HomeMy WebLinkAbout1974-07-10 150 Bozeman, Montana 10 July 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 10 July 1974, at l:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, COmmissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie. Assistant City Manager Keyes, Acting City Attorney MOrgan and the I Clerk. Commissioner Vollmer opened the meeting with a~'prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 3 July, were approved as corrected. Open Construction Bids for Fire Station No. 2 This was the time and place set for opening bids for the construction of the new fire sub-station on South Nineteenth Avenue near Koch Street as prepared by George Mattson, Architect. Affidavit of publication of "Notice to Bidders" was presented and it was moved by Comm~ssioner Vollmer, seconded by Commissioner Vandeventer. that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. and Mayor Sedivyt those voting No, none. COmmissioner Lehrkind. Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Hearing, Changing Zoning AS to RS-l - Section 21, T2S. R6E, M. P.M. I ~, ~ This was the time and place set for a public hearing to consider an application from George Reiser for a zoning change to RS-l, Rural Suburban from Agricultural Suburban (AS). The Bozeman Zoning Commission having held a public hearing to consider the request for a zone change on property located south of and adjacent to east Kagy Lane and consisting of the ~ of the NW\ of Section 21. T2S, R6E. and belonging to George Reiser and having found that 68 acres of this area had been master planned in 1972 and that a subdivision for 5 acres of the master planned area had been approved at that time, therefore recommended the zone change from "AS to RS-l." I The Commission concurred with the recommendation of the Bozeman Zoning COmmission also concurred in by the City Manager and it was moved by Commissioner Taylor, seconded by COmmissioner Lehrkind, that they approve the zone change as recommended and the motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Taylor. Conditional Use Permit ~ RetreadiB~ Business - Tract 25 Mandeville School Section Subdivision This was the time and place set for a public hearing to consider a recommendation of the Bozeman City Commission regarding an application from Bruce Mecklenburg for a con~ ditional use permit to allow a retail retreading business in the M~2~T zone. The subject I property is located at the intersection of Meadow Lane and Griffin Drive in Tract 26 of the Gordon Mandeville State School subdivision. The Bozeman Zoning Commission having reviewed the application recommended approval thereof subject to the following conditions: 1. That all yard landscaping and sign requirements as outlined in the Zoning Ordinance be satisfied. 2. That a complete landscaping plan be submitted to the Building Inspector which conforms with the buffer requirements of the "T" district and which would assure that the development would be visually pleasing. 3. That well and septic tank system plans be submitted for review and approval by the County Health Department before building permits are approved. The Commission concurred with the recommendation of the Bozeman Zoning COmmission and it was moved by Commissioner Lehrkind, seconded by Commissioner VOllmer, that they approve conditional use permit to allow a retail retreading business in the M-2-T zone located at the intersection of Meadow Lane and Griffin Drive in Tract 26 of the Gordon Mandeville State School Subdivision with the three conditions as stated above. The motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Lehrkind, COmmissioner I Vollmer, Commissioner Vandeventer, COmmissioner Taylor, and Mayor Sedivy; those voting No, none. Request for Sewer SID to Serve Frope-ty at Colle~e Street and 19~h Avenue A letter received from Eugene Graf, Jr., petitioning the City of Bozeman to create a special improvement district for the installation of a sewer line north of West College Street and east of South 19th'IAveaeer:was':presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they acknowledge receipt of the petition to create a Special Improvement District and instruct the City Attorney to draw up the resolution of intention to create the special improvement district for the sewer construction as soon as the City Staff furnishes the proper information. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, COmmissioner Vandeventer, Commissioner Taylor. Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Authorization to Attend ~i~eme~'s Convention, Havre, 17-20 July Chief Hoey and ~i-efighter ~igoi~s The Montana State Fireman's Association 82nd annual conference is scheduled to be I held in Havre, 17-20 July 1974. Upon recommendation of the Fire Chief concurred in by the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner taylor, that Fire Chief Hoey and Firefighter Figgins be authorized to attend the convention, and it being in the public interest, their expenses be paid out of the General Fund and the motion was carried by the following Aye and No.vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind. Commissioner Vollmer. and Mayor Sedivy; those voting No, none. - ~'-~ --.. - -.. ~ --- ~'~ ~.". - , .- ,...' . . ., ..~. .. , .- - .. , . , .. . . 152 ChaD~e Order No. 1 ~ Multi Purpose Paviog Project $3,175.00 Change Order No. 1 on the MUlti Purpose Paving Project as prepared by Thomas, Dean & Hoskins, Inc., to become a part of the original contract for construction at the Irving and Willson Schools was presented as follows: Description: Additional paving areas at the Irving and Willson Schools. The Irving School area is a 90' x 12' wide driveway from South I 9th Avenue into the school. This will include a concrete curb cut on South 9th Avenue. The Willson School will include additional paving to the north (174' x 20.). This work includes a concrete sidewalk cut and removal. Both of the pavement sections are identical to the remainder of the playground areas. Purpose: These pavement increases were a request of School District No.7. Cost: Driveway and curb cut at the Irving School is $780.00 additional paving and sidewalk at Willson School is $2,395.00. The City Manager concurred with the engineers and recommended that Change Order No. 1 be accepted and approved as presented. