The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building. 19 March 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Comm-
issioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. City Manager Fryslie. Assistant City
Manager Wolf. City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held on Wednesday. 12 March 1975. were approved as read.
Ordinance No. 951 - Fire Code for Adoption (1973)
Ordinance No. 951 adopting the "Uniform Fire Code. 1973 Edition" as copyrighted by the Internat-
ional Conference of Building Officials and the Western Fire Chiefs Association and repealing all
ordinances and parts of ordinances in conflict therewith was presented.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN ADOPTING
UNIFORM FIRE CODE.
Following a thorough discussion. it was moved by Commissioner Vollmer. seconded by Commissioner
Vandeventer. that Ordinance No. 951 adopting the Uniform Fire Code as presented be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Comm-
issioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none.
Appointment & Reappointments - Various Boards
Mayor Sedivy announced his appointments and reappointments to various City Boards as follows:
Band Board - Charles W. Lacy
- Rolfe Johnson
Cemetery Board - Scott W. Callin
Library Board - Edwin Howard. Jr.
Zoning Commission Board - John Braaksma
It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that they concur in
Mayor Sedivy's Appointments and Reappointments. and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind.
Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Proclamation - MSU Scholarship Week. 30 March to 5 April 1975
Mayor Sedivy proclaimed the week of 30 March 1975 to 5 April 1975. as'Montana State University
Scholarship Week" with full recognition that scholarships are a vital and important factor in the
continuing educational processes at Montana State University.
It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that they endorse the
Mayor's proclamation. and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer.
and Mayor Sedivy; those voting No. none.
Hearin~ - Rezone Parcel at Peach and Wallace - From R-5 to M-l, C. W. Sparks
This was the time and place set for a public hearing to consider the request for a zone change
from R-5 to M-1 on Tracts 1 and 2 in Block 6 of the Babcock and Davis Addition. said property belong-
ing to Mr. C. W. Sparks.
The Zoning Commission having reviewed the application voted to recommend approval of the zone
change request.
The Mayor declared the hearing opened. Mr. & Mrs. P. W. Peterson. 517 North Church Avenue were
present to oppose the zone change from R-5 to M-l based upon the excessive noise and increased traffic
flow on North Church Avenue.
Following a discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer.
that they continue the hearing for a period of one week to 26 March 1975. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vol1me~,
Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none.
Application for Gambling Licenses - Rosary School, MSU Skydivers, VFW Auxiliary. VFW Club
The City Manager presented an application from Rosary School along with the required fee of $10.00
for a Bingo License for the purpose of holding a Bingo Game on 5 April 1975. It was moved by Commiss-
ioner Vollmer. seconded by Commissioner Vandeventer. that they approve the application of the issuance
of the Bingo License. and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and
Mayor Sedivy; those voting No. none.

The City Manager presented an application from the MSU Skydivers along with the required fee of
$lO.OO for a raffle to be held 27 March 1975.
Upon recommendation of the City Manager. it was moved by Commissioner Vandeventer. seconded by
Commissioner Taylor. that they approve the application for the raffle. and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner
Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.
The City Manager presented an application from the VFW Auxiliary along with the required fee
of $10.00 for a raffle to be held 3 April 1975.
Upon recommendation of the City Manager. it was moved by Commissioner Taylor. seconded by Comm~
issioner Lehrkind, that they approve the application for the raffle to be held 3 April, and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commiss-
ioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none.
The City Manager presented an application from the VFW Club. along with the required fee of
$142.48 for a gambling license for the operation of two (2) card tables at the VFW Club, 240 East
Main Street. for a period ending 30 June 1975.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that they concur in the
recommendation of the City Manager and approve the application for the issuance of the Gambling License
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehr-
kind. Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those
voting No. none.
Reports
The City Manager commented on the report of the Director of Public Service and recommended app-
roval thereof. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the
report of the Director of Public Service be approved and ordered filed. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer.
Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA.
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A
SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS-
TRICT NO. 547 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A TRUNK
STORM DRAINAGE SYSTEM INCLUDING NECESSARY STORM DRAINAGE PIPE, MAN-
HOLES. INLETS. DITCHES. AND OTHER NECESSARY APPURTENANCES TO STORM
DRAINAGE, TOGETHER WITH GRAVEL FILL MATERIAL NECESSARY TO ESTABLISH
REQUIRED GRADES ALONG THE SOUTH SIDE OF DURSTON ROAD FROM NORTH
ELEVENTH AVENUE TO NORTH EIGHTEENTH AVENUE IN THE CITY OF BOZEMAN.

Upon concurrence of the City Manager. it was moved by Commissioner Vandeventer, seconded by
Commissioner Taylor. that Commission Resolution No. 1728 be passed and adopted. and that 9 April
1975 be the date set for public hearing. and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind.
Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Ordinance No. 952 - Establishing A Flood Hazard District
Ordinance No. 952 establishing a flood hazard district. defining its boundaries. providing for
the issuance of special permits. prohibiting specific uses. designating floodproofing requirements.
and providing for appeals and variances was presented as follows:

It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that Ordinance No. 952
establishing a Flood Hazard District be approved. and the motion was carried by the following Aye

Indoor Swimming Pool Project - Items not in Original Contract
The following items were recommended by the Architect and the Recreation Director as being
essential to the completion of the indoor~outdoor swimming pool.

Following a thorough discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner
Vollmer. that the items as listed with the exception of the Shallow Pool Insert be approved. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
Commissioner Lehrkind. Commissioner Vandeventer. and Mayor Sedivy; those voting No being Commiss-
ioner Taylor.
The Shallow Pool Insert is a top priority item. The size and cost to be researched by the
Architect and the information returned to the City Commission as soon as possible.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Vollmer. seconded by Commissioner Vandeventer. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
