The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 31 July 1974. at 1:15 o'clock p.m. Present were Mayor Sedivy,
Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, Acting City Manager
Keyes. Acting City Attorney Angel, and the Clerk. I
Commissioner Vandeventer opened the meeting with a prayer and the following pro-
ceedings were had.
Minutes of the regular meeting held on Wednesday, 24 July 1974, were approved as
read.
'Rid 4>ening: 50.000 pounds of Sodium Si1icof1uorirle
This was the time and place set for opening bids for the purchase of 50,000 pounds
of Sodium Silicofluoride. The affidavit of publication of the "eall for Bids" was presented.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the bids
be opened and read and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind.
and Mayor Sedivy; those voting No, none.
The following bids were then opened and read:
Browning Chemical Corporation New York, NY $8 .500.00
Dyce Sales & Service Company Billings, MT 6.525.00
S. E. C. Corporation Billings, MT 7 ,210 . 00
Wyo-Ben Materials Supply Billings, MT 8,375.00
The bids were referred to the Water Superintendent for tabulation and recommendation. I
It was moved by Commissioner Vandeventer, seconded by Commissiorer Lehrkind, that
due to the instability of prices in freight costs the Acting City Manager be given
authorization to purchase the 50,000 pounds of Sodium Silicofluoride immediately from
Dyce Sales and Engineering, Billings, on the basis of their bid in the amount of $6,525.00,
it being the lowest bid and equaling or exceeding the specifications as contained in the
"Ca 11 for Bids". The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer, and
Mayor Sedivy; those voting No. none.
CommiRsion Resolution No. 1691 ~ Intent to Annex "Valley View Annexation No. 1" HearinR,
28 August 1974
Commission Resolution No. 1691 declaring the City Commission's intention to annex
a tract of land containing a total of 15.254 acres to be known and designated as the Valley
View Annexation No. 1 to the City of Bozeman, entitled:

that the Commission adopt the resolution and it was moved by Commissioner Lehrkind.

Acceptance of Equipment Bui1din~ at Sanitary Landfill
The combination equipment-storage building and maintenance shop located at the City
of Bozeman Landfill. having been completed in accordance with the plans and specifications,
was presented for acceptance. This final acceptance and payment does not relieve the
I contractor of responsibility for negligence or faulty materials or workmanship to the
extent and period provided by law. The contractor has furnished a performance bond equal
to the total contract &~ to guarantee materials and workmanship for a one year period
commencing upon final acceptance. It was moved by Commissioner Vollmer. seconded by
Commissioner Vandeventer, that they concur in the recommendation of the Acting City
Manager and accept the City of Bozeman Landfill combination equipment-storage building
and maintenance shop as completed. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner
Lehrkind. and Mayor Sedivy; those voting No, none.
Request for Sidewalk Abatement - Hal Bolinger
A letter received from Attorney H. A. Bolinger. in behalf of the Martha Palffy
Estate, requesting a sidewalk order abatement on the north ten feet of a twenty-five
foot strip of land generally between 11th and 15th Avenues on the souths ide of West Main
Street was presented.
Mr. Bolinger was also present to discuss the abatement in question and to answer
I any questions.
Following a lengthy discussion and in concurrence with the recommendation of the
Acting City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner
Lehrkind, that based upon the fact that sidewalks had been ordered in for the balance of
that area the request of H. A. Bolinger for a sidewalk order abatement on the above strip
of land be denied but that they authorize construction of a five foot sidewalk in place of
a ten foot sidewalk at this time. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Vollmer, and Mayor Sedivy; those voting No, none.
Request for Gas Tax Project (Sidewalks - $5 i 951. 38)
An application for the installation of miscellaneous sidewalks within existing
street right-of-way adjacent to the Soroptomist Park in the amount of $1.879.40 and Cooper
Park in the approximate amount of $4.071.98 to be paid for from Gas Tax Funds allocated
to the City of Bozeman under provisions of House Bill Nos. 42 & 436 and complying with
Rules and Regulations promulgated by the Montana State Highway Commission for administra-
- tion of the act was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner
I Vollmer, that the application be submitted to the Montana State Highway Commission as
presented and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer, and Mayor
Sedivy; those voting No, none.
Authority to Purchase 2 iOOO feet of 3/4 Inch Copper Tubing
The Water Department has need for an additional 2.000 feet of 3/4" Copper Tubing
at an estimated cost of $2,200.00 and the Acting City Manager requested authorization to
purchase the copper tubing. It was moved by Commissioner Vollmer. seconded by Commissioner