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind, that the Change Order be approved and the Mayor and Clerk of the COmmission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissiore r Lehrkind, Commissioner yollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Change Order No. 1 ~ SID No. 530 - $365.00 Change Order No. 1 as prepared by Thomas, Dean & Hoskins, Inc., to become a part of the original contract for construction of Special Improvement District No. 530, Storm Drain Improvements for North 2lst Avenue. Bozeman, was presented as follows: I Change Order No. 1 Description: Installation of a 24" and a 36" storm drain debris rack on the inlet end of two storm drains in the vicinity of Kirk Park and Durston Road along North 21st AVenue. Purpose: WOuld eliminate some trash out of Kirk Park and from residential area, and probabilities of young children climbing into the inlet end of storm drain system. Cos t : 36" storm drain debris rack $218.00 installed and $147.00 for the 24" storm drain debris rack installed. The City Manager concurred with the engineers and recommended that Change Order No. 1 be accepted and approved as presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor. and Mayor Sedivy; those Voting No, none. Request for Abatement of Sidewalk Order - Bozeman Christian Church A letter received from Jay Wilson, Minister of the Bozeman Christian Church, requested a sidewalk variance for a period of one year on two'lots at East Garfield and South I Montana Avenue. The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they grant the request for an abatement for a period of one year until 15 July 1975. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the I Softball Association having met all requirements, they be granted a license to sell beer at the North Grand Park on 13-14, 20-21, 27-28 July and 3-4 August and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Resolution No.'s 1684 and 1685 ~ Amending SID Assessments in Block 8, Thompson's 4th Addition COMMISSION RESOLUTION NO. 1684 A RESOLUTION OF THE CCltMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CGfMISSION RESOLtrrION NO. 1620, LEVYING AND ASSESSING SPECIAL ASSESSMENT TAXES UPON THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 511. as prepared by the City Attorney amending Commission Resolution No. 1620 levying and assessing special assessment taxes in Block 8, Thompson's Addition #4, Lots numbered 1 through 27, inclusive. was presented. The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that Commission Resolution No. 1684 amending COmmission Resolution No. 1620, SID No. 511, be passed and adopted and the I motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. COMMISSION RESOLUTION NO. 1685 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CCHUSSION RESOLUTION NO. 1609, LEVYING AND ASSESSING SPECIAL ASSESSMENT TAXES UPON THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 512. as prepared by the City Attorney amending Commission Resolution No. 1609, SID No. 512, levying and assessing special assessment taxes in Block 8, Thompson's Addition No.4, Lots 1 through 27, inclusive, was presented. The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Commission Resolution No. 1685. License Bond: Bolin Plumbing and Heating - Plumbing and Gas Fitter. $5.000.00 I In compliance with Chapter 16 of the Bozeman MUnicipal Code the continuation of the Plumbing Bond of Bolin Plumbing and Heating in the amount of $5,000.00 was presented. The Building Inspector had recommended approval thereof and the Acting City Attorney approved the bond as to form. It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the continuation bond of Bolin Plumbing and Heating be approved and the motion was carried by the following Ay_e and No vote: those voting Aye being Commisssioner Vollmer, Commissioner Vandeventer, COmmissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. 15tl Execution of Contract Documents - Recreation Complex Building The contract documents for the construction of the Recreation Complex Building, Bureau of Outdoor Recreation No. 30-00171 were presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the contract documents of Robert A. Taylor, Construction, Bozeman, in the amount of $39,700.00 be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City I and that Robert A. Taylor. Construction, be authorized and directed to proceed with the construction of the Recreation Complex Building and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Reports The following reports were presented: Cashier Director of Public Service The City Manager commented on the reports and recommended approval thereof. Commission ResolutioQ No. 1687 - Creatin~ the Spedal ImrH'o'~eme,.,t District Re~'olving Fund SID No. 538 COMMISSION RESOLUTION NO. 1687 I A RESOLUTION CREATING SPECIAL IMPROVEMENT DISTRICT NO. 538, FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING C(MCRETE PAVEMENT, CURB, AND GUTTER, AND NECESSARY APPURTENANCES, AND STORM DRAINAGE PIPE, INLETS, MANHOLES. DITCHES AND APPURTENANCES NECESSARY IN SIIT OF BOZEMAN. MONTANA. as prepared by Lawrence D. Huss, of the law offices of Scribner & Russ for the purpose of creating a Special Improvement Revolving Fund for Special Improvement District No. 538 was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Omnmission Resolution No. 1687 creating the Special Improvement District Revolving Fund for Special Improvement District No. 538 be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Water Depa~tment - Purchase Coppe~ ~!bing The Water Department has need for 3,000 feet of 3/4" Type K Copper Pipe at an approxi- mate cost of $3.000.00 and the City Manager requested authorization to purchase the copper pipe. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the I City Manager be granted authority to purchase the above pipe and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor.
