Montana 6 November 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Bui 1d ing, 6 November 1974, at l:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind, City Manager Frys1ie, Ass't. City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. I Minutes of the regular meeting held on Wednesday, 30 October 1974, were approved as read. Hearing, Request for Rezoning Lands South of Babcock Street, 19th Ave. East from R-3 to B-2. Edward J. Harrington. This was the time and place set for a public hearing to consider the request of Edward J. Harrin- gton, to change from "R-3 to "B-2" a tract of land 22' X 600' in the Nl/2, NWl/$, SWl/4, Section 12. T2S. R5E, M.P.M., Gallatin County, Montana, said property being located at the intersection of 19th Avenue and Babcock Street extending a distance of 690' along Babcock Street. Following a discussion, and upon recommendation of the City Manager, it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that they continue the hearing until they have received a recommendation from the Bozeman Zoning Commission. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Commissioner Vollmer. Commissioner Vandeventer. Comm- issioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No. none. Change Order No. 1 - Bogert Pool Bathhouse - $768.30 Change Order No. 1 on the construction of the Bogert Pool Bathhouse as prepared by City Engineer, Arthur Van'tHul. to become a part of the orignal contract was presented as follows: Description - A. Installation of a stack extension and raincap to the boiler stack. B. Install two screen walls to replace the steel lockers as originally designed to break line of site into dressing rooms. C. Install window between chlorine room and equipment room to allow operator view access of equipment. D. Add four rows of shale block in each dressing room to improve entry to front and back. I Change Order Cost Total Additions $768.30 The City Manager concurred with the engineers and recommended that Change Order No. 1 be accepted and approved as presented. It was moved by Commissioner Vandeventer. seconded by Commissioner Taylor, that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none. Request for Variance to Sign Code - Mike Gentile, 115 North Grand Avenue The request from Mike Gentile for permission to place a wooden sign at 115 North Grand Avenue was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was ~oved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the request for a 4' X 6' wooden sign code variance be denied since it is a combustible sign. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, none. License Bond: Gallery Signs - $2,000.00 In compliance with Chapter 14 of the Bozeman Municipal Code, the certificate of Gallery Signs in the amount of $2,000.00 was presented. The Building Inspector had recommended the sign bond and the City Attorney approved the bond as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vande- I venter, Commissioner Taylor and Mayor Sedivy; those voting No, none. Reports The following reports were presented: Librarian Building Inspector Cemetery Fire Chief Water Collector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the reports be approved and ordered fi led and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. ')'19 ,...,,{.;I...J Claims Claim No's. 19258 thru 19483 and 08308 thru 08476 inclusive were presented. Care 50.00 $161,228.94 The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue warrants in payment. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that the claims be approved as presented following the signature of the City Manager. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss- ioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
