The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 4 December 1974, at 1:15 o'clock p.m. Present were Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Assistant City Manager
Wolf, City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer, and the following proceedings were had.
I Minutes of the regular meeting held on Wednesday, 27 November 1974. were approved as read.
Authorize Absence of Mayor Sedivy
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Taylor, that the absence of Mayor Sedivy be authorized in compliance with Section 11-3245,
R.C.M. , 1947, and that Commissioner Vollmer be designated President Pro-Tempore, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss-
ioner Taylor, Commissioner Lehrkind and Commissioner Vollmer; those voting No, none.
Salvation Army - Christmas and Winter Relief Drive - 4 December to 24 December 1974
A letter received from the Salvation Army requesting permission to conduct a Christmas Relief
Drive on various corners in the business area from 4 to 24 December 1974 was presented.
It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that the Salvation Army
be granted permission to conduct the Christmas Relief Drive, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind,
Commissioner Vandeventer and Commissioner Vollmer; those voting No, none.
Commission Resolution No. 1717 - Certification of Delinquent City Special Assessments - $120,169.18
Commission Resolution No. 1717 certifying delinquent taxes in the amount of $120,169.18 to the
Gallatin County Treasurer was presented:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING
CERTAIN SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESS-
MENTS. DUE AND PAYABLE 30 NOVEMBER 1974, AND UNPAID AS OF THAT
DATE. AND CERTAIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF
I SPECIAL ASSESSMENTS, DUE AND PAYABLE 30 NOVEMBER 1974, AND UNPAID,
DELINQUENT, AS PROVIDED BY CHAPTER 2.32 OF THE BOZEMAN MUNICIPAL
CODE AND SECTION 11-2233, POLITICAL CODE, R.C .M., 1947.
Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by
Commissioner Vandeventer, that the Resolution be passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer.
Commissioner Taylor and Commissioner Vollmer; those voting No, none.
Contract Documents - Valley View Country Club Sewer
The Contract Documents for the construction of the Valley View Country club sewer extension was
presented. The City Manager recommended that the contracts for the construction of 600 feet of sewer
extension be approved as presented. It was moved by Commissioner Vandeventer, seconded by Commiss-
ioner Taylor, that the Contract Documents be approved and that the Mayor and Clerk of the Commission
be authorized and directed to sign the contracts for the City of Bozeman and that White-McNeil
Construction, Bozeman, be authorized and directed to proceed with the construction of the Valley
View Country Club sanitary sewer construction. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind
and Commissioner Vollmer; those voting No, none.
Reports
The following reports were presented:
Fire Chief Building Inspector
The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Taylor, seconded by Commissioner Lehrkind, that the reports be approved and ordered
I filed, and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer and Commissioner Vollmer; those
voting No, none.
Request for a Variance - 424 East Main Street - Donald E. Cape and Maynard L. Hewitt
A letter received from Donald E. Cape and Maynard L. Hewitt requesting an interpretation or
a variance on the land and building located at 424 East Main Street was presented.
Following a discussion, it was moved by Commissioner Lehrkind. seconded by Commissioner Vande-
venter, that they acknowledge receipt of the letter and table the request for a period of one week
for further study. The motion was carried by the following Aye and No vote: those Voting Aye being

Commissioner Lehrkind. Commissioner Vandeventer and Commissioner Vollmer; Commissioner Taylor
abstained.
Parking at Fixit Shop
Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Van-
deventer, that the request from the Professional Business Forms Service, Inc., and the Fixit Shop
of 317 and 319 East Mendenhall Street. remain on the table until a firm recommendation has been
received from the staff. The motion was carried by the following Aye and No vote: those voting I
Aye being Commissioner Lehrkind. Commissioner Vandeventer, Commissioner Taylor and Commissioner
Vollmer; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner Taylor. Commissioner Lehrkind and Commissioner Vollmer; those voting No. none.
