Municipal Building. 9 April 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. City Manager Fryslie. Assistant I City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer, and the following proceedings were had: Minutes of the regular meeting held on Wednesday. 2 April 1975. were approved as read. Hearing - Commission Resolution No. 1728 - Intent to Create SID 547 - Storm Drain - South Side - Durston Road from North 11th to North 18th This was the time and place set in Commission Resolution No. 1728 to hear protests to the creation of Special Improvement District No. 547. Affidavit of publication of Notice and the Clerk's mailing certificate. stating all property owners had been notified as required by law. were presented. The City Manager presented protests filed with the Clerk of the Commission and signed by owners of property representing 1.1% of the proposed district as determined by the City Engineer. Several property owners were present to discuss the Special Improvement District. Mr. McClure showed slides of the hazards in that area. Following a discussion. the Mayor declared the hearing closed. and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that Commission Resolution No. 1729. entitled COMMISSION RESOLUTION NO. 1729 I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA. CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 547 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A TRUNK STORM DRAINAGE SYSTEM INCLUDING NECESSARY STORM DRAINAGE PIPE, MANHOLES, INLETS. DITCHES, AND OTHER NECESSARY APPURTENANCES TO STORM DRAINAGE, TOGETHER WITH GRAVEL FILL MATERIAL NECESSARY TO ESTABLISH REQUIRED GRADES ALONG THE SOUTH SIDE OF DURSTON ROAD FROM NORTH ELEVENTH AVENUE TO NORTH EIGHTEENTH AVENUE IN THE CITY OF BOZEMAN. MONTANA as prepared by the City Attorney be passed and adopted. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Proposal to Operate a Farmers' Market at Bogert Park The proposed Farmers' Market, having been continued for a period of one week for study. was again presented. Following an extensive discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that a license be granted to Farmers' Market, Inc., on a trial basis for a period of one year. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commississioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. I The Board of Directors of the Farmers' Market thanked the Commission for granting them the permission to open the Farmers' Market at Bogert Park. Change Order No. 1 - Bozeman City Shops - Net Addition - $472.00 Change Order No. 1 on the construction of the Bozeman City Shop as prepared by Berg-Grabow- Schofield. Bozeman. to become a part of the original contract was presented as follows: 280 Description and Cost: (1) Delete two (2) curb cuts on Tamarack Street (2) Delete exhaust fan at welding area (3) Add frame partition above concrete block wall along the south and west wall of the paint shop. also along the west wall of the meter room. Furnish and install hollow metal doors in opening to water lab and meter room (4) Add: Revise overhead doors in accordance with attachment $1.043.00 1,993.00 2,145.00 I 320.00 $ 472.00 total added The City Manager concurred with Berg-Grabow-Schofield and recommended that Change Order No. 1 be accepted and approved as presented. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, none. "Call for Bids" - SID No. 550 - Water Main. Figgins & Graf's Third Addition - $13.000.00 SID No. 551 - Sanitary Sewer. Second Phase, Graf's Third Addition - $28,000.00 SID No. 552 Water and Sewer. Cutting Street in Figgins Addition - $31,000.00 Plans and specifications covering the proposed improvement in Special Improvement District No. 550 for construction of water mains in Figgins and Graf's Third Addition; Special Improvement District No. 551 for construction of Sanitary Sewer, Second Phase. in Graf's Third Addition; and Special Improvement District No. 552 for construction of Water and Sewer on CUtting Street in Figgins Addition as prepared by Thomas. Dean & Hoskins. Inc., consulting engineers. was placed before the Commission. upon recommendation of the City Manager. it was moved by Commissioner Lehrkind, seconded by I Commissioner Vollmer. that the plans and specifications as presented be approved and that the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of Special Improvement District Nos. 550, 551. and 552 with an opening date of 30 April 1974 and to advertise for bids for the Sale of Bonds in the approximate amount of $13.000.00 for SID No. 550. $28.000.00 for SID No. 551 and $31.000.00 for SID No. 552 to be received on 7 May 1975 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Offer & Request to Place Senior Citizen Benches - Bozeman Board of Realtors A letter received from the Bozeman Board of Realtors requesting permission to place three benches in the downtown area for the retired persons riding the bus to and from Hillcrest Homes. was presented. The Commission concurred in the recommendation of the City Manager. and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they be granted permission to place the benches in the downtown area contingent upon the following: 1. That the Realtors obtain approval from the Street Superintendent in regard to permanently I attaching the benches. 2. That this project is not in conflict with the Chamber of Commerce plans for the beautification of Downtown Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those 281 voting No, none. Proclamations: (a) Library Week - 13-19 April 1975 (b) Poppy Days --- 30-31 May 1975 Mayor Sedivy proclaimed the week of 13-19 April as "National Library Week" in Bozeman and I recommended that all citizens participate in a special endeavor to broaden and increase the use of library services. