The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 13 November 1974, at 1:15 o'clock p. m. Present were Mayor Sedivy, Commissioner Vollmer.
Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, City Manager Frys1ie, Ass't.
City Manager Wolf and the Clerk.
I Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday. 6 November 1974. were approved as read.
Parking Restrictions in Street Cleaning Districts.
Having reviewed the parking restri~tions placed within the Street Cleaning Districts 6, 7, 8
and 9 and having consulted with the appropriate staff for a period of two weeks, the City Manager
presented two alternatives:
l. To retain all-night parking as is on Main Street and North Seventh Ave.
and to alternate dates in the remaining areas of the districts.
2. To retain seven-day-a-week parking restrictions within all of District
5 and 6 and, in addition, the restrictions will prevail along Babcock
Street and Mendenhall Street and all cross streets between Mendenhall
and Babcock Streets from Rouse Avenue to Third Avenue. Within all
other areas included in the Sprinkling Districts all-night parking
restrictions will be imposed only on Tuesdays and Thursdays.
Many interested residents and property owners within the Street Cleaning Districts 6. 7, 8
and 9 were present and unanimously protested complete banning of overnight parking in the above
districts, with many objections to any parking restrictions.
Following a lengthy discussion and in concurrence with the recommendation of the City Manager.
it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that they accept Alternative
No.2 along with improved maintenance of the alleys. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Taylor. Commissioner Vollmer,
Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Hearing - Planned Unit Development Application - John French, 15th Avenue and Babcock Street.
I This was the time and place set for a public hearing to consider the request of John S. French,
Jr. . to build a Planned Unit Development on a 5.5-acre tract of land in the N l/2 of Section 12,
T2S, R5E, M.P.M., Gallatin County, Montana, said property being located east of and adjacent to
South 15th Avenue extended and approximately 150 feet south of West Babcock Street in the City of
Bozeman.
The City of Bozeman Zoning Commission. having held a public hearing and having reviewed the
application of John S. French. Jr.. recommended the approval of the Planned Unit Development of
56 Multi-family units and one single family dwelling, along with a playground area, a recreation
building, a tennis court, private driveways, and buffer screening subject to the following condi-
tions:
l. Development shall proceed in accordance with the general layout and
elevation plans (structure height being approximately 21 ft.) submitted
by the developer.
2. A forty foot right-of-way extending from the southwest corner of the
development to the centerline of West Babcock Street shall be dedicated
and improved in accordance with City specifications. The private drive
and parking stalls shall have a paved surface. Signs or other devices
shall be used to restrict parking from the private drive.
3. A five foot decorative fence which meets design standards submitted by
the developer (i.e. rough, sawn board and earth tone stain) shall be
constructed along the west and south property lines. Fence is not re-
quired around the yards of the single family residence. A minimum ten
foo t. latticed. chainlink fence shall be constructed along the north
and east sides of the tennis court.
4. All setback areas and buffer strips. except where other improvements
I are permitted, shall be landscaped. A hedge shall be planted along
the north boundary line.
5. Playground areas shall be improved with landscaping and conventional
playground equipment.
6. Improvements shall be completed in accordance with the following sch-
edule before building permits may be issued.
a. South 15th - Arrangements for the construction of the roadway
shall be made. with the approval of the City Manager's office,
before any building permits are issued.
b. parking stalls, private drive. no-parking signs. fence, play-
grounds, and buffer landscaping - May be completed in phases.

phase must be submitted for approval to the Building Offi-
cial before building permits may be issued for each phase.
6. Recreation building and tennis courts - No requirements.
The City Manager concurred with the recommendation of the Bozeman Zoning Commission and
recommended approval of the Planned Unit Development with the above conditions. It was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer. that they approve the request to build
a Planned Unit Development with the conditions set forth by the Bozeman Zoning Commission and the I
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting
No, none.
Council on Aging - $400.00 Funding (Exchange).
A letter received from Oliver Dahl, Chairman of the Council on Aging, requesting that $400.00
be given in exchange for $400.00 Tax Money in order that the Area IV Council on Aging Services to
Older Americans will receive Federal funds from the Montana Aging Services, was presented.
Following a discussion and upon recommendation of the City Manager. it was moved by Commissioner
Vandeventer, seconded by Commissioner Taylor, that they approve the request of the Council on Aging
and morally endorse their program. The motion was carried by the Following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, Commissioner
Vollmer and Mayor Sedivy; those voting No, none.
Applications for Gambling Licenses:
a) MSU Army ROTC - RHffle - 9 December 1974
The City Manager presented an application from Montana State University Army ROTC. along with
the required fee, for a single raffle to be held 9 December 1974.
Upon recommendation of the City Manager, it was moved by Commissioner Taylor. seconded by Comm-
issioner Lehrkind. that they approve the application for the Raffle to be held 9 December 1974, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor.
Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting
No, none. I
El Rocking R Bar - Card Table - 30 June 1975
The City Manager presented an application from Carl R. Lindgren of the Rocking R. Bar, 211 East
Main Street, along with the required fee of $360.00 for a gambling license for the purpose of oper-
ating one (1) card table at the Rocking R. Bar, 211 East Main Street. for a period ending 30 June 1975.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that they concur with
the recommendation of the City Manager and approve the application for the issuance of the Gambling
License, and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy;
those voting No, none.
Request for Variance to Building Code - Red Barn.
A letter received from the Red Barn requesting a variance to the City Building Code to obtain
a building permit to enable them to construct a restaurant in the Red Barn was presented.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the request
for a variance to the Building Code be approved. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor,
Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
Montana Fire Chiefs Association Convention, 20-23 November, Kalispel1. Hoey and Simpson.
The Montana Fire Chiefs Association Convention is scheduled to be held in Kalispell 20-23 Nov-
ember, and Fire Chief Hoey requested that he and Assistant Fire Chief Simpson be authorized to attend
the convention.
Upon recommendation of the City Manager. it was moved by Commissioner Vandeventer. seconded by I
Commissioner Taylor. that Fire Chief Hoey and Ass't. Fire Chief Simpson be authorized to attend the
convention and, it being in the public interest, their expenses be paid from the General Fund" and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No being Commiss-
ioner Taylor.
Application for Retail Wine License -- Texaco Freeway Inn.
The City Manager presented an application and the appropriate fee for a six-month Wine License
for the Texaco Freeway Inn. located at 1211 East Main Street, and recommended approval thereof.

It was moved by Commissioner Taylor, seconded by Commissioner Vollmer. that the application for
the Wine License in the amount of $50.00 for the Texaco Freeway Inn be approved and the Director of
Finance be instructed to issue the Retail Wine License, and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Vollmer, Commissioner
Lehrkind. Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
I Amend Sign Code on Wooden Signs.
It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that the Building
Inspector be instructed to write an amendment to the Sign Code on Wooden Signs. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner
Lehrkind, Commissioner Vollmer, aQd Mayor Sedivy; those voting No, being Commissioner Vandeventer.
Reports.
The City Manager commented on the reports of the Police Judge and the Police Chief and re-
commeded approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer,
that the reports be approved and ordered filed and the motion was carried . . . .
Adjournment.
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting
No. none.
