HomeMy WebLinkAbout1974-05-15 118 Bozeman, Montana 15 May 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 15 May 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commiss- ioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 8 May 1974 were approved as corrected. Hearing, Request to Rezone Portion of Section 20, T2S ,_ R6E , from AS to RS -1, Kenne th Nordved t, Jr.: I This was the time and place set for a public hearing to consider a recommendation from the Zon- ing Commission to reclassify a parcel of land in Section 20, T2S, R6E, and belonging to Kenneth Nordved t, Jr., f rom AS toRS -1 . The Zoning Commission having met and heard the request on 23 April 1974, recommended to the City Commission that they grant the Zone change from AS to RS-l. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they concur in the recommendation of the Zoning Commission also concurred in by the City Manager and approve the Zone Change from AS to RS-l on a parcel of land in Section 20, T2S, R6E and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Hearing, Request to Rezone Portion of Sec. 9, T2S, R5E from AS to B-2, Denn~s Wheat; Smiley & Nash: This was the time and place set for a public hearing to consider a recommendation from the Zoning Commission to reclassify a portion of the SE 1/4 of theSE 1/4 of Sec. 9, T2S, R5E, from AS to B-2 and belonging to Dennis Wheat. The Zoning Commission having met and heard the request on 23 April 1974 recommended to the City Commission that they deny Mr. Wheats request for a zone change from AS to B-2, but that they recommend to the City that they grant a Zone Change from AS to M-l. The Zoning Commission also recommended that the City Commission approve a previous request from Richard Smiley and Don Nash to rezone their property located adjacent to the Wheat property from AS to M-I. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they concur in the City Managers recommendation and approve the zone change from AS to M-l on the property owned hy Dennis Wheat, Richard Smiley and Don Nash. The III motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Open Bids_L..Aogert Park Swimming Pool and Bath House: This was the time and place set for opening bids for reconstruction of the Bogert Municipal Swimm- ing Pool and for the adjoining Bath House and the installation of new mechanical equipment together with design and engineering of the project. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the bids be opened and read and the motion was carried by the following Aye and no vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. The following bids were then opened and read: Contract 4fr1 Contract #2 Intermountain Specialty Construction, Salt Lake City $99,500.00 Alpha Western Pools, Bellevue, Wash. 102,500.00 Bruce-Anderson Construction, Bozeman $90,685.00 Edsall Construction, Bozeman 95.578.60 The Commission concurred in the recommendation of the City Manager and it was moved by Commiss- ioner Lehrkind, seconded by Commissioner Vollmer, that the bids be referred to the City Engineer, the Park Superintendent and the Park Recreation Director for final tabulation and recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Consideration of Bids - a) Sign Blanks, b) Sign Poles: The Commission was referred to the opening of bids for the purchase of various signing material and aluminum blanks to fabricate new signs to be installed within the business district of Bozeman and to be paid out of Gas Tax funds HB42-436. The Ass't City Manager having completed their study of '. '" the bids submitted and having prepared a final tabulation of the bids recommended that the bid be awarded to Kaiser Aluminum, Oakland, California, on the basis of their bid in the amount of $1,593.25 it being the lowest bid and meeting or exceeding the specifications in the "Call for Bids." The Commission concurred with the recommendation of the Ass't. City Manager, also concurred in by the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, 119 that Kaiser Aluminum, Oakland, California, be awarded the bid for the signing material and aluminum blanks in the amount of $1,593.25 contingent upon receiving written approval from the Montana State Highway Department. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. The Commission was referred to the opening of bids for the purchase of 400 12' fully galvanized outsidediameter posts to be used to install various signs within the business district of Bozeman and I to be paid out of Gas Tax funds, HB42-436. The Ass't City Manager having completed his study of the bids submitted and having prepared a final tabulation of the bids recommended that the low bid of Vulcan signs be rejected since they did not meet all specifications in the "Call for Bids" and that the bid be awarded to Pacific Hide and Fur on the basis of their bid in the amount of $4,568.00, it meeting or exceeding the specifications in the "Call for Bids." The Commission concurred with the recommendation of the Ass't. City Manager, also concurred in by the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that Pacific Hide and Fur be awarded the bid for the 400 12' posts in the amount of $4,568.00 contingent upon receiving written approval from the Montana State Highway Department. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Consideration: Commission Resolution No.. 1673 - Create SILD 541, Willson, Babcock to Olive Street: Commission Resolution No. 1673 for the purpose of creating Special Improvement Lighting District No. 541, South Willson Avenue from Babcock Street to Olive Street having been delayed for a period of one week to further consider the protest of Mr. Green and Mr. Farmer was presented for further consideration. Following a discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they do not create Special Improvement Lighting District No. 541 and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commission- er Vandeventer and Mayor Sedivy; those voting No, none. I It was moved byCommissioner Lehrkind, seconded by Commissioner Vollmer, that upon receiving the proper information from the engineering staff, the Gity Attorney be instructed to prepare a resolution of intention to create Special Improvement Lighting District No. 541 on South Willson Avenue from Babcock Street to Olive Street. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy; those voting No, none. Consideration: Commission Resolution No. 1675, Create SID No. 543, Pave Villard from Tracy to Willson Commission Resolution No. 1675 for the purpose of creating Special Improvement District No. 543 paving Villard Street from Tracy Avenue to Willson Avenue for a period of one week to further consider the protests of Mr. Vicain and Mrs. Mitchell was presented for further consideration. Following discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1675 creating the district, entitled: COMMISSION RESOLUTION NO. 1675 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 543 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVING, INTEGRAL CONCRETE CliJRB AND GUTTERS, NECESS- ARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE INLETS, MANHOLES, DITCHES OR OTHER APPURTENANCES TO STORM DRAINAGE ON VILLARD STREET BE1WEEN NORTH TRACY AVENUE AND NORTH WILLSON AVENUE IN THE CITY OF BOZEMAN, MONTANA. as prepared by the City Attorney be passed and adopted and the motion was carried by the following I Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, Commissioner Vollmer. ~oi~~ment of Parki~ommission Mayor Sedivy announced his appointment of the following to the City of Bozeman Parking Commission. Term - 30 June 1975 Milt Vandeventer, Liaison Officer - 30 June 1976 The Commission concurred in the Mayors appointment and it was moved by Commissioner Vandeventer, 120 seconded by Commissioner Taylor, that the above be appointed to the City of Bozeman Parking Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande- venter, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Request to Conduct First Annual Governor's Cup Race: A letter received from Andy Blank, Race Director of Big Sky Winddrinkers requesting permission to conduct the First Annual Governor's Cup Race on Monday, 27 May 1974 was presented. It was moved I by Commissioner Taylor, seconded by Commissioner Lehrkind, that permission be granted the Big Sky Winddrinkers to conduct the First Annual Governor's Cup Race and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Comm- issioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Interlocal "Agreement - SHimming Pool It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the City Managers recommendation and approve the Interlocal Cooperation Agreement to provide for a joint recreational-instructional swimming facility between the City of Bozeman and the Bozeman High School District and School District No. 7 of Montana as provided for in Section 16-4901 through 16-4909, R.C.M., 1947, Article XI, Section 9 of the Constitution of Montana, and further provided for by the Inter- local Agreement to provide for a Joint Community Recreation Department, approved by the Attorney General's office, 15 May 1973. The Mayor and Clerk of the Commission were authorized and directed to sign the Interlocal Agreement for the City of Bozeman. The motion was carried by the following Aye and No vo te : those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vande- venter, Commissioner Taylor and Mayor Sedivy; those voting No, none. North Seventh Avenue Sidewalks: -- ~- ~ The question of ordering in sidewalks on both sides of North Seventh Avenue from Durston Road north to Oak Street was placed before the Commission. Following a thorough discussion and review of information supplied by the City Engineer and City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they order in sidewalks from Durston Road to Oak Street on the east side of North Seventh Avenue and from Durston I Road to the Holiday Inn on the west side of North Seventh Avenue. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commiss- ioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Authorization to "Call for Bids" 1971, t~alk and Curb Pro~ram: The City Manager requested authorization to place a "Call for Bids" for repair and/or replace- ment of Walks and Curbs within the City of Bozeman for the year 1974. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Clerk of the Commission be authorized and directed to issue a "Call for Bids" for repair and/or installation of ''Walks and Curbs" to be opened on 5 June and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss- ioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. , ^uthori.zation to "Call for Bids" - SID No's. 530, .535, 536, 537 , 538, 5112 and 5l,3: Plans and Specifications covering the proposed improvement in Special Improvement District No. 530 for paving North 21st Avenue from Beal Street to Durston Road, Special Improvement District No. 535 for paving West Hemlock Street, Seventh to Fifth Avenue, Special Improvement District No. 536 paving West Oak Street, Seventh to Fifth Avenue, Special Improvement District No. 537 paving Kagy Blvd, seventh to Eleventh Avenue, Special Improvement District No. 538 paving South Eleventh Avenue Kagy to Lincoln Road, Special Improvement District No. 542 paving West Olive Street, 10th to 11th Avenue and Special Improvement District No. 543 paving Villard, North Willson to North Tracy Avenue as prepared by Thomas, Dean & Hoskins, Inc., consulting engineers was place before the Commission. In concurrence with the consulting engineers, the City Manager recommended that the plans and speci- I fications as presented be approved and that a call for construction bids and sale of bonds for SID No. 535 in the maximum amount of $80,OOO.OQ for SID No. 536 in the maximum amount of $62,000.00, for SID No. 537 in the maximum amount of $96,000.00, for SID No. 538 in the maximum amount of $184,000.00, for SID No. 542 in the maximum amount of $13,000.00 and fot SID No. 543 in the maximum amount of $23,000.00 be authorized. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the plans and speci- fications be approved and the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of Special Improvement District No's. 530, 535, 536, 537, 538, 542 -. 121 and 543 with an opening date of 5 June 1974 and to advertise for bids for the sale of bonds in the approximate amount of $80,000.00 for SIn No. 535, $62,000.00 for SID No. 536, $96,000.00 for SID No. 537, $184,000.00 for SID No. 538, $13,000.00 for SID No. 542 and $23,000.00 for SID No. 543 to be received on 12 June 1974. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. I License Bond: Midla~~ Electric Company $5,000.00: In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrical License Bond for Midland Electric Company in the amount of $5,000.00 was presented. The Building Inspector had approved the certificate and the City Attorney had approved the bond as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the above bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Reports The following reports were presented: Cashier Cemetery Director of Public Service Water Collector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor and Mayor Sedivy; those voting No, none. Request - Pleasant Valley High School, Iowa, Appear and perform on 2 June 1974, Enrouse to 74 Expo: It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that a letter be address- ed to Pleasant Valley High School, !GWa, inviting them to present their concert at Bogerts Grove on I Sunday, 2 June 1974, enroute to the 74 Expo at Spokane, Washington. The Motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
