The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building. 30 April 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Comm-
issioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, City Manager Fryslie. Assistant
City Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Vollmer. opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday. 23 April 1975. were approved as read.
Open Construction Bids - SID No. 550 - Water Main, Graf's 3rd & Figgins Addition
SID No. 55l - Sanitary Sewer (Second Phase) Grafts 3rd Addition
SID No. 552 - Water & Sewer. Cutting Street
This was the time and place set for opening bids for the construction of Watermains SID No. 550,
Graf's 3rd & Figgins Addition; Sanitary Sewer Construction SID No. 5Sl. (Second Phase) Grafts 3rd
Addition; and Water and Sewer Construction SID No. 552, Cutting Street. Affidavit of publication of
"Notice to Bidders" was presented. It was moved by Commissioner Vollmer. seconded by Commissioner
Vandeventer. that the bids be opened and read and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor,
Commissioner Lehrkind and Mayor Sedivy; those voting No. none.
The following bids were then opened and read:

The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Vandeventer, seconded by Commissioner Taylor. that the bids be referred to the engineers
representing Thomas. Dean & Hoskins. and the City Engineering staff for final tabulation, consider-
ation and recommendation 7 May 1975. and that the bid security checks be returned to all but the
three lowest bidders. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer
and Mayor Sedivy; those voting No, none.
Open Bids - Bituminous Plant Mix Material
This was the time and place set for opening bids for 5.700 tons Bituminous plant Mix to be
used for street maintenance and reconstruction. to be paid out of Gas Tax HB-254 funds. Affidavit
of publication of "Notice to the Bidders" was presented. It was moved by Commissioner Taylor. se-
conded by Commissioner Lehrkind. that the bids filed with the Clerk of the Commission be opened and
read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor. Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer. and Mayor Sedivy;
those voting No. none.
The following bids were then opened and read:

The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Lehrkind. seconded by Commissioner Vollmer. that the bids be referred to the engineering
staff for their study and final recommendation on Wednesday. 7 May 1975, and the motion was carried
by the following Aye and No vote: Those voting Aye being Commissioner Lehrkind. Commissioner Vollmer.
Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No, none.
Open Bids - Packer Truck Unit
Due to a possible error in the Garbage Packer Truck specifications for the Sanitation Department,
it was moved by Commissioner Vollmer. seconded by Commissioner vandeventer. that all sealed bids for
the 26.000 Standard G.V.W. Rating Truck and Rear-Loading Refuse Compaction Unit be returned unopened
to the registered bidders. The specifications will be examined and rewritten and readvertised for
opening on Wednesday. 21 May 1975 at 1:15 o'clock p.m. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner
Taylor. Commissioner Lehrkind. and Mayor Sedivy; those voting No. none.
Larry Wallace - Report on Garbage Nuisance
Larry Wallace. County Sanitation Official. appeared before the Commission and gave a short
report on the garbage nuisance and dog survey. The survey revealed that about half of the people

contacted had complied with the regulations.
Hearing, David Osterman - Conditional Use Permit for Hulti Family Dwelling
This was the time and place set for a public hearing to consider the request of Mr. David
Osterman. for a conditional use permit to construct six efficiency units of approximately 471
square feet each on Lot 4. Block 2. of Kirk's subdivision and zoned Residential-3.
The Zoning Commission having reviewed the request. voted unanimously to recommend approval of
the conditional use permit subject to the provisions of adequate screening of the parking area by
the construction of a solid fence six feet high on the western. northern, and southern boundaries
of the site.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that they concur in
the recommendation of the Zoning Commission and approve the request for the conditional use permit
to construct the six effieiency units in the R-3 Zone. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner
Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Hearing, Waddell Construction Company - Conditional Use Permit for Warehouse in H-l-T Zone
This was the time and place set for a public hearing to consider the request of Waddell Constr-
uction Company. Helena. Montana. for a conditional use permit in the M-l-T Zone to build eleven
warehouse units for enclosed storage on 1.5 acres located on North Rouse Avenue. north of and imme-
diately adjacent to the Sweetheart Bread Store.
After review of the staff findings and consideration of public testimony, the Zoning Commission
voted unanimously to recommend approval of the conditional use permit based upon the following
conditions:
1. That a special permit be obtained from the City Building Inspector. if
necessary. to insure adequate floodproofing safeguards for the proposed
one bedroom apartment unit.
2. That there be a 65 foot setback from the centerline of Rouse Avenue.
3. That the sign meet the approval of the City Commission and it not be
illuminated.
4. That it be noted that the Zoning Commission feels that the parking
requirement is satisfied in view of the particular use of the proposed
development as there is adequate parking around each of the warehouse
buildings.
Following discussion. it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind.
seconded by Commissioner Taylor. that they concur in the recommendation of the Zoning Commission and
approve the Conditional Use Permit for warehouse units in M~l-T Zone. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind.
Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none.
Presentation - National Safety Week - Ninth Grade Students
Several Ninth Grade Students appeared before the Commission in regard to National Safety Week.
urging all citizens to participate and support all activities during Safety Awareness Days and all
year long.
Mayor Sedivy proclaimed 1-10 May 1975 as "Safety Awareness Days" in accordance with National
Safety Week. It was moved by Commissioner Lehrkind. seconded by Comnlissioner Vollmer. that they
endorse the Mayor's proclamation. and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner
Taylor and Mayor Sedivy; those voting No. none.
Authority to Purchase Thirty 3/4" Water Meters - $1,350.00
The Water department has need for 30 3/4" Water Meters at an approximate cost of $1.350.00.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the request to
purchase the water meters be granted and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Comm-
issioner Lehrkind and Mayor Sedivy; those voting No. none.
Authority to Conduct "Honey Bear" Sale - Jaycees. 3 May 1975
A letter received from the Bozeman Jaycees requesting permission to conduct a "Honey Bear" sale
on Saturday. 3 May 1975. on Main Street and North Seventh Avenue. with the proceeds going to the Mont-
ana Special Olympic Program was presented.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the request for
the Bozeman Jaycees to conduct the "Honey Bear" sale be granted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor,
Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.

