HomeMy WebLinkAbout1974-07-24 161 Bozeman, Montana 24 July 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 24 July 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, COmmissioner Vandeventer, COmmissioner Taylor, Commissioner Le~rki~d. I City Manager Frys1ie, Assistant City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceed- ings were had. Minutes of the special meeting held on Monday, 15 July 1974. were approved as read. Minutes of the regular meeting held on wednesQay, 17 July 1974, were approved as read. Restriction of Parking on East Main Street - David Lockie David Lockie, of the Mountain View MOtel and acting as spokesman for other businesses located on East Main Street, appeared before the Commission to request the City not to restrict overnight parking on East Main Street. The Assistant City Manager explained that the signs were installed due to the expan- sion of the sprinkling district in that area, to make it possible for early morning street cleaning. Mr. Lockie questioned the frequency of cleaning the streets. The City Manager stated the weather would have a lot to do with t~e frequency of cleaning the streets. He stated that a great deal of money has been spent across the country and in Bozeman to I maintain a safe and attractive environment, and there is nothing less attractive than trucks being parked all night on the streets. The Commission concurred in the recommendation of the City Manager that the request was unreasonable and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the signs remain in place and be enforced and that the City retain prohibition of on-street parking on East Main Street. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Application for Gas Tax Project - Purchase Road Oil from Montana State Highway $3,999.00 An application for the purchase of approximately 10.000 gallons of road oil from the State of Montana Department of Highways at an estimated cost of $3.999.00 including 10% handling and heating under AIR account to be paid for from the Gas Tax Funds allocated to the City of Bozeman under provisions of House Bill Nos. 42 & 436 and complying with Rules and Regulations promulgated by the Montana State Highway Commission for administration I of the act was presented. It was moved by Ornnmissioner Vandeventer. seconded by Commis- sioner Taylor, that the application be submitted to the Montana State Highway Commission as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No"none. Oraft of C~mblin~ Ordinance A draft of the proposed Gambling regulation for the City of Bozeman as prepared by the City Attorney was presented. After considerable discussion. the Commission agreed .........-............................... 162 to read and study the draft of the Gambling regulations for a period of one week to be brought back for discussion and a final decision on Wednesday. 31 July 1974. License Ronds - ('.ctton House Moving - $2.000.00 (r.ontinuation) Capitol Neon Sign - $2.000.00 (Continua~ion) In accordance with the provisions of Ordinance No. 785, the continuation certificate for the building movers bond as surety for a moving permit on Cotton House Moving, Helena, I Montana, in the amount of $2.000.00 and in compliance with Chapter 14 of the Bozeman Municipal Code the continuation certificate for Capitol Neon Sign in the amount of $2,000.00 was presented. The Building Inspector had recommended the continuation of the house moving bond and the sign bonds and the City Attorney approved the Bonds as to form. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the continuation of the two bonds be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Commission Resolution No. 1690 - Intent to Create SID No. 545, Construction of Sanitary Sewer on Ice Pond Road. Hearin~ 14 August COMMISSION;RESOLUTION NO. 1690 A RESOLUTION OF THE CITY C<H1ISSION OF THE CITY OF BOZEMAN. MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO ~. CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNWON AS SPECIAL IMPROVE- MENT DISTRICT NO. 545 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLA- TION OF A SANITARY SEWER LINE TO SERVE A PORTION OF THE BOZEMAN CREEK ANNEXATION TO THE CITY OF BOZEMAN, MONTANA, MORE SPECIFICALLY DESCRIBED AS FOLLOWS: AN EIGHT INCH SANITARY SEWER AND NECESSARY APPURTENANCES ALONG THE NORTH LINE OF TRACTS 5B. SC, 50, 5E. and 5F AND SAID LINE EXTENDED WESTERLY TO THE EXISTING SANITARY SEWER IN TRACT 5, ALL IN I THE BOZEMAN CREEK ANNEXATION TO BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY SEWER IS TO INCLUDE ALL TRENCH EXCA- VATION AND BACKFILL, BEDDING MATERIAL, SEWER PIPE, MANHOLES, NECESSARY WYES, AND OTHER NECESSARY APPURTENANCES. as prepared by the City Attorney as directed by the City Commission was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that COmmission Resolu- tion No. 1690 be passed and adopted and 14 August be the date set for public hearing and the motion was carried by the following Aye and NO.vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor. and Mayor Sedivy; those voting No. none. Sanitary Sewer Easements: Hubert M. Reid A'Delbert P. & Gladys Louise Samson Dorothy Meridieth Jack R. & laVell French George R. & Mary S. Roemhild Easement and Right-of-Way Agreements from Hubert M. Reid, A'Delbert P. & Gladys Louise Samson, Dorothy Meridieth. Jack R. & laVell French, and George R. & Mary S. Roemhi1d for the purpose of installing. operating. using. repairing. replacing, maintaining. and removing said sanitary sewer lines and appurtenances and for such other rights of access I and indidental rights thereto upon and across various properties located within the southeast portion of the City of Bozeman at no cost to the City of Bozeman was presented. Following a discussion. the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the six Sanitary Sewer Easements having been executed by the property owners be approved and the Mayor and Clerk of the Commission be authorized to sign for the City and - n-".--a ~_..._ _ .~. _ . ~ &. ..,,, 163 the motion was carried by the following Aye and No vote: those voting Aye being. Reports The following reports were presented: I Cemetery water Collector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Solution to Signing on East Main Street Interstate Several merchants from East Main Street appeared to further appeal to the City Commission to closing the westbound traffic lane of Interstate 90 from Bear Canyon to Bozeman. Following a thorough discussion it was moved by Commissiorer Lehrkind. seconded by Commissioner Vollmer, that the City Manager set up a meeting with the Montana State Highway Department, the City of Bozeman. and the East Main merchants to discuss some of the possible solutions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkinq, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, and Mayor Sedivy; those voting No. none. I Authorize Absence of Commissioner Taylor on 31 July and 7 August It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that in compliance with Section 11~3245, R.C.M., 1947. the absence of Commissimner Taylor from the meetings of 31 July and 7 August be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vo~lmer. Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy; those voting No. none. Ad;ournment There being no further business to be brought before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
