Municipal Building, 16 April 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, City Manager Frys1ie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held on Wednesday. 9 April 1975, were approved as read. Authority to Call for Bids - Road Surface Aggregate - Open 30 April 1975 The City Manager requested authorization to call for sealed bids for 5.700 ~6ns of Bit~minous plant mix material to be used for street maintenance and reconstruction and to be paid out ofC~s Tax HB-254 funds. It was moved by Commissioner Vollmer, seconded by Commissioner V~ndeventer. that the request be approved and the Clerk of the Commission be authorized and directed to issue a "eall for Bids" to be opened 30 April and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Authority to Call for Bids - (',arbage Packer Truck - Open 30 April 1975 The Sanitation Department has need for a 26.000 lb. Standard G.V.W. Rating Truck on which will be mounted a Rear-Loading Refuse Compaction Unit. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that the purchase be authorized and the Clerk of the COlmnission be directed to issue a "Call for Bids" for the purchase to be received and opened 30 April 1975. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. Discussion of Continuance of the World Family School Representatives of the World Family School were present to request an extension of their Conditional Use Permit. Following discussion. it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that they approve the request to extend the conditional use permit for a period of two years. After further discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they amend the original motion to read five years in place of two years, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind. and Mayor Sedivy; those voting No being Commissioner Taylor. The Commission then voted on Commissioner Taylor's amended motion and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. being Commissioner Taylor. Ordinance No. 953 - Flood Hazard Zoning Regulations Ordinance No. 953 repealing Ordinance No. 952, establishing a flood hazard district, defining its boundaries, etc. was presented as follows: I I I 285 ORDINANCE NO. 953 I AN ORDINANCE OF THE CITY OF BOZEMAN. MONTANA. ESTABLISHING A FLOOD HAZARD DISTRICT. DEFINING ITS BOUNDARIES. PROVIDING FOR THE ISSUANCE OF SPECIAL PERMITS, PROHIBITING SPECIFIC USES. DESIGNATING FLOODPROOFING REQUIREMENTS. PROVIDING FOR APPEALS AND VARIANCES. AND REPEALING ORDINANCE NO. 952 AND ALL ORDINANCES IN CONFLICT HEREWITH. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that Ordinance No. 953 establishing a Flood Hazard District and repealing Ordinance No. 952 be passed and adopted to become effective 15 May 1975. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Water Superintendent Ralph E. Dunahoo - Montana Waterworks Man of the Year The City Manager advised the Commission that it gave him a great deal of pleasure to announce that Water Superintendent Ralph E. Dunahoo was the recipient of the Montana Waterworks Man of the Year Award and recommended that he be authorized to attend the American Waterworks Convention to be held in Minneapolis 8-13 June 1975. Mayor Sedivy congratulated Mr. Dunahoo on having received the award. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkindt that they concur in the Mayor's congratulations and approve his attendance to the American Water Works Convention and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. I Change Order No. 1 - Bozeman Fire Station Change Order No. 1 on the construction of the New Fire Substation as prepared by C~orge Mattson, Bozeman, to become a part of the original contract was presented as follows: Description & Cost 1. Use grey block in lieu of colored block 2. Relocate electric panel A 3. Use Cyanamid skylight in lieu of Super Sky 4. Omit floor tile and base in Dormitory & Study 5. Use of Narrow1ine overhead doors in lieu of Heavy 6. Omit chain hoists on overhead doors Deduct $ " 275.00 " 480.00 " 50.00 " 120.00 Duty " 64.00 " 140.00 Total Deduct $1.129.00 The City Manager concurred with George Mattsont and recommended that Change Order No. 1 be accepted as presented. It was moved by Commissioner Lehrkind, seconded by Commiss-ioner Vollmer, that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Applicat~ons for Gambling Licenses: a) MSU - Spurs and Fangs - Raffle b) Breakfast Optomist - Raffle The City Manager presented an application from the Montana State University Spurs and Fangs I along with the required fee of $10.00 for a raffle to be held on 16 May 1975. Upon recommendation of the City Manager. it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that they approve the application for the raffle, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. The City Manager presented a similar request by the Optimist Breakfast club for a raffle to be held on 2 August 1975. and it was also approved by the same Aye and No vote. 28G Proclamation - Realtor Week, 20-26 April 1975 In accordance with a request from Bozeman Board of Realtors, Mayor Sedivy proclaimed the week of 20-26 April as "Board of Realtors" week in the City of Bozeman and recommended that all citizens observe this week with appropriate and significant programs. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Discussion of Budget Preparation Director of Finance Grant Murie appeared before the Commission to explain the preparation of the budget for 1975-1976. Report The City Manager commented on the report of the Director of Public Service and recommended approval thereof. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the report be approved and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Cormnissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
