The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building. 2 April 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer,
Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. City Manager Frys1ie, Assistant
City Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held on Wednesday. 26 March 1975 were approved as read.
Acknowledgement - Bequest to Library from Estate of Marguerite B. Roecher. deceased..
A letter from Mr. J. H. Morrow. Attorney at Law. on behalf of the Estate of Marguerite B.
Roecher. deceased. was presented along with a check in the amount of $3.000.00-for the. benefit of -'the
Bozeman Public Library, to be used in the purchase of books at a rate of $500.00 per year for a period
of six years.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, 'that an expression
of gratitude be addressed to Mr. J. H. MOrrow. Attorney at Law on behalf of the Marguerite B.
Roecher Estate. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor
Sedivy; those voting No. none.
Consideration of Farmers' Market to he Established on City Property
A letter addressed to the City Commission by several board of directors of the Farmers' Market
proposing to establish a farmers' market to provide an attractive opportunity for the sale of
locally grown garden produce and crafts was presented. Bogert Grove appeared to be the most
suitable location for the proposed Farmers' Market.
Following a discussion. it was moved by Commissioner Vandeventer. seconded by Commissioner
Taylor. that consideration of the proposed Farmers' Market be continued for a period of one week to
be brought to the Commission for final action on Wednesday. 9 April 1975. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor.
Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Neighborhood Facility Committee Discussion
Several members of the Neighborhood Facility Planning Committee appeared before the Commission
to discuss the proposed Neighborhood Facility Planning and to present a preliminary type of proposal.
Following a discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer.
that an expression of gratitude be extended to the Committee for the presentation of the proposed
Neighborhood Facility. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and
Mayor Sedivy; those voting No. none.
Confirmation of Fire Fighters - Vern Backman & Dale Hanson. effective 1 April 1975
The Fire Chief reported that Fire Fighte~ Vern Backman and Dale Hanson had satisfactorily
completed the required one year probationary period and recommended that they be confirmed as
regular fire fighters. effective 1 April 1975. The City Manager concurred in the recommendation of
the Fire Chief and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that

the confirmation of Fire Fighters Vern Backman and Dale Hanson be approved effective 1 April 1975
and that they be congratulated on completing the one year probationary period. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner
Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none.

Application for Participation in the National Flood Insurance Program
Application No. OMB No. 63-R1404 for participation in the National Flood Insurance Program
along with Commission Resolution No. 1726 and Resolution No. 1727 authorizing submission of the
application to Federal Insurance Administration, Department of Housing and Urban Development.
Washington. D. C.. was presented.
The Commission concurred in the recommendation of the City Manager. and it was moved by
Commissioner Vandeventer. seconded by Commissioner Taylor. that they approve Application No. OMB
No. 63-R1404 for participation in the National Flood Insurance Program for an area of approximately
540 acres and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No, none.
COMMISSION RESOLUTION NO. 1726

COMMISSION RESOLUTION NO. 1727
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN.
MONTANA DECLARING THE INTENTION OF THE CITY COMMISSION TO
QUALIFY THE FLOOD HAZARD AREA WITHIN THE CITY FOR FLOOD
INSURANCE UNDER NATIONAL FLOOD INSURANCE ACT OF 1968
prepared by the City Attorney as directed by the City Commission was presented. It was moved by
Commissioner Lehrkind. seconded by Commissioner Vollmer. that Commission Resolution No. 1727 be
passed and adopted and become effective 2 May 1975. The motion was carried by the following Aye and

Request for Variance from Sign Code - Directional Signs at Montana National Bank
A letter received from Leonard R. Sundell. Architect. of Billings. requesting a variance in the
informational signing of the Montana National Bank Drive-Up to install a 6' x 1'9" entry sign and a

4'6" x 1'9" exit sign was presented. Both signs are fabricated of glu-1am beams 3" thick. and are
mounted on steel supports set in concrete up l' from the ground level.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that the request for
a variance to the Sign Code be approved. and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor,

Application for Gas Tax Funds - Black top Purchase - Approximately $57.000.00
An application for the purchase of 5,700 tons of ~ inch plant mix at an estimated cost of
$57.000.00 for the construction and reconstruction of streets and alleys to be paid for from gas tax
funds allocated to the City of Bozeman under provisions of House Bill No. 42-436-254 and complying
with rules and regulations promulgated by the MOntana State Department of Highways for administration
of the act was presented.
It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that the applications
for the project be executed by the members of the City Commission and submitted to the MOntana
Department of Highways as presented. and the motion was carried by the following Aye and No vote:

Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Annexation and Utility Agreement - Bozeman Industrial Park
An Annexation and Utility Connection Agreement by and between the City of Bozeman and the
Bozeman Industrial Park. for permission to connect a tract of land in Section Thirty-one (31),
Township 1 South. Range 6 East. M.P.M.. Gallatin County. Montana. at no cost to the City of Bozeman
was presented.
Upon recommendation of the City Manager. it was moved by Commissioner Taylor. seconded by
Commissioner Lehrkind. that the Annexation and Utility Connection Agreement, having been executed
by Bozeman Industrial Park. be approved and the Mayor and Clerk of the Commission be authorized and
directed to sign for the City of Bozeman. and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer.
Commissioner Vandeventer and Mayor Sedivy; those voting No. none.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Lehrkind, seconded by Commissioner Vollmer. that the reports be approved and ordered

Lehrkind, Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, and Mayor Sedivy;
those voting No. none.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Vollmer. seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
