Municipal Building. 12 February 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor. City Manager Frys1ie. Assistant City Manager Wolf. City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held on Wednesday. 5 February 1975 were approved as read. Absence of Commissioner Lehrkind upon recommendation of the City Manager. it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the absence of Commissioner Lehrkind be authorized in compliance with Section 11-3245. R.C.M.. 1947, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Hearing--COmmission Resolution No. l7lB, Intent to Create SID No. 550 - Water Main Graf's 3rd and Figgins Addition Commission Resolution No. 1722, Creating SID No. 550 This was the time and place set in Commission Resolution No. 1718 to hear the protests to the creation of Special Improvement District No. 550. Affidavit of publication of Notice and the Clerk's mailing certificate were presented. There were no written protests on file and no one appeared to protest verbally. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that Commission Resolution No. 1722 creating Special Improvement District No. 550 for the purpose of construction and installation of watermains and appurtenances thereto to serve portions of riggins Addition and Graf's Third Addition to the City of Bozeman. entitled: COMMISSION RESOLUTION NO. 1722 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 550 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF WATERMAINS AND NECESSARY APPURTENANCES TO SERVE PORTIONS OF THE FIGGINS ADDITION AND GRAF' S THIRD ADDITION TO THE CITY OF BOZEMAN, MORE SPECIFICALLY AS FOLLOWS: A TEN (10) INCH WATERMAIN ON PROPOSED EXTENSION OF LANGOHR AVENUE SOlITH OF ARNOLD STREET SOUTHERLY FROM THE EXISTING WATERMAIN; A TEN (10) INCH WATERMAIN EASTERLY THEREFROM TO SOUTH THIRD AVENUE; A TEN (10) INCH WATERMAIN SOUTHERLY THEREFROM ON THIRD AVENUE TO GRAF STREET; A TWENTY-FOUR (24) INCH WATERMAIN ON GRAF STREET FROM SOUTH THIRD AVENUE TO THE EAST LINE OF GRAF'S THIRD ADDITION; AND A SIX (6) INCH WATERMAIN ON COLTER AVENUE FROM GRAF STREET NORTHERLY TO THE EXISTING WATERMAIN. Affidavit of publication of Notice and the Clerk's mailing certificate was presented. There were no written protests on file and no one appeared to protest verbally. MONTANA. CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 552 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING LATERAL WATERMAINS AND SANITARY SEWER MAINS AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES. Hearing of Zoning Matters: a) b) Rezone Eastedge Meadows from AS to RS-1 Conditional Use - Warehouse at Griffin Drive Directly North of Conoco Bulk plant Conditional Use - Truck Repair Shop - North Rouse Avenue North of I-90 c) (8) Rezone Eastedge Meadows from AS to RSl This was the time and place set for a public hearing to consider the request of Howard L. Huffman and Paul K. Dudley. for a Zoning Change from Agriculture Suburban (AS) to Rural Suburban (RS-1) a 17.1754 acre tract of land in the S~. S~ of Section 8 and ~. NEt of Section 17 partially fronting along Haggerty Lane. The Zoning Commission. having briefly reviewed the request. voted unanimously to recommend approval of the Zoning Change from AS to RS-l. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that they concur in I I I I I I ') r: ~) #-oJ ~) l! the recommendation of the Zoning Commission and approve the request for a Zoning Change from "AS" to "RS-l". (b) Conditional Use Permit - Warehouse at Griffin Drive Directly North of Conoco Bulk Plant This was the time and place set for a public hearing to consider the request of Dale Thornton for a conditional use permit in the M-2-T #3 District. to build a 40' X 40' warehouse on Lot 24 in the Gordon Mandeville State School Section Subdivision. located directly north of the Conoco Bulk Plant on Griffin Drive and the location of Mr. Thornton's present salvage business. Following discussion. the Commission concurred in the recommendation of the Zoning Commission and it was moved by Commissioner Taylor. seconded by Commissioner Vollmer, that they delay action on the request until a recommendation has been received from the City of Bozeman Zoning Commission. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. (c) Conditional Use - Truck Repair Shop - North Rouse Avenue, North of 1-90 This was the time and place set for a public hearing to consider the request of Frank M. Kemmerer. pursuant to the requirements of the Bozeman Area Zoning Code. for a conditional use permit to build a 10~ X 100' truck repair and service structure on a 6.42 acre of land in the ~. NW~ of Section 6. Township 2 South. Range 6 East. M.P.M.. said tract of land lying just north of the interstate on North Rouse AVenue. The M-l-T District requires that particular attention be paid to: 1. Buffering where there are adjacent residential districts; 2. Signs as they affect passing interstate traffic; and. 3. The method and impact of sewage disposal. Having reviewed the staff report and listened to public testimony. the zoning commission voted unanimously to recommend approval of the petition without further conditions. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that they concur in the recommendation of the Zoning Commission and approve the conditional use permit to construct a truck repair and service shop in the M-I-T District No.4. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Authority to Call for Bids - Tractor-l.oader-Backhoe - Water Department - Open Bids 5 March 1975 The Water Department has need for a new Wheel Loader Backhoe and the City Manager requested for bids authority to callAfor the purchase of the Wheel Loader Backhoe with a 1971 Case MOdel 580CK Wheel Loader Backhoe trade in. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the purchase of the Wheel Loader Backhoe be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase to be received and opened 5 March 1975, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the claims be approved as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Letter to Legislators - Re: Protest Cut in State Funding of M. S. U. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that the City Commission go on record as protesting the proposed cut in State funding for MOntana State University and that the City Manager be directed to address a letter to the Legislators of this area expressing the concern of the Commission of the City of Bozeman of the adverse effect this would have on the City. as well as the State of MOntana. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
