HomeMy WebLinkAbout1974-04-17 102 Bozeman, Montana 17 April 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Build ing, 17 April 1974, at 1:15 o'clock p.m. Present were mayor Sedivy, Commissioner Vollmer, Comm- issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Asa't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. I Minutes of the regular meeting held on Wednesday, 10 April 1974, were approved as read. Proclamation Child Youth Month - American Legion Auxiliary: Mayor Sedivy proclaimed the month of April as "Child Youth Month" in accordance with the American Legion and American Legion Auxiliary. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they endorse the Mayors proclamation as requested and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Commissioner Lehrkind; those voting No, none. North Seventh Avenue on Street Parking: The petition protesting the removal of parking on both sides of North Seventh Avenue having been taken under advisement for a period of one week was again presented. Following a discussion, the City Manager recommended that the Commission not rescind Commission Resolution No. 1661 and leave it in full force and effect, asking the State Highway Department to re- move the parking on both sides of North Seventh Avenue from Beall Street north to the City Limits. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they concur in the City Managers recommendation as presented: those voting Aye being Commissioner Vollmer and Mayor Sedivy; those voting No, being Commissioner Vandeventer, COmmissioner Taylor and Commissioner Lehrkind. The motion was lost. Hearing - Request to Change Zoning ASto B-2, R. R. Nelson, Land E 1/2, NE 1/4, Sec. 16 , T2S, R5E , MPM This was the time and place set for a public hearing to consider a recommendation from the Zoning Commission regarding a request to rezone the north 500 feet of that land lying north of the Farmers Canal in the E 1/2, NE 1/4, Sec. 16, T2S, R5E, MPM., Gallatin County Montana and belong to R. R. Nel- I son, from AS to B-2 Zone. The Zoning Commission recommended to the City Commission that they deny the request since the Bozeman Master Plan does not provide for strip commercial development along Hiway 191 and that one of the recommendations of the Citizens Advisory Committee was to prohibit strip commercial develop- ment along access roads to the City of Bozeman. The City Manager concurred in the recommendation of the Bozeman Zoning Commission and recommended that the Commission deny the request for the Zone Change. It was moved by Commissioner Taylor, sec- onded by Commissioner Lehrkind, that they deny the request to change the zoning from AS to B-2 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those vo ting No, none. Hearing - Request to Change Zoning RS to M-l, Corcoran-Spain; Land in Section 6, T2S, R6E, MPM. This was the time and place set for a public hearing to consider a recommendation from the Zon- ing Commission to rezone a tract of land belonging to Corcoran-Spain in Section 6 T2S, R6E; MPM., Gallatin County, Montana from MS-l to M-l. The Zoning Commission recommended that since the present building on the above described property is bisected by the City Limit line and part outside the City Limit line is zoned RS-l and the area inside the City Limit Line is zoned M-l it should all be in one zone. Mr. Spain was present in regard to the area in question. The City Manager concurred in the recommendation of the Bozeman City Zoning Commission and re- commended that the City CommiSsion act favorably on the request for the zone change. I t was moved I by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they approve the change from RS-l to M-l and the motion was carried by the following Aye and No vote: those voting Aye being Commission- er Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Hearing, Request to Change Zoning, AS to B-2, Frank Trunk, Jr., Land in W 1/2, NW 1/4, Sec. 16, T2S, RSE , MPM. This was the time and place set for a public hearing to consider the application of Frank Trunk, Jr. , to rezone the north 400 feet of the W 1/2, NW 1/4. S16, T2S, R5E, MPM., Gallatin County, Montana, from AS to B-2 Zone. 103 The Bozeman Zoning Commission having reviewed the request recommended to the City Commission that they deny the request 8S the Bozeman Master Plan does not provide for strip commercial development along Highway 191 and that one of the recommendations of the Citizens advisory Committee was to pro- hibit strip commercial development along access roads to the City of Bozeman. Mr. Trunk was present to discuss the area in question. Following a discussion. the Commission concurred in the recommendation of the Bozeman City Zoning Commission and recommended that the Commission deny the request for the Zone Change. It was moved by I Commissioner Vollmer. seconded by Commissioner Vandeventer. that they deny the request to change the Zone from AS to B-2 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer. Commissioner Lehrkind. and Mayor Sedivy. Commissioner Taylor abstained. Conditional Use Permit Application -- Egbert-Simkins: 300' X 123' SE 1/4. SEC 31. TIS, R6E, MPM.: This was the time and place set for public hearing to consider a recommendation from the Zoning Commission to issue a conditional use permit on 300' X 123' tract of land in the SE 1/4. SW 1/4, of Section 1, TIS, R6E, MPM.. Gallatin County. Montana. The conditional use permit would permit indus- trial development on the above described land. The Zoning Commission having reviewed the request of Everett Egbert and Robert Simkins to issue a conditional use permit recommended it be granted with the following recommendation: 1. That front yards of 25 feet are provided on all proposed sites. 20' rear yards are provided for those lots adjoining the mobile home park tothe east. 2. That suitable buffering. a maximum of 6' in height is provided for the east- ern boundary of the property. Off-street parking spaces are provided as re- quired by the zoning ordinance in relation to the size of the specific industrial building. It is assumed here that all other requirements of the zoning ordinance will be met. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that they concur in the recommendation of the City Manager and approve the conditional use permit with the above recommend- ation. Commissioner Vollmer and Mayor Sedivy; those voting No, none. I Hearing. Resolution No. 1656. SILD No. 539 - South Grand. South Third & Lincoln Rd. Resolution No. 1667. Creating SILD No. 539: This was the time and place set in Commission Resolution No. 1656 to hear protests to the creation of Special Improvement Lighting District No. 539. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. There were no protests on file and no one appeared to protest verbally. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind. that Commission Resolution No. 1667 creating Special Improve- ment Lighting District No. 539. entitled: COMMISSION RESOLUTION NO. 1667 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA. CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT LIGHTING DISTRICT NO. 539 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT soum GRAND AVENUE BETWEEN LINCOLN STREET AND SOUTH THIRD AVE- NUE, SOUTH THIRD AVENUE BETWEEN LINCOLN STREET AND THE C.M.St. p. & P. Creating a Parking Commission for Central Business District: A petition signed by owners or businessmen of the Central Business District of the City of Bozeman I petitioning the City Commission to create a parking commission for the central business district was presented. Following a discussion, the City Manager recommended that the City Commission instruct the City Attorney to draw up the necessary resolution. it being in the best public interest to have a parking commission. The Parking Commission would be substantially advisory in nature with the final decision for matters of substance resting with the City Commission. Request for Utility and Paving SID's - Graf's Third Addition: A letter received from Eugene Graf, Jr., petitioning the City of Bozeman to create special im- provement districts for the installation of paving on Henderson and Arnold Street and Colter Avenue in Graf's Third Addition and for the installation of sanitary sewer and water lines in the balance of Graf's Third Addition.was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commiss- ioner Taylor, seconded by Commissioner Lehrkind, that they instruct the City Attorney to draw up the resolution of intention to create the special improvement district when he receives the necessary estimates from the City Engineer. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Authority to Sell Buddy Poppies, 18 May 1974, VPW Auxiliary: A letter received from Frances Oliver, President of the V.F.W. Auxiliary No. 903 requesting per- mission for the members of Major Drennan Auxiliary to sell Buddy Poppies on Saturday, 18 May 1974 was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that permission to conduct the fund drive on 18 May 1974 be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vande- I venter, Commissioner Taylor and Mayor Sedivy; those voting No, none. Proposal for Bicycle Pathways System for Bozeman: Several interested persons were present in connection with establishing a Bicycle Pathways System for Bozeman and to present a petition signed by one-thousand people who are interested therein. Following an extensive discussion, the Commission concured with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they acknowledge receipt of the petition and ask the group to appear before the Commission in a week or two to see what we have found out in an effort to assemble the plan. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none 105 Ordinance No. 944 - 'Going Out of Business Sale.~ ORDINANCE NO. 944 AN ORDINANCE REGULATING GOING -OUT-OF-BUSlNESS SALES, DEFINING THE SAME, PROVIDING FOR THE LICENSING THEREOF, AND PENALTIES FOR VIOLATION THEREOF. as prepared by the City Attorney as directed by the City Manager for the purpose of regulating I 'Going Out of Business Sales' in the City of Bozeman was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that Ordinance No. 944 regulating 'Going Out of Busi- ness Sales' be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Proclamation - Campbell, Board of Realtors: Mayor Sedivy announced his proclamation of 21-27 April 1974 as "Realtor Week" and urged all fellow citizens to join with the Bozeman Association of Realtors in its observance. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the proclamation as requested by the realtors be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Application for Beer License - Freeway Inn: The City Manager presented the application and the appropriate fee for a 1974 Beer License for the Freeway Inn and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the application be approved and the Director of Finance be instructed to issue the license and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Application for EPA Grant - Step 1 Facility Plan and T. V. Inspection $21,000.00 Waste Water Treatment Application No. 5700-12 (Revised 9-72) for Federal Assistance for the Waste Water TreatmentPlant. I I Plant Expansion under the Environmental Protection Agency in preparing and carrying out plans of No. 66.015 Wastewater Treatment Works Construction Grnat - Step I and T.V. Inspection in the amount of $21,000.00 was presented. The total cost of the project is $1,500,000 and $21,000.00 is the En- fironmental Protection Agency's Share requested for this budget period. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they concur in the recommendation of the City Manager and approve Application No. 5700-12 for the Wastewater Treatment Works Construction Grant in the amount of $21,000.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vande- venter, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Municipal Band Director 1974 - Gordon Wickham: A letter received from Ralph C. Challender, Secretary-Treasurer of the Bozeman Municipal Band, stating the City Municipal Band Board of Directors selected Gordon Wickham as the Director of the Band for the 1974 season, the term covering a period of one year and ending I April 1974. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Commission concur in the selection of Gordon Wickham as Band Director and that they also approve the concert schedule when it is set. Reports The following reports were presented: Cemetery Water Collector Chief of Police The City Manager commented on the reports and recommended approval thereof. Contract Documents The contract documents for the installation of the sprinkler irrigation system at the Bozeman Recreation Complex was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner . Vollmer, that the contract documents of Rainmaker, Inc., Billings, in the amount of $29,700.00 be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City and that Rainmaker, Inc., be authorized and directed to proceed with the installation of the Sprinkler 10G irrigation system at the Bozeman Recreation Complex. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Van- deventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Examination of Depository Securities In Compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission proceeded to examine the receipts of Depository Bonds and Securities held by the Director of Finance as security for City funds deposited in Bozeman Banks.
