Municipal Building. 16 October 1974 at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie. Acting City Attorney Andriolo and the Clerk. I Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 9 October were approved as read. Hearing. Proposed Zoning Amendment - Former Gallatin Veterinary Clinic (Buronepe Co) from AS to B-2 This was the time and place set for a public hearing to consider the request of the Buronepe Co. , formerly known as the Gallatin Valley Veterinary Clinic. to change the Zone classification from AS to B-2 on a 150' X 300' tract of land in the SE 1/4. SW 1/4. Section 11. T2S, R5E, M.P.M. The Bozeman Zoning Commission having held a public hearing were of the concensus that to rezone this small parcel of land would be spot zoning and recommended that they continue the hearing for a period of one month to allow the adjoining property owners an opportunity to make application for a zoning change. The Commission concurred with the recommendation of the Bozeman Zoning Commission. also concurred in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they continue the hearing on the request for a period of one month for a recommendation from the Bozeman Zoning Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Hearing, Proposed Zoning Amendment - 14 Acres Adjacent to 19th & W. College from R-4-T to R-O. Farm Bureau. This was the time and place set for a public hearing to consider the application of Rick Mayfield for a zoning change from R-4-T to R-O on an L shaped piece of property fronting on South Nineteenth Avenue and West College Street, said property being approximately 14 acres in size. I The Bozeman Zoning Commission having reviewed all testimony and reports, recommended that the petition be granted with the additional requirement, that this be designated Transitional District No. 7. The conditions which would have to be met before any use could be approved for the district to be set forth in full as recommended by the Zoning Commission. A number of interested persons and property owners were present to discuss the Zone change as presented by Rick Mayfield on behalf of the Gallatin Farm Bureau. Also present to speak on behalf of the appeal were officials of the Montana Farm Bureau Federation and the Gallatin Farm Bureau. A petition signed by a number of interested persons all of whom are property owners and residents of the area surrounding the land proposed for rezoning. requesting that the Commission reject the recommendation of the City Zoning Commission to change the Zoning from R-4-T to R-O in the above area was also presented. Following an extensive discussion. it was moved by Commissioner Vandeventer, seconded by Comm- issioner Taylor. that they declare the hearing closed and concur in the recommendation of the City Manager, that they not adopt the recommendation of the City of Bozeman ZoningCommission to change the zoning from R-4-T to R-O and that the zoning code be reviewed to determine if a procedure to accomodate the specific desires of the Farm Bureau, can or should be adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Review of Lease to Gallatin Post No. 14. American Legion - Block 38. Imes Addition, Legion Housing The lease for the American Legion Housing located in Block 38, Imes Addition to the City of Bozeman was presented for review. The City Manager stated the original lease between Gallatin Post No. 14, American Legion and the City of Bozeman was entered into on the 14th day of June 1946. I Many interested persons were present to discuss the area in question, and to urge the Commission to not phase out the Legion Housing at this time. Following a thorough discussion and question and answer period. the Commission concluded that the lease termination question needs further study. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that they table the proposal to phase out the Legion Housing to give them an opportunity to review the lease and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Van- ; deventer and Mayor Sedivy; those voting No, none. 212 Authorization to Attend National Lea~ue of Cities Conference. Houston. Texas. 1-5 December, ~ayor Edmund P. Sedivy The Fifty-First Annual Conference of the National League of Cities is scheduled to be held in Houston Texas, 1-5 December 1974 and the City Manager recommended that Mayor Sedivy be authorized to attend the conference. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Mayor Sedivy be authorized to attend the conference and. it being in the public interest his expenses be paid out I of the appropriate fund and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkinq Commissioner Vollmer. Commissioner Taylor and Commissioner Vande~ venter; those voting No. none. Announcement of Appointment - Assistant City Manager Joseph G. Wolf. City Manager Fryslie stated he had thoroughly reviewed the applications of persons applying for the position of Assistant City Manager and was pleased to announce his appointment of Joseph G. Wolf as Assistant City Manager effective 4 November 1974. The Commission concurred in the City Managers appointment and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the appointment of Joseph G. Wolfe as Assistant City Manager be approved effective 4 November 1974 and he be congratulated on accepting the position. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. \ Proclamation - "United Nations Day" 24 October 1974 In accordance with the Governor of Montana, Mayor Sedivy proclaimed Thursday, 24 October 1974 as "United Nations Day" in the City of Bozeman and urged all citizens of Bozeman to observe United Nations Day and seek to promote understanding and support for the United Nations and it affiliated agencies. I t was moved by Commiss ioner Vandeven ter. seconded by Commissioner Taylor, that they endorse the mayors proclamation and the motion was carried by the following Aye and No vote: those vo ting Aye being Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Commissioner I Vollmer; those voting No. none. Application - Retail Beer and Wine License for one-half Year - Ramada Inn The City Manager presented the application and the appropriate fee for a six month beer and wine license for the Ramada Inn located at 1325 North Seventh Avenue and recommended approval thereof. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the application for the beer and wine license be approved and the Director of Finance be instructed to issue the license and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No. none. Report - Director of Finance The City Manager commented on the report of the Director of Finance and recommended approval the reo f . It was moved by Commissioner Lehrkind seconded by Commissioner Vollmer. that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, Commission- er Taylor and Mayor Sedivy; those voting No. none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that the meeting be adjourned and the moti.on was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