Vandeventer, that the Acting City Manager be granted the authority to purchase the above
copper tubing and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, COmmissioner Vandeventer. Commissioner Lehrkind, and
Mayor Sedivy; those voting No, none.
Request for Kennel License - Margaret Parmenter, 1617 Durston Road
An application received from Margaret Parmenter, 1617 Du~ston Road. requesting a I
kennel license in accordance with Ordinance No. 856, Section 5.16.040 of the Bozeman
Municipal Code, together with the required fee was presented.
The Acting City Manager and the Police Chief stated that they were n~aware of any
reason to deny the above kennel license and it was moved by Commissioner Vandeventer.
seconded by Commissioner Lehrkind, that the above application be approved and the Director
of Finance be instructed to issue a license to Margaret Parmenter in accordance therewith.

Request for Variance to Sign Code - Dr. William Oyler. 202 South Black
, ,
A letter received from Dr. William H. Oyler requesting a variance to construct
a sign at the corner of South Black and East Olive Street was presented.
The sign would be approximately 4 feet wide and 3 feet high and it would be approxi-
mately 3\ feet from the ground to the bottom of the sign. This sign would be a redwood
frame painted white with a plexiglass front. I
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the

Report: Fluoridation
The Acting City Manager commented on the Fluoridation report and recommended approval
thereof. It was moved by COmmissioner Vollmer, seconded by Commissioner Vandeventer.

License Bond - General Sign Company ~ $2.000.00
In compliance with Chapter 14 of the Bozeman Municipal Code, the continuation certi~
ficate of General Sign Company in the amount of $2,000.00 was presented. The Building
Inspector had recommended the continuation of the sign bond and the City Attorney had
approved the bond as to form. It was moved by Commissioner Vandeventer. seconded by
Commissioner Lehrkind. that the bond be approved and the motion was carried by the foI- I
lowing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner
Lehrkind, Commissioner Vollmer. and Mayor Sedivy; those voting No. none.
r:ontract flocuments for Execution - Bruce-Andersen C'.onstruction
The performance bond and the contract documents of Bruce-Andersen Construction for
the construction of the new fire sub~station on South Nineteenth Avenue near Koch Street
was presented. It was moved by COmmissioner Lehrkind. seconded by Commissioner ~011mer.
that the contracts be approved and the Mayor and Clerk of the Commission be authorized

and directed to sign the contracts for the City of Bozeman and that Bruce-Andersen
COnstruction be authorized and directed to proceed with the construction of the new
fire sub-station and the motion was carried by the following Aye and No vote: those

I Warranty Deed - Roadway Ri~ht-of-Way - Lovfald and Mecklenburg
A warranty deed whereby Anton and Helen D. Lovfald and W. Bruce and Gladys M.
Mecklenburg granted unto the City of Bozeman for street purposes a roadway right-of-way
located in the Southeast ~, Southeast ~, Sect ion 11, T2S, R5E, M. P. M. , including a portion
of Block 4. Kirk Subdivision Number 4, City of Bozeman. Gallatin County was presented.
Following a discussion. it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer. that the warranty Deed be accepted by the City of Bozeman and filed for
record with the Gallatin County Clerk and Recorder and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Lehrkind. and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to be brought before the Commission at this time,
it was moved by Commissioner Vandeventer, seconle::l by Commis s ioner Lehrkind, that the
