Municipal Building, 4 September 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind. I City Manager Frys1ie, Acting City Attorney Andrio1o. and the Acting Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 28 August 1974, were approved as read. Bid Opening: Convert a 2% Ton (6 x 6) Army Truck to a Fire Truck This was the time and place set for opening bids for the conversion of a 2% ton (6 x 6) Army Truck to a Fire Truck. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. The following bids were then opened and read: M & W Repair Bozeman, MT $11.655.27 Superior Fire Apparatus Helena, MT $ 9,488.00 The bids were referred to the Fire Chief for review of specifications with recommenda- I tion to be returned next week. Hearing - Conditional Use Permit. Eldridge Mobile Home Court This was the time and place set for a public hearing to consider an application from Mauri ce L. Eldridge, 1304 West Babcock, to expand a mobile home court, presently covering two acres with ten mobile home lots, to contain one more acre l.;rith six mobile home lots. The Zoning Commission, having reviewed the application. voted to refer it to the Board of Adjustment and to continue consideration of this application at their next meeting, if a variance was awarded. Mr. Eldridge was present to speak on behalf of the proposal. Mr. Van Schmidt, 221 South 13th, presented a petition of protest which contained 81 signatures. Mr. Oscar Thomas, 315 South 14th. was also present to voice his protest of approval of the application. Mr. BDb Yaw. 415 South 12th, stated that he felt there was a better use for this land. Followi,ng an extensive discussion, City Manager Frys1ie recommended that the C'mnmission l.;rait for advisement from the Zoning C'nmmission after they hear from the Board of Adjustment. Hearing - Connit-ional JIse Permif-. Mobile Home in AS nistri~t This was the time and place set for a public hearing to consider an application from the Montana C'~nference of Seventh-Day Adventists to place a mobile home on an AS District east of Bozeman. ..---- ....-.... 188 The Zoning Commission. having reviewed the application, voted to recommend d~nial of the application. They then instructed the Planning Staff to study the use of the mobile home and suggested that the use of this mobile home be continued until this matter was brought before the City Commission. Stan Steadman was present to clarify the content of his letter that was sent to the City Manager. Art Van't Hull, City Engineer, was also present to answer questions I that might arise. Following an extensive discussion, City Manager FrysHe recommended that the Commission concur in the recommendation made by the Zoning C'.ommission. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they table the matter until hearing the report from the Planning Staff. The motion did not carry by the following Aye and No vote: those vot ing Aye being Commissioner Taylor and Mayor Sedivy; those voting No being Commissioner Lehrkind, Commissioner Vollmer, and Commissioner Vandeventer. It was then moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they deny the application ann the motion was carried by the following Aye and No vote: those voting Aye being Commis~ioner Lehrkind, Commissioner Vollmer, and Cotmnissioner Vandeventer; those voting No being Commissioner Taylor and Mayor Sedivy. Presentation - Pedestrian Safety Award - Montana Automobile Association. Mrs. James c. (RAaLrice1_Tay10r Mrs. James C. Taylor presented a plaqlle to the City Commis~ion from the Montana Automohile Association for completing two years without a pedestrian fatality within the City of Bozeman. Five of these Pedestrian Safety Awards have been awarded throughout I the state of Mont;ma by the Montana Automobile Association. Mayor Sedivy expressed his appreciation upor. receiving the plaque and stated that it was his wish to improve on the record. Curb Opening - Montana National Bank City Manager Fryslie read a letter from Bruce Ellis) Vice President of the Montana National Bank, requesting a variance to permit a curb cut 61 feet 4 inches in length to he used for an exit from the bank property onto North Third Avenue. The City Manager stated that curb cuts of this length are usually refused, due to the traffic hazard they create. However. the City Manager recommended approval of this curb cut, due to the fact that drive-in banking is a unique vehicular movement and that there should be no more than two vehicles leaving the property at anyone time. Commissioner Vandeventer suggested that a "Right Turn Only" sign he placed at this exit to avoid accidents. Police Chief Johnson stated that a City Ordinance must be I written in order to enforce a "Right Turn Only" sign at this point on private property. It was moved by Commissioner Vollmer, seconded hy Commissioner Vandeventer, to approve the 61 foot 4 inch curb cut at the Montana National Bank and the motion was carried by the following Aye and No vote: those voting Aye being C'~mmissioner Vollmer. C',ammissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. ~- ~ 189 Reports The following reports were presented: Building Inspector Fire Chief The City Manager commented on the reports and recommended approval thereof. It I was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, r~mmissioner Taylor, and Mayor Sedivy; those voting NO, none. Request for Kennel License - Stan and Diane Tibbitts. 811 South Grand An application received from Stan and Diane Tibbitts, 811 South Grand, requesting a kennel license in accordance with Ordinance No. 856. Section 5.16.040 of the Bozeman Municipal Code, together with the required fee was presented. The Tibbitts' were present to answer any questions that might arise. There were some reservations among their neighbors, but not a sufficient number of protests to recommend denial of this application. The City Manager and the Police Chief stated that they were not aware of any reason to deny the above kennel license and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the above application he approved and the Director of Finance he instructed to issue a license to Stan and Diane Tibbitts in accordance therewith. The motion was carried by the following Aye and No vote: those voting Aye being Cornmissioner I Vandeventer, Commissioner Taylor, Cornmissioner Lehrkind, Commissioner Vollmer. and Mayor Sedivy; those voting No, none. Authority to r~ll for Bids - SID No. 545. Sanitary Sewer to Serve a Portion of Bozeman Creek Annexation. Open 25 September 1974 Plans and specifications covering the proposed improvement in Special Improvement District No. 545 for the construction and installation of a sanitary sewer line to serve a portion of the Bozeman Creek Annexation was placed before the Cornmission. The City Manager recommended that the plans and specifications be approved and that a "Call for Bids" and sale of the Bonds for SID No. 545 in the amount of $13,000 be authorized. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the plans and specifications be approved and the Clerk of the City Commission be authorized and directed to publish a "Call for Bids" for the construction of Special Improvement District No. 545 with an opening date of 25 September 1974, and to advertise for the sale of the Bonds in the amount of $13.000 to be received 2 October 1974. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. and Mayor Sedivy; those voting No. none. I Annual Convention of Montana League of Cities and Towns - 12 . 13. and 14 September City Manager Fryslie reminded the Commission of the upcoming annual convention of the Montana League of Ci.ties and Towns to be held on the 12, 13. and 14 of September in Billings, Montana. The City Manager recommended that the City Commission, the City Manager, the Recreation Director, the Clerk of the City Commission, and the City Attorney be authorized to attend this convention. 190 It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that they concur in the City Manager's recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, COmmissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Adjournment I There being no further business to be brought before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Taylor. that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiasioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those voting No. none.
