The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 3 April 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm-
issioner Vandeventer~ Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had.
I Minutes of the regular meeting held on Wednesday, 27 March 1974, were approved as read.
Consideration of Bids - Fencing Material
The engineering staff having completed their study of the bids submitted for the fencing for the
recreation complex, Bogert Park tennis courts and various school sites throughout the City and having
prepared a final tabulation of the bids recommended that the bid be awarded to Quality Wholesale,
Bozeman, on the basis of the low bid in the amount of $16,026.03 it meeting or exceeding the speci-
fication in the "Call for Bids."
The City Manager concurred in the recommendation of consulting engineers Morrison Maier1e and
the City engineering staff and recommended the bid be awarded to Quality Wholesale of Bozeman on the
basis of their low bid in the amount of $16,026.03. It was moved by Commissioner Vollmer, seconded
by Commissioner Vandeventer, that the bid be awarded to Quality Wholesale and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vande-
venter, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
Sale of Bonds, SIn No. 534 - $52,000.00
The City Manager stated that according to the affidavit of publication this was the time and
place set for the bond sale of Special Improvement District No. 534 for the construction of watermains
on Oak Street, Hemlock Street and North Fifth Avenue in the amount of $52,000.00. The affidavit of
Notice of Sale was presented, examine4 approved and ordered filed.
The Mayor and City Manager outlined the proceedure for conducting this bond sale and stated that
the amount of bonds to be sold would'be the same as the advertised amount and announced the City was
ready to conduct the bidding on the bonds in the amount of $52,000.00 for SID No. 534
I The Clerk of the Commission opened a sealed bid received from D. A. Davidson for the purchase
of the bonds with an interest rate of 7.0% plus $7.00.
It was then announced that oral bids for the purchase of the bonds in accordance with the Notice
of Sale would be received. The following bidders having presented good faith checks as prescribed
by the Notice of Sale then submitted oral bids and the final and best bid submitted by each of said
bidders was as follows:

Following the recommendation of the City Manager., it was moved by Commissioner Vandeventer,
seconded by Commissioner Taylor, that the bid of Arnold Benson, Dillon in the amount of 6.20% it being
the lowest and best bid submitted, the sale of the bonds be awarded to Arnold Benson and the Bid
security of the unsuccessful bidders be returned and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind,
Commissioner Vollmer and Mayor Sedivy, those voting No, none.
Open Bids - Landfill Building
This was the time and place set for opening bids for the construction of a combination equipment
storage building and maintenance shop located at the City of Bozeman Landfill. Affidavit of publi-
cation of "Notice to Bidders" was presented. It was moved by Commissioner Taylor, seconded by Comm-
issioner Lehrkind, that the bids filed with the Clerk of Commission be opened and read and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commiss-
I ioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
The following bids were then opened and read.

It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the

recommendation of the City Manager, that the bids be referred to the Ass't. City Manager for Tabul-
ation, study and recommendation to be made to the Commission at their next meeting on Wednesday, 10
April 1974. The motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy;
those voting No, none.
Hearing, Resolution No. 1655 - Intent to Annex Gas-a-Mat: Resolution No. 1658 - Annexing Gas-A-Mat
During the regular session of the City Commission held on 27 February 1974, the Commission re- I
gularly passed and adopted Commission Resolution No. 1655 declaring its intention to extend the
boundaries of the City of Bozeman so as to include a tract of land contiguous to the City of Bozeman
and containing 0.96 acres to be known and designated as the Gas-A-Mat Annexation.
This being the date for public hearing as set forth in said Commission Resolution No. 1655,
affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners
had been notified was presented.
A letter received from the Pat Griffin Company, Fort Collins, Colorado, protesting the annexation
of the above tract of land was presented. The City Attorney having thoroughly checked the area in
question found that the property was completely surrounded by property that was already annexed and
therefore recommended that the tract of land contiguous to the City of Bozeman and containing 0.96
acres known and designated as the Gas-A-Mat be annexed.
In concurrence with the recommendation of the City Attorney also concurred in by the City Manager,
it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution
No. 1658 to accomplish the requested extension of the City Limits and complete the action as pre-
pared by the City Attorney was presented, entitled:

