The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 1 May 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commiss-
ioner Vandeventer, Commissioner Taylor, City Manager Fryslie, Ass't City Manager Keyes, City Attorney
Berg and the Clerk.
Commissioner Vandeventer opened t~meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 24 April 1974, were approved as read. I
Absence of Commissioner Lehrkind:
Upon recommendation of the City Manager, it was moved by Commissioner Taylor, seconded by Comm-
issioner Vollmer, that the absence of Commissioner Lehrkind be authorzed in compliance with Section
11-3245, R.C.M., 1947, and the motion was carried by the following Aye and No vote: Those voting Aye
being Commissioner Taylor, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those
voting No, none.
Hearing, Conditional Use Permit - Radio Station, AS District:
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that having held a
public hearing and having passed Ordinance No. 943 amending 23.5 of the Bozeman Area Zoning Code to
provide for Radio and Television Buildings in AS and B-1 Districts on 27 March 1974, the action on
the Conditional Use Permit be removed from the table and presented for final action. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
Following a discussion and in concurrence with the recommendation of the City Manager, it was
moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they approve the conditional
Use Permit to build a radio station on a tract of land in the SE 1/4 of Sec. 34, T2S, R5E, MPM. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Appointment of Bicycle Pathway System Advisory Committee:
Mayor Sedivy announced his appointment of the following to the Bozeman Bicycle Pathway System
Advisory Committee: I

John Chuchel George Mattson John P. Parker
Sussie Haggerty Sara Noel Annie Williams
The Commission concurred in the Mayors appointment and it was moved by Commissioner Taylor, sec-
onded by Commissioner Vollmer, that the above be appointed to the Bozeman Bicycle Pathway System Advisory
Committee. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Vollmer, Vandeventer and Mayor Sedivy; those voting No, none.
Zone Code Interpretation - Asphalt Batching plants in M-I Zone
A letter received from Joseph B. Gary, Attorney at Law, on behalf of the Bozeman Blacktop requesting
the determination by the City Commission as to whether a mobile asphalt mixer is permitted use under
M-l Classification along with a letter suggesting that certain property not zoned as RS-l should be
rezoned to M-l Zone was presented.
Bob Planap of Landoe and Gary Law Firm was present to discuss the Zone Code Interpretation and
answer questions in regard to the request of Bozeman Blacktop.
Following a thorough discussion, the City Manager recommended that the Commission accept the advise
of the City Attorney concerning interpretations of the existing Zoning Code in that M-l is limited to
light manufacturing and Asphalt Plants would not be permitted within any zone within the City of Bozeman
except M-2 Zone. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor that they
accpt the City Attorneys opinion of the Zoning Code. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Vollmer and
Mayor Sedivy; those voting No, none.
Proclamations: "Safety Awareness Days"6-18 May 1974 "National Radio Month"- May 1974 I
Mayor Sedivy proclaimed 6-18 Mayas "Safety Awareness Days" and urged the citizens of Bozeman to
become involved, participate and support activities during Safety Awareness Days and all year long.
It was moved by Commissioner Taylor, seconded by Commissioner Vollmer. that they concur in the Mayors
proclamation as requested and the motion was carried by the following Aye and No vote: those va ting Aye
being Commissioner Taylor, Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting
No. none.
Mayor Sedivy proclaimed the month of Mayas "National Radio Month" and called upon all people to

note the record of achievements of the radio broadcasting industry, its personnel and the theme Radio
Free U.S.A. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they
concur in the Mayors proclamation as requested and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor,
and Mayor Sedivy; those voting No, none.
License Bonds: Capitol Neon, Inc., Sign - $2,000.00; Forrest L. Zion. House Moving - $2,000.00;
I. Century Mechanical,- Plumber - $5,000.00:
In compliance with Chapter 14 and 16 of the Bozeman MunicipalCode, the License Bonds of Capitol
Neon, Inc., in the amount of $2,000.00, Forrest L. Zion House Moving in the amount of $2,000.00 and
Century Mechanical Plumbing License in the amount of $5,000.00 was presented. The Building Inspector
had approved the certificates and the City Attorney approved the bonds as to form. It was moved by
Commissioner Vandeventer. seconded by Commissioner Taylor, that the above bonds be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Requests for Zone Code Amendments - Lee Ambulance Service; Grace Baptist Church Bldg., Joseph P. Sabol:
Letters received from Dean A. Hofman, owner of Lee Ambulance Service, requesting the listing of
ambulance services as a permited use in R-4 Zones; from Grace Baptist Church Building Committee that
churches be included as a permitted use in B-3 zones; and from Joseph W. Sabol that provisions be made
for relocating oIder homes in R-3, R-4 and R-5 zones within the City of Bozeman was presented.
Following considerable discussion, it was moved by Commissioner Taylor, seconded by Commissioner
Vollmer, that the above requested amendments to the City of Bozeman Zoning Code be referred to the
Zoning Commission for study, public hearing and recommendation to the Commission. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Helen Johnson - Private Road to Serve Condominium, 2020 South Rouse Avenue:
A letter received from Helen Johnson, President of Aspen Incorporated requesting the approval
for establishment of a twenty-five foot wide private street to serve the condominium development at
I 2020 South Rouse Avenue was presented. It was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that they approve the request on behalf of Aspen Inc., to construct a twenty-five foot
wide private street to serve a portion of the condominium development with the assurance that the cond-
ominium association provide offstreet parking and not permit parking on the private street. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
Ad journment:
There being no further bHsiness to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Taylor and Mayor Sedivy;