Annexation Agreement - Myda P. Inabnit - Griffin Drive
An Annexation and Utility Connection Agreement by and between the City of Bozeman and Myda P.
Inabnit for permission to connect a tract of land in the SEt of the SEt of Section 31. Township 1
South. Range 6 East of the Montana Principal Meridian. Gallatin County. Montana. at no cost to the
City of Bozeman was presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager and
it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the Annexation and Utility
Agreement. having been executed by Myda P. Inabnit, be approved and the Mayor and Clerk of the Comm-
ission be authorized to sign for the City. and the motion was carried by the following Aye and No
Vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer.
Commissioner Vandeventer and Mayor Sedivy; those voting No. none.
Proclamation - Loyalty Day. 1 May 1975
Mayor Sedivy proclaimed 1 May 1975 as "Loyalty Day" and urged all his fellow citizens to take
full advantage of the special occasion to affirm his or her love of Flag and Country and urge every-
one to display the Flag of the United Stated and participate in public activities.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that theyconcur in the
Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and
Mayor Sedivy; those voting No. none.
License Bond - C.P. Electric - Electrician $5.000.00
In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrical Bond of C. P. Elect-
ric in the amount of $5,000.00 was presented. The City Manager stated the Building Inspector had
recommended approval of the bond. and the City Attorney had approved the bond as to form.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the above lic-
ense bond be approved and the motion was carried by the following Aye and No vote; those voting Aye
being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind
and Mayor Sedivy; those voting No. none.
Discussion - Bozeman Growth Study - Paul Bolton. City County Planning Director
A copy of the preliminary report of the growth study that the Planning Board has been doing
was presented to the Commission. Paul Bolton representing the City-County Planning Board gave a
preliminary report on the progress of the Growth Study Plan of the City of Bozeman.
The City Manager announced at this time, that the Planning Board had appointed Mr. Bolton as
the New Planning Director of the City County Planning Department. The Mayor and Commission offered
their congratulations and expression of confidence.

Water Cemetery Library
The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Vandeventer, seconded by Commissioner Taylor. that the reports be approved and ordered
filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those
voting No, none
Commission Resolution No. 1731 - Develop Coordinated Water Quality Preservation System
COMMISSION RESOLUTION NO. 1731
RESOLUTION INDICATING INTENT TO JOIN WITH OTHER GENERAL PURPOSE
UNITS OF LOCAL GOVERNMENT IN THE GALLATIN AND MADISON RIVER DRAIN-
AGE AREA TO DEVELOP A PLAN RESULTING IN A COORDINATED WATER
QUALITY PRESERVATION MANAGEMENT SYSTEM FOR THE AREA.
was presented.
Following a discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer.
that Commission Resolution No. 1731 be passed and adopted and that they appoint Robert A. Taylor to
represent the City of Bozeman and the motion was carried by the following Aye and No vote; those
voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor
Sedivy; those voting No being Commissioner Taylor.
Plans and Specifications - SID No. 548 - Paving Arnold, Henderson. & Colter Streets, Graf's 3rd Addn.
Plans and specifications covering the proposed improvement in Special Improvement District No.
548 for construction of paving Arnold. Henderson and Colter Streets in Graf's Third Addition as
prepared by Thomas. Dean & Hoskins. Inc.. was placed before the Commission.

Upon recommendation of the City Manager. it was moved by Commissioner Taylor, seconded by Comm
issioner Lehrkind. that the plans and specifications as presented be approved and that the Clerk of
the Commission be authorized and directed to publish a "Call for Bids" for the construction of Spec-
ial Improvement District No. 548 with an opening date of 21 May 1975 and to advertise for bids for
the Sale of Bonds in the approximate amount of $125.000.00 to be received on 28 May 1975 and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor.

Steve Copeland - Southside Tennis Courts
Steve Copeland appeared before the Commission to complain that those not belonging to an orw
ganized group are deprived of the opportunity to make use of the existing tennis facilities because
of the schedule setup by the Recreation Board.
Following a discussion. it was moved by Commissioner Vandeventer. seconded by Commissioner
Tayolr. that they instruct the City Manager to ask the Recreation Board to once again review the
schedule of the Tennis Courts. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. Commissioner
Vollmer and Mayor Sedivy; those voting No. none.
Mrs. John Dunse- Swimming Pool Fees
Mrs. John Dunse. 219 South Bozeman Avenue. appeared before the Commission to make inquiry about
the swimming pool fees. It was explained that the tickets will be in books that can he utilized
either as child or adult admission.
