The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, 28 August 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. Acting City
I Manager Keyes, Acting City Attorney Andriolo, and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings
were had.
Minutes of the regular meeting held on Wednesday, 21 August 1974, were approved as read.
Hearing - Commission Resolution No. l691-Intent to Annex "Valley View Annexation No. 1"
During the regular session of the City Commission, held on the 31st day of July 1974,
the Commission regularly passed and adopted Commission Resolution No. 1691 declaring its
intention to extend the boundaries of the City of Bozeman so as to include 18.044 acres, more
or less, to be known and designated as the "Valley View Annexation No. I" to the City of
Bozeman.
This being the date set for public hearing as set forth in said Commission Resolution
No. l691, affidavit of publication of Notice and the Clerk's mailing certificate, stating
that all property owners had been notified, was presented. There were no written protests
filed and no one appeared to protest verbally.
The Commission concurred in the recommendation of the Acting City Manager and it was moved
I by Commissioner Vollmer, seconded by Commissioner Vandevente~ that Commission Resolution No.
1702, to accomplish the extension of the City Limits, entitled:

Commission Resolution No. 1696 - Assessing Final Assessment SID No. 525, Trunk Sewer Line.
Figgins' & Graf's Third Addition- $42.087.40
This was the time and place set for public hearing on levying final assessment for trunk
sewer line, Figgins' and Graf's Third Addition. SIn No. 525 in the amount of $42,087.40.
Affidavit of pubHca.tion of Notice was presented. No one appeared to protest verba 11y and
there being no protests on file, it was moved by Commissioner Vandeventer. seconded by Commissioner
Taylor. that Commission Resolution No. 1696 provisionally passed and adopted on 21 August
1974, be finally passed. The motion was carried by the following Aye and No vote: those

This was the time and place set for public hearing on levying final assessment for trunk
watermain, Figgins' and Graf's Third Addition. SIn No. 526 in the amount of $76,814.22.
Affidavit of publication of Notice was presented. No one appeared to protest verbally and there
being no protests on file, it was moved by Commissioner Taylor, seconded by Commissioner

Lehrkind, that Commission Resolution No. 1697 provisionally passed and adopted on 21 August
1974, be finally passed. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer. Commissioner
Vandeventer, and Mayor Sedivy; those voting No, none.
Commission Resolution No. 1698 - Assessing Final Assessment, SIn No. 527 , Sewer Laterals.

This was the time and place set for public hearing on levying final assessment for sewer
laterals, Figgins' and Graf's Third Addition, SIn No. 527 in the amount of $69.257.69. Affidavit
of publication of Notice was presented. No one appeared to protest verbally and there being
no protests on file. it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer,
that Commission Resolution No. 1698 provisionally passed and adopted on 21 August 1974, be
finally passed. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind. Commissioner Vollmer. Commissioner Vandeventer, Commissioner
Taylor, and Mayor Sedivy; those voting No. none.

This was the time and place set for public hearing on levying final assessment for water
laterals. Figgins' and Graf's Third Addition, SIn No. 528 in the amount of $58,365.60. Affidavit
of publication of Notice was presented. No one appeared to protest verbally and there being
no protests on file, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer,
that Commission Resolution No. 1699 provisionally passed and adopted on 21 August 1974, be
finally passed. The motion was carried bv the following Aye and No vote: those voting Aye I

This was the time and place set for public hearing on levying final assessment for water
and sanitary sewer, North 21st to Durston, SIn No. 529 in the amount of $49,762.34. Affidavit
of publication of Notice was presented. No one appeared to protest verbally and there being
no protests on file, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor,
that Commission Resolution No. 1700 provisionally passed and adopted on 21 August 1974. be
finally passed. The motion was carried by the following Aye and No vote: those voting Aye

This was the time and place set for public hearing on levying final assessment for watermain
lateral, Remington Addition, SIn No. 533 i.n the amount of $19,230.35. Affidavit of publication
of Notice was presented. No one appeared to protest verbally and there being no protests on I
file, it was moved by Commissioner Taylor. seconded by Commissioner tehrkind, that Commission
Resolution No. 1701 provisionally passed and adopted on 21 August 1974, be finally passed.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Lehrkind, Commis s ioner Vo llmer, r~mmissioner Vandeventer, and Mayor
Sedivy; those voting No, none.
Consideration of Chlorine Bids
The City Staff, having checked the bid on the purchase of 90,000 pounds of Liquid Chlorine

for the Water Department and the Waste Water Treatment Plant recommended that tney accept
the bid of SEC Corporation, Billings. it being the only bid RubmHted. The City Commission
concurred with the recommendation of the Acting City Manager and it was moved by Commissioner
Lehrkind, seconded by Commissioner Taylor, that the bid of SEC Corporation, Billings, be
accepted, it being the only bid submitted and meeting all sped fications of the "r,all for Bids".

0Qnfirmation of Fire Fighter - Allen Scholes. 1 September 1974
The Fire Chief reported that Fire Fighter, Allen Scholes. had satisfactorily completed
the required one year probationary period and recomrnend~d that Fire Fighter Scholes be confirmed
as a regular fire fighter, effective 1 September 1974. The Acting City Manager concurred in
the recommendation of the Fire Chief and it was moved by Commissioner Taylor, seconded by
Commissioner Lehrkind, that the confirmation of Fire Fighter Scholes be approved and he be
congratulated on completing the one year probationary period. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind,
Commissioner Vollmer, Commissioner Vandeventer. and Mayor Sedivy; those voting No, none.
Confirmation of Police Officer - Robert Furu, 1 August 1974
The Police Chief reported that Police Officer, Robert Furu, had satisfactorily completed
the required one year probationary period and recommended that Police Officer. Robert Furu,
be confirmed as a regular officer of the Police Department, effective 1 August 1974. The

Acting City Manager concurred in the recommendation of the Police Chief and it was moved by
r~mmissioner Lehrkind, seconded by Commissioner Vollmer, that the confirmation of Police
Officer Furu be approved and he be congratulated on completing the one year probationary period.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, and Mayor
Sedivy; those voting No. none.
Request for Vacation - Clerk of the Commission. 30 August to 8 September
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the
Clerk of the Commission, Erna V. Harding, be granted leave of absence from 30 August to 8 September
and that Assistant City Manager, Robert F. Keyes, be designated Acting Clerk of the r~mmission
during this period and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner
Lehrkind. and Mayor Sedivy; those voting No, none.

The Acting City Manager commented on the reports and recommended approval thereof. It
was moved by Commissioner Vandeventer, seconded by Commissioner Taylor that the reports be
approved and ordered filed and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, Commissioner
Vollmer, and Mayor Sedivy; those voting No, none.
Resignation of Glen Harrington. Board of Adjustment. Effective 1 September 1974
A letter received from Glen Harrington, whereby he tendered his resignation as a member

of the Board of Adjustment to be effective 1 September 1974. was presented. The Mayor, on
behalf of the Commission, stated that it was with regret that they accept Mr. Harrington's
resignation and expressed their appreciation and commendation for his long years of outstanding
service to the City.
Appointment of Keith Swanson to Board of Adjustment
Mayor Sedivy announced his appointment of Keith Swanson to the Board of Adjustment to I
replace Glen Harrington, to be effective 1 September 1974.
Adjournment
There being no further business to be brought before the Commission at this time. it
was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the meeting be
adjourned. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer,
and Mayor Sedivy; those voting No, none.
