriate fund. It
was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that Assistant City Manager
Wolf be authorized permission to attend the Labor Management Relation Course and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner
Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none.
Utility Easement for Sanitary Sewer - I..D.S. Church
A Utility Easement Agreement by and between the L.D.S. Church and the City of Bozeman for the
purpose of installing. operating. and maintaining a sewer line thereto upon and across the western
ten (10) feet of Lot 2, Block 3 and the westerly ten (10) feet of Block 1, Tract A, Graf's 3rd
addition to the City of Bozeman at a cost of $383.00 was presented.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that the Utility
Easement Agreement be entered into by the City and that the Mayor and Clerk be authorized and dir-
ected to sign for the City and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor
and Mayor Sedivy; those voting No, none.
Gallatin Saddle Club - Rid-a-Thon- for Lung Association - 31 May 1975
A letter received from the Gallatin Saddle Club requesting permission to conduct a "Horseback"
Rid-a-thon for the Lung Association on 31 May was presented.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that they be granted
permission to conduct the Rid-a-thon for the Lung Association on 31 May and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vande-
venter, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none.
Resolution No. 1732 - Intent to Create SID No. 553. Hearing 28 May 1975

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA.
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN. TO CREATE A
SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS-
TRICT NO. 553 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A STORM I
DRAINAGE SYSTEM INCLUDING NECESSARY STORM DRAINAGE PIPE, MANHOLES,
INLETS. DITCHES. AND OTHER NECESSARY APPURTENANCES TO STORM DRAINAGE.
TOGETHER WITH ALL TRENCH EXCAVATION AND BACKFILL IN LANGOHR AVENUE.
A PORTION OF WESTRIDGE DRIVE, AND ACROSS LOT 1 OF BLOCK 9, ALL IN THE
FIGGINS ADDITION TO THE CITY OF BOZEMAN, MONTANA.

The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Vandeventer. seconded by Commissioner Taylor. that Commission Resolution No. 1732 be passed
and adopted and 28 May 1975 be the date set for public hearing and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor,
Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.

Reports
The City Manager commented on the reports of the Fire Chief and Building Inspector and recommen-
ded approval thereof. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that
the reports be approved and ordered filed and the motion was carried . . . . .
Proclamation - Nursing Home Week, 11-17 May 1975
Mayor Sedivy proclaimed the week of 11-18 Mayas "Nursing Home Week" as requested by the Amer-
ican Health Care Association and urged all citizens to focus attention on the needs of the convales-
cent patients. the agedly and chronically ill. and on the quality of care provided by the long term
care profession in Montana.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that they endorse the
Mayors proclamation as presented and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer. Commissioner
Taylor and Mayor Sedivy; those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approve d and the Director of Finance be instructed to
issue warrants in payment. It was moved by Commissioner Vollmer. seconded by Commissioner Vande-
venter, that the claims be approved as presented and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner
Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none.
Ad;ournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
