Municipal Building, 5 February 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. City Manager Fryslie. Assistant City Manager Wolf. City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer. and the following proceedings were had: Minutes of the regular meeting held on Wednesday. 29 January 1975. were approved as read. Hearing - Zoning Code: a) Amendment to Allow Muffler Sa 1es and Services in B-3 b) Conditional Use Permit - Sign at North Rouse and Criffin Drive c) Conditional Use Permit - Medical Office - R-4 Zone; 1015 West Mendenhall a) This was the time and place set for a hearing to consider the request of Donald E. Cape and Maynard J. Hewitt to amend the Bozeman Area Zoning Code to include muffler sales and service shops as a permitted use in the "B-3" District. The Bozeman Zoning Commission having reviewed the application. voted unanimously to recommend denial of the above request. Several persons were present in regard to the area in question. Following a thorough discussion. the hearing was closed. and it was moved~by Commissioner ~ Vollmer. seconded by Commissioner Vandeventer, that the request to amend the Bozeman Area Zoning Code to include muffler sales and service shops as a permitted use in the "B-3" District be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. and Commissioner Lehrkind; those voting No being Mayor Sedivy. Commissioner Taylor abstained. b) This was the time and place set for public hearing to consider the request of Vernon Koelzer for a conditional use permit to erect a 8' X 10' wood sign on Tract 7. Township 2 South. R 6 East at the S.W. corner of the intersection of North Rouse and Griffin Drive. After reviewing the staff findings and consideration of public testimony. the Zoning Commission voted unanimously to recommend approval of the request. Following a thorough hearing. the Mayor declared the hearing closed and it was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that they approve the request of Vernon Koelzer of the Beaver Pond for a Conditional Use Permit to erect an 8' X 10' wood sign on Tract 7. Township 2 South. Range 6 East at the S.W. corner of the intersection of North Rouse Avenue and Griffin Drive in the M-l-T District No.4. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. c) This was the time and place set for a public hearing to consider the application of Ken Spain for a Conditional Use Permit in the R-4 Zoning District. to allow an orthodonist office in an existing structure located on Lots 13-18. Block 5, in the Springbrook Addition at 1015 West Mendenhall Street. The Zoning Staff having reviewed the application voted unanimously to recommend approval of the conditional use permit. Mr. Allan Green acting as agent for Mr. Spain was present for the public hearing and to answer any questions that might arise. 250 Following the discussion. the Mayor declared the hearing closed and it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that they concur in the recommendation of the Bozeman Zoning Commission and approve the application for a conditional use permit in the R-4 Zone to allow an orthodonist office in an existing structure located on Lots 13-18. Block 5. in the Springbrook Addition at 1015 west Mendenhall Street. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Consideration of Construction Bids: a) General Construction, Contract No. 1 (Bozeman pool) The Commission was referred to the opening of bids for the construction of the Bozeman Municipal Pool Building and the 50-$eter indoor swimming pool on 15 January 1975. Architect William E. Grabow of Grabow and Associates. and the City staff having completed their study of the bids submitted and having prepared a final tabulation recommended awarding the contracts to the following: Bid No. 1 - Edsall Construction Company. Bozeman (Construction of Bozeman Municipal Pool Building) Base bid Alt. #1 $354.333.00 26,950.00 $381.283.00 Bid No.2 - Bruce-Anderson Co.. Inc.. Bozeman (Construction of 50 Meter Municipal Pool) Base bid $111.908.00 The City Manager in concurrence with the recommendation of the Architect and the City staff recommended that the bid for the construction of the Bozeman Municipal Pool Building be awarded to Edsall Construction Company. Bozeman. on the basis of their low bid in the amount of $381.283.00. it meeting or exceeding the specifications in the "Call for Bids" and that the bid for the construction of the 50-meter Bozeman Municipal Pool be awarded to Bruce-Anderson Co.. Inc.. Bozeman. on the basis of their low bid in the amount of $111.908.00, it meeting or exceeding the specifications in every respect with the "Call for Bids" and that the bid bonds of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. The Commission concurred with the recommendation of the Architect. the members of the engineering staff and other staff members. also concurred in by the City Manager and it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that Edsall Construction Company be awarded the bid for the construction of the Bozeman Municipal Pool Building and that Bruce-Anderson be awarded the bid for the construction of the 50-meter Bozeman Municipal Pool. and that the bid bonds of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Rezoning - Parcel of Land 1 Mile South of 191 on Rae Road - Sabol & Kuntz Mr. Joseph W. Sabol and Mr. Ronald Kuntz appeared before the Commission to seek some sort of guidance in regard to rezoning a parcel of land located south of 191 on the Rae Road. Following a thorough discussion. the Commission referred the petitioners to the City Zoning Commission. suggesting that the Zoning Commission get together with the Planning Staff and specifically outline and itemize the information they want from the petitioners, namely Mr. Joseph W. Sabol and Mr. Ronald Kuntz. Once they have accomplished this. then the Zoning Commission can make their final recommendation to the City Commission. I I I I I I ')hl /-wi ~J. " Application for Wine License - Little Big Men Pizza The City Manager presented the application from the Little Big Men Pizza for a wine license. along with the appropriate fee. for the calendar year 1975. Upon recommendation of the City Manager. it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the Wine License be approved as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Application for Raffle License - Delta Sigma phi F!aternity The City Manager presented an application from the Delta Sigma phi Fraternity along with the required fee of $10.00 for a single raffle to be held on 13 March 1975. Upon recommendation of the City Manager. it was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that they approve the application for the raffle to be held on 13 March 1975 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Ommmissioner Vollmer and Mayor Sedivy; those voting No. none. Application for Kennel License - 717 North Church Avenue An application received from John Ott. 717 North Church Avenue, requesting a kennel license in accordance with Ordinance No.857. Section 5.16.040 of the Bozeman Municipal Code. together with the required fee was presented. The City Manager and the Chief of Police stated they were not aware of any reason to deny the above kennel license. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the above application be approved and the Director of Finance be instructed to issue a license to Mr. John Ott in accordance therewith. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Proclamations: a) b) Heart Month - February 1975 as 65th Anniversary of Boy Scouts of America In accordance with the Heart Association. Mayor Sedivy proclaimed the month of February as "American Heart Month" and 23 February to be "Heart Sunday". It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that they endorse the Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No, none. In accordance with the Boy Scouts of America. Mayor Sedivy proclaimed the year 1975 as the 65th Anniversary of the Boy Scouts of America. It was moved by Commissioner Vollmer. seconded by Oommis- sioner Vandeventer. that they concur in the Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Acceptance of Deeds - Portion of Babcock Street and South 23rd Avenue A warranty deed whereby Anton and Helen D. Lovfald and W. Bruce and Gladys M. Mecklenburg Southeast 1/4 granted unto the City of Bozeman a Right-of-Way located in the Southeast 1/4.ASection 11. Township 2 South, Range 5 East, M.P.M.. including a pertion of Block 4. Kirk Subdivision Number 4. City of Bozeman. Gallatin County. was presented. ')r:'J I-.J ~J {...,J Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that the Warranty Deed be accepted by the City of Bozeman and filed for record with the Gallatin County Clerk and Recorder and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none. Resolution No. l72l - Intent to Create SID No. 548 - First phase Paving Graf's Third Addition - Hearing. 26 February 1975 Commission Resolution No. 1721 set forth in full as prepared by the City Attorney as directed by the City Commission was presented. upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that Commission Resolution No. 1721 be passed and adopted and that 26 February be the date set for public hearing. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Reports The following reports were presented: Fire Chief Building Inspector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Adjournment There being no further business to come before the Commission at this time. it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer. that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
