HomeMy WebLinkAbout1974-05-22 122 Bozeman, Montana 22 May 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Build ing, 22 May 1974 at 1:15 o'clcok p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commiss- ioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Frys1ie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 15 May 1974 were approved as read. I f:~Hlsideration ?f Bids - Bogert Swimming Pool and Bath House: The Commission was referred to the opening of bids for the reconstruction of the Bogert Municipal Swimming Pool and the adjoining Bath House and the installation of new mechanical equipment together with design and engineering of the project. The City Engineer, the Park Superintendent and the Park Recreation Director having completed there study of the bids submitted for Contract No. I, construction of the swimming pool shell, equipment and fil ter tank, recommended that the bid be awarded to Intermountain Specialty Construction of Salt Lake City, Utah, on the basis of their low bid in the amount of $99,500.00, it meeting or exceeding the specifications in the "Call for Bids." The Commission concurred in the recommendation of the engineering staff and other staff members, also concurred i.n by the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Intermountain Specialy Construc tion of Salt Lake City, be awarded the bid in the amount of $99,500.00, it meeting or exceeding the specifications in every respect with the "Call for Bids," and that the bid bonds of the unsucessful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Covenants Proposl:=...<l - Rezoning 91 Acres North~est of J!ozeman AS to 1'1-1 America~l Simmenta1 & GB Properties: A request from GB properties and American Simmental Association to change a 91 acre tract of land in Sec. 35, T1S, R5E, from AS to M-1 having been tabled to review the recordable covenants was again presented along with a copy of the protective covenants. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the request be tabled for a period of one week in order that the Comm- ission review the Declaration of Protective Covenants for Gardner Light Industrial Plaza for a decision to be made on Wednesday, 29 May 1974 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandew venter and Mayor Sedivy; those voting No, none. Authority Lo Condl~t Parade - .B.P.O.E. 1,63, 8 June 197t+: A letter received from Duain Bowles, Exalted Ruler of the Bozeman Elks Lodge No. 463 requesting permission to conduct a parade on 8 June 1974 on the streets adjacent to the new BPOE #463 Elks Home was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the re- quest to conduct the parade be granted and the motion was carried by the following Aye and No vote: I those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commiss- ioner Taylor and Mayor Sedivy; those voting No, none. Authority to Purcl:ase Riding MO'1er (Dll~8 Hydrostatic) - Cemetery $1,900.00; The Cemetery has need for a riding mower and requested authorization to purchase a Hydrostatic Rotary Mower #0148 at an approximate cost of $1,900.00. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the purchase of the Hydrostatic Rotary Riding Mower be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. 123 Designation of Chairman and Appointment of Member: Bozeman Parking Commission: Mayor Sedivy announced his appointment of Bob Evans to the Bozeman Parking Commission to replace Jack Greenway who had resigned since he did not reside within the City of Bozeman. The Mayor also announced Rod Marshall as chairman of the City of Bozeman Parking Commission. It was moved by Comm- issioner Vandeventer, seconded by Commissioner Taylor, that they concur in the Mayors appointment of Bob Evans and announcement of Rod Marshall as Chairman of the Bozeman Parking Commission. The motion I was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, those voting No, none. Resolution No. 1673 - Intent to Create SILD No. 544, Willson Ave., Babcock to Olive Street: COMMISSION RESOLUTION NO. 1673 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID CITY COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 544 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT soum WILLSON AVE- NUE BETWEEN WEST BABCOCK STREET AND WEST OLIVE STREET, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMANCE WITH SECTIONS 11-2245 TO 11-2257, INOLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. as prepared by the City Attorney as directed by the City Commission and to be known as Special Im- provement Lighting District No. 544 for the purpose of operating and maintaining a street lighting system to light South Willson Avenue between West Babcock Street and West Olive Street and to be inst- alled and paid for by the Montana Power Company was presented. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that Commission Resolution No. 1673 be passed and adopted and Wednesday, 12 June be the-date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor S~divy; those voting No, none. Proclamation: "Poppy Days~L-:l4-25-Ml'lY 1974: In accordance with a letter received from Mrs. Isam Love, Poppy Chairman, Ameri.can Legion Auxi- liary, Mayor Sedivy proclaimed 2l~-25 May 1974 as "Poppy Day" in the City of Bozeman and urged every I citizen to give generous recognition to this program and obtain and wear a Memorial Red Poppy on these days. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Reports: The following reports were presented: Director of Finance Librarian Chief of Police The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor and Mayor Sedivy; those voti.ng No, none. Meeting at Office of County Attorney - Recommendation Relative to Interlocal Agreement Rec. Swim Facility: A Interlocal Cooperation Agreement to provide for a Joint Recreational Instructional Swimming Facility with School District No. 7 and Bozeman High School District as amended and reviewed by County Attorney Tom Olson was presented. Following a discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they approve the amended copy of the Interlocal Agreement and authorize and direct the Mayor and Clerk of the Commission to sign the Interlocal Agreement for the City of Bozeman. The motion was carried by the following Aye I and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkin9 and Mayor Sedivy; those voting No, none. Adjoyrnment: There being no further business to come before the Commission at this time, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehkrind, Commissioner No, none.
