HomeMy WebLinkAbout1974-06-12 130 Bozeman, Montana 12 June 19711 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Build ing, 12 June 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm- issioner Vandeventer, Commissioner Lehrkind, City Manager Fryslie, Ass't City Manager Keyes, Acting City Attorney Morgan and the clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held on 5 June 1974 were approved as read. I Consid';:')::..8 ti~.9l__'v!~::s and Ct.:E!?.s Bid: The City Engineering Staff having completed their study of the bids for construction of Walks and Curbs for 1974, recommended that Binder Construction Company be awarded the bids for the sidewalk construction on the basis of their low bid in the amount of $20,104.50. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bid be awarded to Binder Construction Company on the basis of their bid it being the lowest and best bid submitted and equaling or exceeding the specifications as contained in the "Call for Bids." The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, ~emm~BBie"e~-Iay~e~ and Mayor Sedivy; those voting No, none. Sale of Bonds - SID No. 535 08~J0, SID No. 536 ($62,000), SID No. 537 ($96!00~SID No. 538 <$18l;,000~D No. 5L.2 ($l3,OOq), (SID No. 5L.3 ($23,000) : The City Manager stated that according to the affidavit of publication this was the time and place set for the bond sale of Special Improvement Districts No. 535, 536, 537, 538, 542 and 543. The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated that the amount of bonds to be sold for each district would be the same as the advertised amount and announced that the City was ready to conduct the hidding on the bonds of SID No. 535 in the amount of $80,000.00. A sealed bid submitted by D. A. Davidson, Inc., of Great Falls, in the amount of 6.70% was opened and read. It was then announced that oral bids for the purchase of the bonds in accordance with the Notice of Sole would be received. The following bidders having presented good faith checks as prescribed I by the "Notice of Sale" then s11bmitted orBI bids and the final and best oral bids submitted by each of said bidders was as follows: First Security Bank of Bozeman 6.30% Fitst National Bank of Bozeman 6.25% Following the recommendation of the City Manager, it was moved by Commissioner Vandeventer, se- conded by Commissioner Lehrkind, that the bid of First National Bank of Bozeman in the amount of 6 . 2 S'X, , it being the lowest and best bid submitted, the sale of the bonds be awarded to First National Bank of Bozeman and the bid security of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss ioner Lehrkincl, Commissioner Vollmer and Mayor Sedivy; those voting No, none. The Mayor and the City Manager outlined the proceedure for conducting the bond sale of SID No. 536 in the amount of S62,OOO.00. A sealed bid submitted by D. A. Davidson, Inc., of Great FBlls, in the amount of 6.75% was opened and read. It was then announced that oral bids for the purchase of the bonds in accordance with the Notice of Sale would be received. Following the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded I by Commissioner Vollmer, that the bid of First Security Bank of Bozeman in the amount of 6.35% it being the lowest and best bid submitted, the sale of the bonds be awarded to First Security Bank of Bozeman and the bid ~ecurity of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrldnd, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. The Mayor and the City Manager outlined the proceedure for conducting the bond sale of SID No. 537 in the amount of $96,000.00. A sealed bid submitted by D. A. Davidson, Inc., of Great Falls, in the amount of 6.70% plus a $10.00 premium. 131 It was then announced that oral bids for the purchase of the bonds in accordance with the notice of sale would be received. The following bidders having presented good faith checks as prescribed by the "Notice of Sale" would be received. The Mayor and the City Manager outlined the proceedure for conducting the bond sale of SID No. 538 in the amount of $184,000.00. It was moved my Commissioner Vandeventer, seconded by Commissioner Lehrkind that the sealed bid submitted by D. A. Davidson, Inc., of Great Falls in the amount of 6.625% plus a $10.00 premium it being the one and only bid submitted, the sale of the bonds be awarded to D. A. Davidson, Inc., Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. The Mayor and the City Manager outlined the proceedure for conducting the bond sale of SID No. 542 in the amount of $13,000.00 and announced that oral bids for the purchase of the bonds in accord- ance with the "Notice of Sale" would be received. The following bidders having presented good faith checks as prescribed by the "Notice of Sale" then submitted oral bids and the final best oral bids submitted by each of said bidders was as follows: First National Bank of Bozeman 6 . 