Municipal Building, 7 August 1974. at 1:15 o'clock p.m. Present were Mayor Sedivy, Couunissioner Vollmer, Commissioner Vandeventer. Commissioner Lehrkind. City Manager Fryslie, Assistant City Manager Keyes, City Attorney Berg, and the Clerk. I Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 31 July 1974. were approved as read. Open Bids: Playground - Tennis Court Surfacing This was the time and place set for opening bids for the supplying of playground pave~ ment sealer and tennis court resurfacing and color coating materials for the City of Bozeman. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. The following bids were then opened and read: Chevron Asphalt Company Tucson, AZ $5.601.10 Malott & Peterson-Grundy San Francisco, CA $4.998.00 The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the bids be referred to the engineering staff for tabulation, consideration and recommendation. The motion was carried I by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. COmmissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No. none. Public Hearing - Ordinance No. 949. Appropriation Fiscal Year 1974-1975 This was the time and place set for public hearing on the appropriation Ordinance No. 949 for the fiscal year ending 30 June 1975. Affidavit of Publication of Notice of hearing was presented. Attorney Douglas Dasinger appeared before the Commission on behalf of the Bozeman Police Protection Association to ask the Commission to again consider the plea of the Police Association for more than a 7%% pay increase. The Clerk of the Commission stated that no formal protests had been filed in opposition to the adoption and passage of the proposed ord,inance,, and accompanying annual appropriation budget. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that no protests. other than Police Pay Scale, having been received the Clerk of the Commission be authorized and directed to publish the ordinance as required by law. Section 11~33l9. R.C.M., 1947, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, COmmissioner Vollmer. Commissioner Vandeventer, and Mayor Sedivy; those voting No. none. I Alcoholic Rehabilitation Association - Solicit ~unds Lee Eblen, of Bozeman, and Ward Hamlin, of Helena, appeared before the Commission to explain the program of the Southwestern Montana Alcoholic Rehabilitation Association and to solicit financial aid. The Commission thanked Mr. Eblen and Mr. Hamlin for their presentation and stated that they would take the request of the Alcoholic Rehabilitation Association for financial aid under advisement. 169 Gamblin~ Regulations It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer. that the draft of the proposed gambing regulations for the City of Bozeman be tabled for an additional week for further study and investigation. and until the five members of the Commission are present. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner I Lehrkind. Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No. none. r~nsideration of Rids - PlaY2round and Tennis Court Su~facing The Engineering Staff. having completed tabulation of the bids for the supplying of the playground pavement sealer and tennis court resurfacing and color coating materials, recommended that Malott & Peterson-Grundy, San Francisco, California, be awarded the bid on the basis of their low bid in the amount of $4,998.00. The Commission concurred in the recommendation of the Engineering Staff. also concurred in by the City Manager and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that Malott & Peterson-Grundy. San Francisco. California, he awarded the bid on the basis of their low bid in the amount of $4.998.00, it meeting or exceeding the call for bids as advertised and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Lehrkind. and Mayor Sedivy; those voting No. none. Front Steps and Ramp - Bogert Swimming Pool>> $3.288.67 A contract whereby Larry Binder will construct the ramp and two sets of stairs along with I a six foot deck on the front of the Bogert Grove Swimming Pool Bathhouse at an estimated cost of $2,100.00 in accordance with the plans prepared by the City Engineer was presented. Following a discussion and in concurrence with the recommendation of the City Manager it was moved by Commissioner Vandeventer, seconded by COmmissioner Lehrkind that the City enter into an agreement with Larry Binder to construct the ramp and two sets of stairs along with a six foot deck on the front of the Bogert Grove Swimming Pool Bathhouse and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind. Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Authority to Call for Bids - 90.000 Pounds Chlorine, Open 21 August 1974 The Water Department and the Waste Water Treatment Plant has need for approximately 90.000 pounds of liquid chlorine and the City Manager requested that the purchase be authorized. It was moved by COmmissioner Lehrkind, seconded by Commissioner Vollmer. that the purchase, as requested, be authorized and the Clerk of the Commission be directed to issue a "call for Bids" for the purchase of 90,000 pounds of liquid chlorine to be opened 21 August 1974. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. and Mayor Sedivy; those voting No. none. I License Bonds: Montana Power Company - Gas Fitter $2 >>000 Everett Egbert - Plumber $5 .000 In compliance with Chapter 16 of the Bozeman Municipal Code. the Gas Fitter Bond of Montana Power COmpany and the Plumbers Bond of Everett Egbert were presented. The City Manager stated the Building Inspector had recommended approval of the above mentioned bonds and the City Attorney approved the bonds as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the above mentioned bonds be approved ahd the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. COmmissioner Vandeventer. Commissioner Lehrkind. and Mayor Sedivy; those voting No. none. 170 COmmission Resolution No. 1692 - Assessing Street Lighting - $20.829.38 Commission Resolution No. 1692. levying assessment in the total amount of $20,829.38 for the various lighting districts for the year 1974, was presented. LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COST I FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTION 11-2252, R.C.M., 1947. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the resolution be provisionally passed and adopted and Wednesday, 14 August 1974, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer. and Mayor Sedivy; those voting No, none. Commission Resolution No. 1693 - Assessing Sprinkling Districts - $16,101.53 Commission Resolution No. 1693 levying assessment in the total amount of $16,101.53 for street sprinkling and cleaning for the year 1974 was presented. COMMISSION RESOLUTION NO. 1693 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CI'lY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1974. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the resolution be provisionally passed and adopted and Wednesday, 14 August 1974. be set as the I date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. and Mayor Sedivy; those voting No. none. Certificates of Completion: (a) sro's 525 to 530. 532 and 533 (b) Bozeman Creek Water Transmission Line The certificate of the engineers of Thomas. Dean & Hoskins. Inc.. on Special Improvement District Nos. 525 - 530, 532. and 533, stating the construction of the Sanitary Sewer, Storm Drain, and Water Main Improvements by Felton Construction Company have been completed in accordance with the plans and specifications, was presented. The City Manager concurred in the recommendation of the engineers and recommended that the project be accepted and approved by"the City Commission and final payment be made. This final acceptance does not relieve the contractor of the responsibility for negligence in faulty materials or workmanship within the extent or period provided for by law. The contractor had furnished a performance bond equal to the contract bid to guarantee materials and workmanship for a one year period commencing upon final acceptance. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that, as recommended, the project be accepted as completed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner I Vollmer. Commissioner Vandeventer. Commissioner Lehrkind. and Mayor Sedivy; those voting No. none. The certificate of the engineers of Thomas. A". 171 The City Manager concurred in the recommendation of the engineers and recommended that the project be accepted and approved by the City Commission and final payment be made. Claims for July 1974 Cia im Nos. 18514 thru 18763 and 07781 thru 07963, inclusive. were presented. It was moved by Commissioner Vollmer, seconded by COmmissioner Vandeventer, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those voting No. none. I Anjou~nment There being no further business to be brought before the Commission at this time, it was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind, that the meeting be adjourned.
