Municipal Building, 12 March 1975. at 1:15 0.c1ock p.m. Present were Mayor Sedivy, Commissioner Vandeventer. Commissioner Lehrkind, City Manager Fryslie. Assistant City Manager Wolf. City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 5 March 1975. were approved as read. Absence of Commissioner Vollmer and Commissioner Taylor Upon recommendation of the City Manager. it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind. that the absence of Commissioner Vollmer and Commissioner Taylor be authorized in compliance with Section 11-3245. R.C.M.. 1947 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Consideration of Bids - Wheel-Loader-Backhoe for the Water Department The Commission was referred to the opening of bids for a new Wheel-Loader-Backhoe for the Water Department of the City of Bozeman on 5 March 1975. The bids having been studied in detail by the \~ater Superintendent. the City Manager concurred with the Water Superintendent. recommending that the purchase be awarded to Kamp Implement of Belgrade. Montana. on the basis of their bid in the amount of $9,257.50 with the trade-in. it being the lowest bid more than exceeding the specifications as contained in the "Call for Bids'.' The lowest bid in the amount of $8.175.00 was for a used machine and the Water Superintendent and the City Manager did not recommend the purchase of a used machine. The second lowest bid in the amount of $8.{~59.50 did not meet the specifications and the third lowest bid in the amount of $8,500.00 did not meet the specifications in a number of areas. Upon concurrence of the City Manager and the Water Superintendent. it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer. that the purchase of the new Hheel-Loader-Backhoe be awarded to Kamp Implement of Belgrade and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Hearing - Conditional Use Permit - Private Nursery School at 603 So. Ttvelfth Ave. - Marianne Murdock This was the time and place set for a public hearing to consider the Conditional Use Permit request of Mrs. Marianne Murdock to operate a private nursery school at their home at 603 South ~Jelfth Avenue. The property is zoned R-3 (Residential Medium Density). The Zoning Commission having reviewed the application voted to recommend approval contingent upon the following additions: 1. That a restraining fence be erected around the perimeter of the chi1dren.s play yard in agreement with the planning staff and the adjacent neighbors. 2. That neighbors in the vicinity be contacted and a report be made to the City Commission by Mrs. Murdock stating the neighborls reaction to the school. The hearing was opened by the Mayor. There being no one present to discuss the subject area, it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the hearing be closed and action be delayed until the recommendation from the Zoning Commission be complied \vith. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Van- deventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Application for Gambling Licenses: a) M.S.U. Physical Education Majors~- Raffle 11 April 1975 b) Camp Fire Girls - Bingo Game lli\pril ~975 The City Manager presented an application from the Physical Education Majors of the Montana State University along with the required fee of $17.50 for a raffle to be held 11 April 1975. Upon recomlnenclation of the City Manager. it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer. that they approve the application for the Raffle to be held 11 April 1975 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vandeventer, Mayor Sedivy; those voting No, none. The City Manager presented an application from the Campfire Girls. along with the required fee of $10.00 for a Bingo License for the purpose of holding a Bingo Game on Friday, 11 April 1975. The Commission concurred in the recommendation of the City Manager and it was moved by Commiss- ioner Vandeventer. seconded by Commissioner Lehrkind. that they approve the application of the issuance of the Bingo License for operating a Bingo Game on Friday, 11 April 1975 and the motion 270 was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Reports The following reports were presented: Police Court Police Chief Fire Chief (Annual) The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the reports be approved and or- dered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Request for a Sign Variance A letter received from the Billings Neon Manufacturing Co., requesting a variance to the Sign Code to install a 4' X 14' double face plexiglass "CONOCO" sign at the Conoco Station located at the corner of South Tenth Avenue and West College Street was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the request for a variance to the City of Bozeman Sign Code be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Claims Claim Number 20183 thru 20422 and 8960 thru 9131 inclusive were presented. It was ITloved by Commissioner Lehrkind. seconded by Commissioner Vandeventer. that the claims be approved as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vandeventer, nnd Mayor Sedivy; those voting No. none.
