Bozeman, Montana 18 December 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building. 18 December 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Frys1ie. Assist- ant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 11 December 1971f, were approved as read. I Hearing - Rezoning AS to RS-5, W 1/2, Sec. 21, T2S, RSE - 320 acres 1 Mile South of 191 on Rae Road This was the time and place set for a public hearing to consider the request of Donald Kuntz, to change from "AS" to "RS-511 a parcel of land located on the West 1/2 of Section21, Township 2 South, Range 5 East, being one mile south of the King Arthur Mobile Home Park on the Rae Road. Many interested persons were present to discuss the area and to oppose the zoning change from liAS" to IIRS-5". Mr. Donald Kuntz and Mr. Joseph W. Sabol, Attorney for Mr. Kuntz, were present to comment on the request for a Zone Change from "AS" to IIRS-5". The Zoning Commission, having reviewed the application, voted to deny the request. Following a lengthy discussion, the hearing was closed, and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the request for a Zone Change from "ASII to IIRS-5", the W 1/2 of Section 2l, Township 2 South, Range 5 East. being approximately one mile south of the King Arthur Mobile Home Park on the Rae Road be denied. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Sedivy; those voting No, being Commissioner Vollmer. Pre~entation and Cons~deration - Facilities plan - Bozeman Sewage System - Thomas, Dean & Hoskins, inc. Mr. T. H. Thomas and Mr. Wayne Dean of Thomas, Dean & Hoskins, Inc., appeared before the Commiss- ion to present the final proposed engineering report of the facilities plans for the Sanitary Sewer System for the City of Bozeman. Following presentation of the report and upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the report be approved and the same I be submitted to the U. S. Environmental Protection Agency and the Montana Department of Health and Environmental Sciences, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Gambling License - Saint George and the Dragon The City Manager presented an application from Phillip C. Frey of the Saint George and the Dragon, 104 West Main Street, along with the required fee of $323.95 for a gambling license for the purpose of operating two (2) card tables at the Saint George and the Dragon, 104 West Main Street, for a period ending 30 June 1975. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they concur in the recommendation of the City Manager and approve the application for the issuance of the Gambling License. The motion was carried by the following Aye and No vote: those voting Aye being Commission- er Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Appointm~nt of Special Police Officers - Montana State University A letter received from Donald J. Skerritt, Chief of the University Police, of the Montana State University, requesting that the following members of the University Police be appointed Special Police Officers of the City of Bozeman for one year from 1 May 1975 to 30 April 1976 without cost to the City of Bozeman, was presented: Donald J. Skerritt Donald G. Wortman Loren G. Winks Robert L. Decker Harold W. pettys Frank W. Lessley I Everett E. Edsall Mervin G. Gunderson It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that they concur with the recommendation of the City Manager and approve the above appointments. and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commiss- i.oner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. 23!3 Reports: The City Manager commented on the report of the Cashier and recommended approval thereof. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that the report of the Cashier I be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind, CommissionerVollmer. Commissioner Van- deventer and Mayor Sedivy; those voting No, none. Adjournment There being no further business to come before the Commissioner at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. ~ ") / ."
