Mont. 2 October 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building. 2 October 1974 at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Comm~ issioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 25 September 1974 were approved as read. I Hearing. Comm. Res. No. 1711 - Assessing Final Assessment. SID No. 534. Watermain Constr. Oak St. This was the time and place set for public hearing on levying final assessment for Wa~~~m~t~s24 Construction on Oak Street. Hemlock Street and North Fifth Avenue (K-Mart Site), SID No. 534 in the final amount of $41,925.24. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no protests on file, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1711 provisionally passed and adopted on 25 September 1974 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No. none. Hearing, Comm. Res. No. 1712 - Assessing Estimated Assessment, SID No. 542 - W. Olive. between So. Tenth & Eleventh Ave. - $13.000.00 This was the time and place set for public hearing on levying estimated assessment for the construction of paving and storm drain. SID No. 542 in the estimated amount of $13,000.00. No one appeared to protest verbally and there being no protests on file. it was moved by Commissioner Van- deventer. seconded by Commissioner Taylor. that Commission Resolution No. 1712 provisionally passed and adopted on 25 September 1974 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vol1uler. Commissioner Vandeventer. Commissioner Lehrkind. Commissioner Taylor and Mayor Sedivy; those voting No. none. Hearing! Comm. Res. No. 1713 - Assessing Estimated Assessment, SID No. 543 - Villard Street between No. Tracy and No. Willson - $23.000.00 This was the time and place set for public hearing on levying esti.mated AsseSSment for pavement I and storm drain construction on W. Villard Street between North Tracy and North Willson Avenue, SID No. 543 in the amoung of $23,000.00. No one appea~ed to protest verbally and there being no protests on file, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that Commission Resolution No. 1712 provisionally passed and adopted on 25 September 1974 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Hearing. Comm. Res. No. 1714 - Assessing 1974 Walks & Curbs, $37.856.44. This was the time and place set for public hearing on levying final assessment for the constru- ction and replacement of sidewalks and curbs for the year 1974 in the amount of $37.856.44. Affidavit of publication of Notice was presented. There being no one present to protest and no protests having been filed it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that Commission Resolution No. 1714 provisionally passed and adopted on 25 September 1974 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Hearing. Comm. Res. No. 1715 - Assessing Solid Waste Collection & Disposal - $142.538.98+ This was the time and place set for public hearing on levying the solid waste collection and disposal assessment in the amount of $142.538.98. Affidavit of publication of Notice was presented. No one appeared to protest verbally and no protests having been filed, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that Commission Resolution No. 1714 provisionally I passed and adopted at the regular session held on 2S'1September 1974 be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. ..Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Sale of Bonds: SID No. 545, Sanitary Sewer. Porti.on of Bozeman Creek Annexation -"Ice Pond Road" $13.000.00 The City Manager stated that according to the affidavit of publication this was the time and place set for the bond sale of Special Improvement District No. 545 for the purpose of constructing a sanitary sewer on a portion of Bozeman Creek Annexation known as "Ice Pond Road." 207 The Mayor and the City Manager outlined the procedure for conducting this bond sale and stated that the amount of bonds to be sold was the same as the advertised amount and announced that the City was ready to conduct the bidding on the bonds of SID No. 545 in the amount of $13,000.00 A sealed bid submitted by First National Bank of Bozeman in the amount of 6.85% was opened and read. It was then announced that oral bids for the purchase of the bonds in accordance with the Notice I of Sale would be received. Jack Brant, having presented his good faith check in the amount of $650.00 as prescribed by the Notice of Sale and being the only oral bidder. bid 6.8% as the lowest effective interest rate accruing to the City of Bozeman. The City Manager stated the bid of 6.8% by Jack Brant of Bozeman was accept- able and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the sale of t~e bonds for Special Improvement District No. 545 be awarded to Jack Brant at 6.