Municipal Building, 25 September 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer. Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Acting City Attorney Andriolo and the Clerk. . I Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 18 September 1974 were approved as read. Hearing. Comm. Res. No. 1703 - Final Assessment SID No. 512. Paving & Storm Drain - Thompson's #4. & University Subv. #2 - $497.245.80 This was the time and place set for public hearing on levying final assessment for paving and storm drain, Thompson's No.4 and University Subdivision No.2, SID No. 512 in the amount of $497.245.80. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no protests filed, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that Commission Resolution No. 1703 provisionally passed and adopted on 18 September be finally passed. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no pro- tests on file, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind~ that Commiss- ion Resolution No. 1709 provisionally passed and adopted on 18 September 1974 be finally passed. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no protests on file, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Commission Resolution No. 1710 provisionally passed and adopted on 18 September 1974 be finally passed. Open Bids - Construction of SID No. 545, Sanitary Sewer - Ice Pond Road, $13,000.00 This was the time and place set for opening bids for the construction of Sanitary Sewer. SID No. 545, Ice Pond Road. Affidavit of publication of "Notice to Bidders" was presented. It was moved I by Commissioner Vandeventer. seconded by Commissioner Taylor, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande- venter, Commissioner Taylor. Bozeman 9,818.00 White-McNeil Construction, Bozeman 1.949.00 The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Taylor, seconded by Commissioner Lehrkind, that the bids be referred to the engineers repre- senting Thomas, Dean & Hoskins and the City engineering staff for final tabulation, consideration and recommendation 2 October 1974 and that the Security check of the two top bidders be returned and t~ motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Comm- issioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer and Ma7~r Sedivy; those voting No. none. Confirmation of Police Officer Donald Weikart effective 15 September 19 The police Ch~et reported that Pol~ce Otticer Donald Weikart had satisfactorily completed the required one-year probationaty period and recommended that Police Officer Donald Weikart be confirmed as a regular officer of the police department effective 15 September 1974. The City Manager concurred in the recommendation of the Police Chief and it was moved by Commissioner Lehrkind. seconded by Comm- issioner Vollmer, that the confirmation of Police Officer Weikart be approved and he be congratulated upon completing the one-year probationary period. The motion was carried by the following Aye and No I vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Authority to Attend WPCF Meeting, Denver, 7-10 October - A. W. Van't Hul, City Engineer The Water Pollution Control Federation Meeting is scheduled to be held in Denver, Colorado, 7-l0 October and in concurrence with the recommendation of the City Manager, it was moved by Commiss- ioner Vollmer, seconded by Commissioner Vandeventer, that City Engineer Van't Hul be authorized to attend the meeting and, it being in the public interest his expenses be paid out of the appropriate fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollnler, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting, No, none. 90'1 Io..J l' J Request to Conduct Homecoming Parade, 4 October 1974 - Bozeman Senio High School A letter received from the Bozeman Seni~High School requesting permission to conduct their Homecoming Parade on Friday, 4 October 1974 at 1:00 o'clock p.m. was presented. The parade is to begin at the High School parking lot and proceed up Eleventh Avenue to the Montana State University Football Stadium where it will disband. It was moved by Commissioner Vandeventer, seconded by Comm- issioner Taylor, that permission to conduct the Homecoming Parade on Friday, 4 October 1974 be granted I and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. Authority to Purchase Fire Vehicle - $2,646.18 The fire Department has need for a fire vehicle and the City Manager requested authorization to purchase a 1974 Plymouth Valiant four door sedan in the amount of $2,646.18 with a trade of a 1967 Ford Ranchero as quoted by Rolfe & Woode. Inc.. it being the lowest and best bid submitted. Reports The following reports were presented: Librarian Director of Public Service Cemetery Water Collector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Lehrkind. seconded by Commission Vollmer, that the reports be app- roved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Gambling License - a) Gallatin County 4-H Foundation, $10.00 b) Veterans of Foreign Wars. $10.00. The City Manager presented an application from the Gallatin County 4-H Foundation a1~ng with the $10.00 fee and an application from the Veterans of Foreign Wars along with the $10.00 fee for a gam- bling license for operating a bingo game for one day. Upon recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Comm- issioner Vandeventer, that they approve the application for the Gallatin County 4-H Foundation and the Veterans of Foreign Wars and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, I and Mayor Sedivy; those voting No, none. Proclamation - "Punt. Pass and Kick" Day. Saturday, 5 October 1974 Mayor Sedivy announced his proclamation of 5 October 1974 as "Punt, Pass and Kick" day in the City of Bozeman and called upon all citizens of Bozeman to observe the day with the traditional Amer- ican spirit of competition Bnd good sportsmanship. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the proclamation as ~equested by KBMN and Bozeman Ford be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Comm- issioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No. none. 20f) Consideration of Construction Bids - City Shop. Martel Construction - $375.000.00 The Commission was referred to the opening of bids for the construction of the City Shop Build- ing on 11 September 1974. Architect William E. Grabow of Grabow and Associates, and the City Staff having completed their study of the bids submitted and having prepared a final tabulation of the bids, the City Manager in concurrence with the recommendation of the Architect recoolmended that the bid be awarded to Martel Construction at a cost not to exceed $375.000.00 which will be itemized in I the contract with Change-orders attached thereto. Following a discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the bid be awarded to Martel Construction of Bozeman at a cost not to exceed $375.000.00 as set forth in full in the contract and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
