The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 29 May 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm-
issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Frys1ie, Ass't. City
Manager Keyes, Acting City Attorney Morgan and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 22 May 1974 were approved as read. I
Rezoning and Proposed Covenants - 91 Acres Northwest of Bozeman
The declaration of protective covenants for Gardner Light Industrial Plaza having been tabled
for a period of one week for review by the Commission was removed from the table for a final decision.
Following a discussion the developer expressed tITillingness to make the minor changes suggested by
the City Manager and concurred in by the City Commission. It was moved by Commissioner Vollmer, sec-
onded by Commissioner Vandeventer, that they approve the Declaration of Protective Covenants as amended
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
Consideration of the application of G-B Properties and American Simmental Association to change
a 91 Acre tract of land in Section 35, TIS, R5E, from AS to M-l Zone having been previously considered
and tabled for reviewcr the recordable covenants on 8 May was again brought before the Commission
for action. The City Manager concurred with the recommendation of the Zoning Commission and recommended
that they approve the request from G-B Properties and the American Simmental Association to change a
91 acre tract of land in 'Section 35, TIS, RSE, from AS to M-l. It was moved by Commissioner Vandeventer
seconded by Commissioner Taylor, that they approve the request to rezone the 91 acre tract of land
from AS to M-l Zone. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No. none.
Authority to Call for Bids - llecreation Complex Building, Open19 June 197/1,
Plans and specifications for the construction of the Recreation Complex Building, Bureau of Out-
door Recreation No. 30-00171 as prepared by Don McLaughlin, Architect, Peter Komers Association was I
placed before the Commission.
The City Manager recommended that the plans and specifications as presented be approved and that
a "Call for Bids" for the fencing be authorized with an opening date of 19 June. It was moved by Comm-
issioner Taylor, seconded by Commissioner Lehrkind, that they concur in the City Managers recommendation
and authorize and direct the Clerk of the Commission to publish a "Call for Bids" with an opening date
of 19 June 1971f and the moti.on was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor
Sedivy; those voting No. none.

The City Manager informed the Commission of the steps taken requesting implementation of the
TOPICS study which has been prepared by the Montana State Highway Department by consultants Menasco-
Mcquinn. He further stated that the traffic problem has.been the subject of numerous conversations
between citizens, the City Commission and himself for quite sometime. Due to these comments and his
own personal observations of the Critical nature of the traffic condition he recommended more positive
action should be taken. During the discussion several members of the Commission expressed their con-
cern and personal observation of the traffic problems within the City of Bozeman and it was moved by
Commissioner Lehrkind, seconded by Commissioner Vollmer, that they instruct the City Manager to convey
their concern of the ever increasing~affic problems within the City of Bozeman, particularly in the
downtown central business district, to Mr. H. J. Anderson, Director of Montana State Department of
Highways, requesting that he personally expedite the construction for this project. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner I
Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
Abatement - Sidewalk Insta11at!oo 00 South Tracy Avenue, University Addn.
A letter received from four property owners requesting a variance of sidewalks in the following
area due to lack of foot traffic on this portion of South Tracy was presented.

It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they grant the
request for a variance of the sidewalks on South Tracy Avenue in the University Addition contingent
upon the improvement of the park at which time sidewalks will become necessary for the safety of the
public. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those
voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting
No, none.
