The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 22 January 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Assistant
City Manager Wolf. City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday. 15 January 1973, were approved as read.
Proclamation - PI Week - 27 January - 1 February 1975
In accordance with the Montana State University Chapter of Pi Kappa Alpha Fraternity. Mayor
Sedivy proclaimed 27 January - 1 February. 1975 as "PI Week" in an attempt to fight birth defects
through research and rehabilitation and urged all citizens to take an active part in supporting this
worthy cause. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the
Mayor's proclamation be endorsed, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner
Lehrkind and Mayor Sedivy; those voting No. none.
Hearing - Proppsed Area Subdivision Regulations
This was the time and place set for a public hearing to be held jointly with the Board of County
Commissioners, Gallatin County, Montana. and the City Commission of the City of Bozeman, Montana in
the City Commission Room for the purpose of reviewing the proposed Bozeman Area Subdivision Regulations
which have been prepared pursuant to the Montana Subdivision and Platting Act (Section 11-3859 through
11-3876. R.C.M.. 1947).
The Planning Director stated that if adopted. the regulations would set forth uniform standards
for the division of land, survey monumentation. and the form and content of records of survey for all
lands within the established planning jurisdiction of the Bozeman City-County Planning Board.
Many interested persons were present to discuss the proposed area subdivision regulations and
ask the following questions:
Lonnie Beck - Was concerned about the cost of road paving to lots of one acre or greater in size
and pointed out that this would include all lots outside of the City becuase of the existing zoning
requirements.
Ken Nordvedt - Questioned whether a pavement requirement was a response to public demand. He
also questioned the planning staff's cost figures on road improvement. His experience in the develop-
ment of roads showed that a good gravel road could be built for $6.00 a running foot in comparison
with the $18.00 figure presented by the planning staff. Also, the cost to maintain gravel on a yearly
basis would be approximately a nickel per running foot. which would be cheaper than the interest cost
associated with pavement. He concluded by stating that it would be a waste of Commercial resources
as compared to an alternative and suggested an amendment to the regulations which would require all
lots of less than an acre to be paved and would require all lots of greater than an acre to be paved
unless a property owners' association were created. In this case. a gravel road meeting subdivision
standards would be allowed as maintained by the association.
Jim Paugh - Suggested that the property owners' association or some other instrument be created
where there are fences bordering a development in order that the fences would be maintained in accord-
ance with Montana custom.
Glen Bus - Questioned the requirement that prohibits the sale or offer to sell a property in a
subdivision until improvements have been taken care of. He suggested that the developer should be
permitted to start marketing lots prior to completion of the improvements. Another point brought
out by Mr. Bus was that, in his opinion. the regulations did not take into account individual septic
systems and asked that the environmental assessment include a provision explaining their potential use.
Roger Smith - Gave support to earlier comments regarding the high cost of improvements to sub-
division lots and particularly pointed out the high cost of lots of the five-acre and greater size.
Jack Greenway - Also presented testimony in opposition to a pavement requirement and objected
to the requirement which prohibited the offering for sale of lots where arrangements for the install-
ation of improvements had not been made.
Mike Sears - As a representative of local consumers was present and felt that if developers
were to install roads now, it would save unexpected and added costs to consumers at a later date.

During the discussion. the Planning Director explained each question raised.
Following the question and answer period, the hearing was closed. and the matter was tabled
for further study by the Commission and staff.
Application for Bingo License - Gallatin Valley Newcomers Club
The City Manager presented an application from the Gallatin Valley Newcomers Club, along with
the required fee for a Bingo License for the purpose of holding a Bingo Game on Saturday, 25 January
1975.
The Commission concurred in the recommendation of the City Manager and it was moved by Commiss-
ioner Vandeventer, seconded by Commissioner Taylor, that they approve the application for the issuance
of the Bingo License for operating a Bingo Game on Saturday. and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor,
Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none.

License Bonds - Marks Electric - $5.000.00
P & R Electric - $5.000.00
In compliance with Chapter 15 of the Bozeman Municipal Code. the Electrical Bond of Marks
Electric in the amount of $5.000.00 and the Electrical Bond of P & R Electric in the amount of
$5,000.00 were presented. The City Manager stated that the Building Inspector had recon~ended
approval of the Bond, and the City Attorney approved the bond as to form. It was moved by Comm-
issioner Taylor. seconded by Commissioner Lehrkind, that the above license bonds be approved, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor
Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting
No, none
Reappointment - Allan Green - Community Recreation Board - 3 Year Term
Mayor Sedivy announced his reappointment of Allan Green to the City of Bozeman Community Re-
creation Board for a period ending 31 December 1977. The Commission concurred in the Mayor's re-
appointment of Allan Green, and it was moved by Commissioner Lehrkind. seconded by Commissioner
Vollmer. that Allan Green be appointed to the Community Recreation Board for a period of three years
ending 31 December 1977. and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, Commissioner Tay-
lor and Mayor Sedivy; those voting No, none.

ioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy;

Request from Parking Commission - SID for $5,000.000.00 Off Street Parking Downtown Bozeman
A letter received from Rod Marshall. Chairman, Bozeman Parking Commission petitioning the City
of Bozeman to establish a Special Improvement District for the purpose of Off Street Parking in the
Downtown area (B-3 District) at an estimated cost not to exceed $5.000.000.00 was presented.
Following discussion. the Commission concurred with the recommendation of the City Manager, and
it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that they acknowledge
receipt of the petition. and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind
and Mayor Sedivy; those voting No. none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer. seconded by Commissioner Taylor. that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