&% and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Comm- issioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No. none. Consideration of Construction Buds - SID No. 545 The engineers representing consultants Thomas. Dean & Hoskins, Inc.. having completed their Study of the bids submitted for the construction of a sanitary sewer on a portion of Bozeman Creek Annexation SID No. 545 and having prepared a final tabulation of the bids recommended that the bid be awarded to Mike Boylan Construction, Bozeman, on the basis of their low bid in the amount of $7,830.00. The Commission concurred with the recommendation of the engineers, also concurred in by the City Manager and it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that Mike Boylan Construction be awarded the bid on the basis of their low bid in the amount of $7,830.00 and that the bid security of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Contract Documents for Execution - "Bozeman City Shops" The performance bond and the contract documents Qf Martel Construction. Inc.. Bozeman, for the I construction of the City Shop Building in the amount of $373,481.00 was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the contract be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman and that Martel Construction be instructed to proceed with the construction of the "Bozeman City Shops" and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehtkind, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No, none. Application for Gambling Licenses: a) Thomas A. Bates - Card Tables b) Gallatin County Democratic Central Committee - Raffle The City Manager presented an application from Thomas A. Bates along with the required fee for a gambling license for operating card tables at the Arcade. 6 North Willson and the Zebra. 321 East Main Street. for a period ending 30 June 1975. The Chief of Police having investigated the application of the applicant recommended that the license not be issued. The City Manager concurred in the recommendation of the Chief of Police and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they not issue a Gambling License to Mr. Thomas A. Bates for operating card tables at the Arcade, 6 North Willson and the Zebra, 321 East Main Street. The motion was carried by the following Aye and No vote: those Voting Aye, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, None, Commissioner Vandeventer abstained. The City Manager presented an application from the Gallatin County Democratic Central Committee along with the $10.00 fee for a single raffle license. Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by I Commissioner Vollmer. that they approve the application and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Application for Variance to Sign Code: Home Federal Savings & Loan Assoc. Grand Avenue Christian Church. A letter received from Paul A. Schofield requesting a variance to COQstruct a sign at the New Home Federal Savings & Loan to be constructed on the corner of West Main Street and 21st Avenuw was presented. The sign would be approximately 6'1" X 5'10" in size and would be approximately 8'7" from the ground to the top of the sign and would be made of combustible material. 208 It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the request for a variance to the Sign Code be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Volluler, Commissioner Vandeventer. Commissioner Lehr- kind and Mayor Sedivy; those voting No, none, Commissioner Taylor abstained. A letter received from Rainbow Signs requesting a height variance on a 6' X 12' S/F Electric Sign for the Christian Church at 110 South Grand Avenue was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the request for the variance to the Sign Code be approved and the motion was carried by the following Aye and I No vote: those voting Aye beingCommissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No, none. Authority to Conduct Light Bulb Sale - Lions Club, 2 October 1974 A request from the Bozeman Lions Club for the permission to hold their annual light bulb sale on the 2nd day of October 1974 was presented. It was moved by Commissioner Taylor, seconded by Comm issioner Lehrkind, that permission to hold their annual Light Bulb Sale be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Proclamation - Fire Prevention Week - 6-12 October 1974 Mayor Sedivy announced his proclamation designating the week of 6-12 October as "Fire Prevention Week" and called upon all departments and agencies of the City Government to participate actively in a campaign for improved fire safety. It was moved by Commissioner Lehrkind, seconded by Commiss~ ioner Vollmer. that they concur in the Mayor's proclamation and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Corrmissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those voting No. none. Reports The following reports were presented: Fire Chief Building Inspector The City Manager commented on the above reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that the reports be approved and the I motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Remove Parking on North Wallace from East Lamme to East Tamarack Street A discussion was held on the removal of parking on the west side of North Wallace Avenue from East Lamme Street to East Tamarack Street. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that they delay action on the removal of the parking for a period of one week in order to view the site in question. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy; those voting No being Commissioner Vollmer.