75"/0 Jack Brant Realty 6.60% Following the recommendation of the City Manager, it was moved by Commissioner Vandeventer, I seconded by Commissioner Vollmer, that the bid of Jack Brant Realty of Bozeman in the amount of 6.60'/0' it being the lowest and best bid submitted, the sale of the bonds be awarded to Jack Brant Realty and the bid security of the unsuccessful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. The Mayor and the City Manager outlined the proceedure for conducting the bond sale of SID No. 543 in the amount of $23,000.00 and announced that oral bids for the purchase of the bonds in accord- ance with the "Notice of Sale" would be received. The following bidders having presented good faith checks as prescribed by the "Notice of Sale" then submitted oral bids and the final best oral bids submitted by each of said bidders was as follows: First National Bank of Bozeman 6.55% Jack Brant Realty 6.50'10 Following the recommendation of the City Manager, it was moved by Commissioner Vollmer, se- conded by Commissioner Vandeventer, that the bid of Jack Brant Realty of Bozeman in the amount of 6.50"/0' it being the lowest and best bid submitted, the sale of the bonds be awarded to Jack Brant Realty and the bid security of the unsuccessful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Amendement to Zone Code - Ambulance Services in R-4 Zone The request from Dean A. Hofman of Lee Ambulance Service to include an ambulance service in the R-4 Zone as a permitted used having been delayed for a period of one week in order that the Comm- ission might view the area in question was again presented for discussion and a final decision. I The Zoning Commission at their meeting on 28 May considered the application of Dean A. Hofman of the Lee Ambulance Service and recommended to the City Commission that they amend the provisions of the R-4 Zoning District to include ambulance services as a permitted use. Following an extensive discussion, it was moved by Commissioner Vollmer. seconded by Commissimer Vandeventer, that they amend Section 33 of the Bozeman Zoning Code to include ambulance services RS a permitted use in R-4 Zones. The motion was carrie d by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. 132 It was then moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind. that the city staff and legal department be instructed to investigate what controls, if any, are needed to regulate emergency vehicle operations within the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting :ro, none. Consideration of Bids: SID's 530, 535, 536, 537. .5 38, 5/12 and 51,3 ......._.....-._..~--+--,.- ........................~_. The engineers representing consultants Thomas. Dean & Hoskins, Inc., and the City engineer I having completed their study of the bids submitted for the construction of the paving and storm drain of SID 530 North Twenty-First Avenue from Beall to Durston, SID 535 West Hemlock Street Seventh to Fifth Avenue, SID 536 West Oak Street Seventh to Fifth Avenue, SID 537 Kagy Blvd. Seven- thto Eleventh Avenue, SID 538 South Eleventh Avenue Kagy to Lincoln Road, SID 542 Olive Street Tenth to Eleventh Avenue and SID 543 Beall Street Tracy to Willson Avenue having prepared a final tabulation of the bids recommended that the bid be awarded to Bozeman Sand and Gravel, Bozeman on the basis of their low bid in the amount of $!~26,875.35. The Commission concurred with the recommendation of the engineers, also concurred in by the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Boze- man Sand and Gravel be awarded the bid on the basis of their low bid in the amount of $426,875.33 and that the bid security of the unsuccessful bidders be returned and the motion tvas carried by the following Aye and No vote: thoe voting Aye being Commissioner l.ehrkind, Commissioner Vollmer, Comm- issioner Vandeventer and Mayor Sedivy; those voting No, none. A request from Swanson's Mobile Service and Williams Texaco for a Sidewalk variance from Main I Street North on both sides of North Grand Avenue was presented. It was moved by Commissioner Lehr- kind, seconded by Commissioner Vollmer, that the 104 linear feet of new sidewalk on both sides of North Grand Avenue from Main Street be abated for a period of one year and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer Commissioner Vandeventer and Mayor Sedivy; those voting No, none. A letter recei.ved from James Bassett requesting a sidewalk construction variance on one vacant lot on North 16th Avenue and one vacant lot on North 17th Avenue was presented. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Vande- ~ t1r;' .' Authority to Call for Bids; Interior Fencing, Recreation Complex - Open 26 June 197~ Plans and specifications for the installation of Interior Fencing for the Boz~man Recreation Complex was placed before the Commission. I The City Manager recommended that the plans and specifications as presented be approved and that a "Call for Bids" for the installation of the miscellaneous fencing be authorized with an opening date of 26 June 1974. Reque~t to_Close Grand Avenue and Cottonwood Street for Softball Tournament 15-16 June 197/1 (IiTOtuml) A letter received from the Womens Softball Association requesting penlission to close Grand Avenue and Cottonwood Street on 15-16 June 1974 for the Womens Softball Tournament was presented. It was moved hy Commissioner Lehrkind, seconded by Commissioner Vollmer, that they allow the Womens Softball Association to close North Grand Avenue and Cottonwood Street during the Homens Softball Tournament and that they provide their own protection. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