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the proclamation as requested be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer, and Mayor Sedivy; those voting No. none. In accordance with a letter received from the America. Legion Auxiliary. Mayor Sedivy proclaimed 30-31 May 1975 as "Poppy Day" in the City of Bozeman and urged every citizen to give generous recognition to this program and obtain and wear a Memorial Red Poppy on these days. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Petition for Paving SID - Figgins Addition A petition received from residents and property owners of Figgins Addition petitioning the City of Bozeman to create a special improvement district for the purpose of paving and installing storm sewers in said subdivision was presented. I The Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that they instruct the City Attorney to draw up the resolution of intention to create the district for paving and storm sewer installation as soon as the City staff furnishes the necessary information. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Oommissioner Taylor and Mayor Sedivy; those voting No. none. Application for Gambling License - (a) (b) Bingo - Fowler Beef and Swine 4-H Raffle - Bozeman Barbershop Chorus The City Manager presented an application from the Fowler Beef and Swine 4-H along with the required fee of $10.00 for a Bingo License for the purpose of holding a Bingo C~me on April 12, 1975. It was moved by Commissioner Vollmer. seconded by Oommissioner Vandeventer. that they approve the application of the issuance of the Bingo License and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none. The City Manager presented an application from the Bozeman Barbershop Chorus along with the required fee of $10.00 for a raffle to be held on May 31, 1975. I upon recommendation of the City Manager. it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they approve the application for the raffle, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. Authority to Conduct March of Dimes Walkathon - 3 May (10 May Alternate) A letter from Mrs. Douglas Ferkin of the National Foundation March of Dimes requesting permission 282 to conduct a fund drive on Saturday. 3 or 10 May 1975 was presented. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that they grant permission to the National Foundation March of Dimes to conduct the fund drive and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Authority to Conduct Shrine Parade - 17 May 1975 A request from Bagdad Shrine Temple for permission to conduct a parade in conjunction with the ceremonial to be held on Saturday. 17 May 1975. was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they grant permission to the Bagdad Shrine Temple to conduct the parade and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No, none. Agreement for BOR Grant ~ $160,000.00 An agreement between the State Fish & Game Commission. the governmental agency of the State of Montana. involving Bureau of Outdoor Recreation Funds and the City of Bozeman for the proposed Park Improvement Program in the amount of $160.000.00 was presented. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the agreements be approved and the Mayor and Clerk of the Commission be authorized and directed to execute the agreements and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Report: Police Judge The City Manager commented on the report of the Police Judge and recommended approval thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor that the report be approved and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that the claims be approved as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. It was moved by Commissioner Vollmer, seconded by Commissioner V;ndeventer. that the request be approved and the Clerk of the Commission be authorized and directed to issue a "Call for Bids" to be opened 30 April and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Authority to Call for Bids -Garbage Packer Truck - Open 30 April 1975 The Sanitation Department has need for a 26.000 lb. Standard G.V.W. Rating Truck on which will be mounted a Rear-Loading Refuse Compaction Unit. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that the purchase be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase to be received and opened 30 April 1975, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. Discussion of Continuance of the World Family School Representatives of the World Family School were present to request an extension of their Conditional Use Permit. Following discussion. it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that they approve the request to extend the conditional use permit for a period of two years. After further discussion. it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that they amend the original motion to read five years in place of two years, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those voting No being Commissioner Taylor. The Commission then voted on Commissioner Taylor's amended motion and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Ordinance No. 953 - Flood Hazard Zoning Regulations Ordinance No. 953 repealing Ordinance No. 952, establishing a flood hazard district, defining its boundaries, etc. was presented as follows: I I I
