Montana 19 .Tune 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 19 June 1974, at 1:15 o'clock p.m. Present were Acting Mayor Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Acting City Manager Keyes, Acting City Attorney Andriolo, and the clerk. I Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held on 12 June were approved as read. Open Rids - Recreation ~omplex This was the time and place set for opening bids for the construction of the Recreation Complex Building, Bureau of OUtdoor Recreation No. 30-00171 Affidavit of publicati on of "Notice to Bidders" was presented and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Commissioner Vollmer; those voting No, none. The following bids were then opened and read: Bruce-Anderson, Bozeman $41,428.50 Martel Construction, Bozeman !~ 7 ,200.00 Robert A. Taylor Construction, Bozeman 39,700.00 Tonca Construction, Bozeman 39,720.00 The Commission concurred with the recommendation of the Acting City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the bids be referred to I the office of Don McLaughlin, Architect, Peter Commers, Associate, for tabulation, consideration and recommendation oil 26 June 1974 and the motion was carried by the follmdng Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Oommissioner Vandeventer, and Commissioner Vollmer; those voting No, none. Hearing, r.onrl it iona I ITs e Permi t : Shopping Center - Joe Sabol This was the time and place set for a public hearing to consider an application from Joseph W. Sabol for a conditional use permit to build a shopping mall in Block 3 (except lot 1) and all of Rlock 4, lots 8, 9, and 10 in Rlock 2, in Kirk's Subdivision No.4 to the City of l)ozeman. The Bozeman Zoning Oommission having reviewed the application voted to recommend approval of the proposed shopping center contingent upon the following condit'ions: 1. ~hat the City Engineer's Office review and approve: A. Any construction over utility easements. B. The lighting system proposed for the shopping center. C. The final overall circulation system involved in the shopping center as well as all related ingress-egress points. 2. That final landscaping plans be submitted fo':" a review by the Zoning Commission and approval hy the City Commission and that such plan comply ~qith the requirements of I the Zoning r..ode. 3. That lots 8, 9, and 10 in block 2 be deleted from the proposed shopping center. Following an extensive discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they table consideration of the application for a period of one week in order that they might look at and study the plans before making a decision on the conditional use permit to build a shOpping mall as stated above. Hearing. Conditional Use Permit: Garage and Workshop - Warren Yeley This waR the time and place set for a public hearing to consider an recommendation of the Bozeman City Zoning Commission regarding an application from Warren J. Yeley for a conditional use permit to a llow a 40' x 50' garage and home works hop- on a one acre tract of land in the SEt.. I Sl~t. . Section 32. TIS, R6E. MPM. Located at 1509 Hillside Lane. The Zoning r~mmission having reviewed the application recommended approval thereof, Mr. Yeley was present to state that no commercial work would be performed on the site. The Commission concurred with the recommendation of the Acting City Manager and it was moved- by Commissioner Vandeventer, seconded by Commissioner Taylor. that they approve Warren Yeley's conditional use permit to allow a 40' x SO' garag~ and home workshop on the property as stated above. The motion was car~ied by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Ornnmissioner Lehrkind. and Commissioner Vollmer; those voting No, none. Hearing. Conditional Use Permit: Church - Latter Day Saints This was the time and place set for a public hearing to consider an application from the Latter Day Saints Church for a conditional use permit to erect a church on lots 2 through 5. Block 3. and a portion of tract A in Graf's Third Addition to the City of Bozeman. The zoning Commission having reviewed the application voted to recommend approval thereof contingent upon the following conditions: L That not less than 75% of all yards and side yards abutting streets or avenues shall I be landscaped in compliance with Section 22.15 of the Zoning Code. 2. That a landscaping buffer be incorporated along the entire periphery of the site. Such landscaping plans being subject to the approval of the City Commission. Following an extensive discussion, it was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that they approve the conditional use permit to erect a church on lots 2 through 5. Block 3. and a portion of tract A in Graf's Third Addition with the provisions that the Zoning Commission set forth. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind, Commissioner Vandeventer. and Commissioner Vollmer; those voting No. none. Hearing. Conditional Use Permit: Private School - Rudolph and rErol Dietrich This was the time and place set for a public hearing to consider an application from Rudolph and Carol Dietrich for a conditional use permit to start a private school on a tract of land 57.3' x 126.68'-lying east of Block B of Hoffman's Addition to the City of Bozeman. located at 120 East Story Street. The Zoning Commission having reviewed and discussed the application voted to recommend approval of the application subject to the condition that the number of pupils attending the I school not exceed 12. Following a thorough discussion>> it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they table final decision of the application for a conditional use permit until they have proof there will be a school and to review the parking requirements. The motion was carried -by the following Aye and No vote:- those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer. Zone Code Change: ~ Section 14 T2S, R6E - AS to M-l Seventh Day Adventists This was the time and place set for a public hearing to consider the application of the Montana Conference Association of Seventh Day Adventists for a change in the zone classification from Agricultural Suburban (AS) to Commercial-Light Manufacturing (M-l) for the Bear Creek Subdivision. located in the ~ of Section 14. T2S. R6E. MPM. The Zoning Commission having reviewed the application voted to recommend approval of the I petition and also recommended to tre City Commission that the portion of land lying east of the Bear Creek subdivision to the intersection of Highway 10 and U. S. 1-90 me included within the same classification. The Commission concurred with the recommendation of the Acting City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they approve the zone change as recommended by the Zoning Commission. Bids - h'ire Sllb-S!"ation, Open 10 Jllly plans and specifications for the construction of the new Fire Sub-Station on South Nineteenth Avenue near Koch Street as prepared by George Mattson, Architect. was placed before the Commission. The Acting City Manager recommended that the plans and specifications as presented be approved and that a "Call for Bids" for the construction of the new Fire Sub-Station be authorized I with an opening date of 10 July 1974. Eyecution - 1974 Walk an~ Curb Program The performance bond and contract documents for- thE contract of Binder Construction Company, Bozeman, awarded 12 June 1974 for the construction of miscellaneous \valk' and curbs within the ~ity of Bozeman for the year ]974 were presented. The bond and contract were approved as to form by the Acting City Attorney, and the Acting City Manager reported that the City had evidence that the cont-rnctor is 3dequately insured anr! recommended the documents be approved. Payne Company, Tnc. , in the amount of $5,000.00, and in compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing bond of American Plumbi.ng and Heating in the amount of $5,000.00 were presented. The Building Inspector had recommended approval thereof and the Acting City Attorney had approved the bonds as to form. Request to Close North Grand Avenue and West Cottonwood Street for Men's Softball Association A request frmn the Men's Softball Association for permission to close North Grand and Cottonwoor! Street on 22-23 June, 19-20-21 July, and 9-10-11 August was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they be allowed to close North Grand Avenue and Cottonwood Street on 22-23 June, 19-21-21 July, and 9-10-11 August and that they provide their own barricades and protection during this time and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, 1- Commissioner Taylor, Commissioner Lehrldnd, and Commissioner Vollmer; those voting No, none. Authorize Absence of Commissioner Vandeventer - 26 June and 3 ,July Upon recommendation of the Acting City Manager, it was moved by Connnissioner Taylor, seconded by Commissioner Lehrldnd, that in compliance with Section 11-3245, R.C.M.. 1947, the absence of Connnissioner Vandeventer from the meetings of 26 June and 3 July be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner 139 Taylor, Commissioner Lehrkind, Connnissioner Vandeventer, and Commissioner Vollmer; those voting No, none.
