HomeMy WebLinkAbout1975-01-15 I I I 241 Bozeman, Montana 15 January 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 15 January 1975. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Lehrkind. City Manager Fryslie, Assistant City Hanager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 8 January 1975. were approved as read. Authorize Absence of Commissioner Taylor Upon recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Comm- issioner Vandeventer, that the absence of Commissioner Taylor be authorized in compliance with Section 11-3245. R.C.M.. 1947, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Request for SIn - Water Line in Cutting Street (Graf) A letter received from Eugene Graf, Jr., petitioning the City of Bozeman to create a special improvement district for the installation of water and sewer lines on Cutting Street in Figgins Addition was presented. The Commission concurred with the recommendation of the City Manager. and it was moved by Comm- issioner Vandeventer. seconded by Commissioner Lehrkind. that they instruct the City Attorney to draw up the resolution of intention to create the special improvement district for the water and sewer lines on Cutting Street as soon as the City staff furnishes the necessary information. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Lehrkind. Commissioner Vollmer, and Mayor Sedivy; those voting No. none. Applications for Gambling Licenses: (a) Thomas A. Bates - Montana Gold Dust (b) Ralpy A. Shaffer - Zebra Lounge The City Manager presented an application from Thomas A. Bates of the Montana Gold Dust, 6 North Willson Avenue. along with the required fee of $256.16 for a gambling license for the purpose of operating two (2) card tables at the Montana Gold Dust for the period ending 30 June 1975. It was moved by Commissioner Lehrkind, seconded by Commissioner vollmer, that they concur in the recommendation of the City Manager and approve the application for the issuance of the Gambling License. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. The City Manager presented an application from Ralph A. Shaffer of the Zebra Lounge. 321 East Main Street. along with the required fee of $383.55 for a gambling license for the purpose of operating two (2) card tables at the Zebra Lounge for the period ending 30 June 1975. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that they concur in the recommendation of the City Manager and approve the application for the issuance of the Gambling License. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Progress Payment - City Shop Building (Martel Construction) The City Manager gave a progress report on the construction of the City Shop Building and recomm- ended that the claim of Martel Construction in the amount of $100.998.4l and the claim of the Depart- ment of Revenue in the amount of $1,020.19 be approved and the Director of Finance be directed to issue a warrant in payment thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the two claims be approved as presented. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Application for Retail Wine License - Haufbrau The City Manager presented an application and the appropriate fee for a Wine License for the Haufbrau. located at 22 South Eighth Avenue, and recommended approval thereof. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the wine lic- ense in the amount of $100.00 be approved. and the Director of Finance be instructed to issue the Retail Wine License. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Lehrkind and Mayor Sedivy; those voting No. none. 242 Reports The City Manager commented on the report of the Police Judge and recommended approval thereof. It was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the report of the Police Judge be approved. and ordered filed. The motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none Application - Off Premises Beer License. Town Pump An application for an off-premises beer license along with the appropriate fee from the Town Pump was presented. The City Manager stated he had no reason to deny the application and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that the application be approved and the Director of Finance be instructed to issue a license and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Bond and Oath of Office - Grant Murie It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that Grant Murie be authorized to sign City of Bozeman checks as Director of Finance of the City of Bozeman and that the official Surety Bond and Oath of Office in the amount of $60.000.00 written by Western Surety Company. as required by Ordinance No. 524, Chapter 2.08.320 of the Bozeman Municipal Code, for Grant Murie for a period of one year from 7 January 1975, and approved by the City Attorney as presented, be accepted. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind. and Mayor Sedivy; those voting No. none. Renewal of Contract for Consulting Engineering Services It was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the Renewal Contract for the Consulting Engineering Services. Sanitary Sewer. Water, and Storm Drainage Improve- ments by and between the City of Bozeman and Thomas, Dean & Hoskins, Inc.. Engineers of Great Falls, Montana. be delayed until 29 January 1975. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Open Bids - Indoor Swimming Pool This was the time and place set for opening bids for the construction of the 50-meter indoor swimming pool as prepared by William Grabow of Berg. Grabow and Associates. Architect. Affidavit of publication of "Notice to Bidders" was presented. and it was moved by Commissioner Lehrkind, se- conded by Commissioner Vollmer. that the bids be opened and read. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, BID No.1 (General Construction) Bruce-Anderson Company. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer.