ARIES OF THE SAID CITY OF BOZEMAN, MONTANA, SO AS TO EMBRACE AND INCLUDE A
CERTAIN TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN
MORE PARTICULARLY DESCRIBED, WITHIN THE CORPORATE LIMITS THEREOF.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrking and Mayor Sedivy; those voting I
No, none.
Consideration of Bids Parking Meters
The Commission was referred to the opening of bids for the purchase of 250 manual single head
parking meters.
The Asslt. City Manager and the Parking Meter Superintendent having tabulated and completed their
study of the bids submitted recommended that the bids of Rockwell International, Pittsburgh, Pa., be
rejected as their bid failed to meet the specifications of the City and that the bid of Traffic App-
liance Corporation, Los Angeles, California, in the amount of $14,500.00 be accepted on the basis of
their bid meeting or exceeding the specifications in the "Call for Bids."
In concurrence with the recommendation of the Asslt. City Manager, also concurred in by the City
Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the bid for
the purchase of the Parking Meters be awarded to Traffic Appliance Corporation, Los Angeles, on the
basis of their bid in the amount of $14,500.00 meeting or exceeding the specifications in the "Call
for Bids" and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No, none.
Commission Resolution No. 1661 - Authorizing and establishing City of Bozeman Local Gov't. Study COmm.
The City Manager presented Commission Resolution No. 1661 authorizing and establishing the City
of Bozeman for the purpose of a Local Government Study Commission. The Study Commission shall have
the power to review the structure and power of each unit of local government represented on the study
commission and shall submit one alternative form of government to the qualified electors. The study I
Commission shall consist of five members to be nominated and elected as provided in Section 16-5107,
R.C.M., 1947.
COMMISSION RESOLUTION NO. 1661
A RESOLUTION ESTABLISHING THE CITY OF BOZEMAN, MONTANA LOCAL GOVERNMENT
STUDY COMMISSION.
Following a discussion and in concurrence with the recommendation of the City Manager, it was
moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that Commission Resolution No. 1661
authorizing and establishing City of Bozeman Local Government Study Commission as adopted by the 43rd

legislative assembly be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Van-
deventer and Mayor Sedivy; those voting No, none.
Preliminary Plans - New Fire Substation by George Mattson, Architect
~. George Mattson, Architect for the proposed new fire substation appeared before the Commiss-
ion to present the preliminary plans of the architectural design of the substation. It was moved
I by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the City Managers
recommendation to accept the preliminary plans and direct the architect to proceed with the final
plans and specifications and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor,
and Mayor Sedivy; those voting No, none.
Preliminary Plans - Recreation Complex Building by McLaughlin & Kommers, Architects
Mr. Don McLaughlin of McLaughlin and Kommers was present to present the preliminary plans for
the design and construction of the Recreation Complex Building to the Commission.
Following his presentation, it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that they concur in the City Managers recommendation and accept the preliminary plans
as presented and instruct McLaughlin and Kommers to proceed with the final plans and specifications
for the design and construction of the Recreation Complex Building and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer,
Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
Humane Society of the Gallatin Valley - Proposal for Animal Shelter
A letter received from Neal Nixon, President of the Gallatin Valley Humane Society, Inc., re-
questing that the City of Bozeman provide approximately one acre of land owned by the City and located
on North Rouse Avenue to the Humane Society of the Gallatin Valley at little or no cost on a long
term basis for the construction of an animal shelter was presented.
Following a discussion and in concurrence with the recommendation of the City Manager, it was
I moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Gallatin Valley Humane
Society be given authority to secure use of approximately one acre of City property located north
of the City and formerly a portion of the Sanitary Landfill, and that they contact the Building
Inspector for the purpose of properly requesting an interpretation of the Bozeman Zoning Code to in-
sure that such a use is permitted and if not, conditional use permits or amendments be pursued. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
The Gallatin Valley Humane Society, Inc., wer commended upon the considerable and productive
effort put forth in procuring a Humane Society Animal shelter.

Acceptance of Street Right of Way Kagy Boulevard, Eleventh Ave and Lincoln Road
A Right of Way Deed whereby the State of Montana granted unto the City of Bozeman a Tract of I
land located in the North Half of Section 13, T2S, R5E, MPM., Gallatin County, a perpetual street
Right-of-Way and Utility Easement and adjacent perpetual Utility Easement.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Street
Right of Way deed be accepted and filed for record with the County Clerk and Recorder of Gallatin
County and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor
Sedivy; those voting No, none.
Annexation and Utility Tie on Agreement - 91 Acres N. W. of Bozeman
An annexation and Utility Tie On Agreement providing for G-B Properties, Inc., American Simm-
ental Association and Kilgore Cattle Company to connect buildings erected and to be erected upon the
premises hereinafter described to the sanitary sewer system of the City of Bozeman at their own
expense and waiving protest to future water main special improvement districts on property located
northwest of Bozeman and containing approximately 91.267 acres was presented.
Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor,
that the Annexation and Utility Tie on Agreements for permission to connect buildings erected upon
the premises be approved waiving protest to future watermain special improvement districts which may
be created to provide adequate supply of water and fire protection to their property. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm-
issioner Taylor, Commissioner Vollmer, Commissioner Lehrkind and Mayor Sedivy; those voting No, none
Request for Rezoning - 91 Acres AS to M-1, North and West of Bozeman.
A letter received from American Simmental Association, G-B Properties and Kilgore Cattle Company, I
Inc., owners of land lying north and west of the City of Bozeman and containing approximately 91
~ acres of land requesting a zone change from AS to M-l was presented.
Following a discussion, the Commission concurred in the recommendation of the City Manager and
it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they acknowledge re-
ceipt of the request and refer the same to the Bozeman Zoning Commission for consideration and recom-
mendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those
voting No, none.
Request to Display Banner - Kidney Treatment Fund Drive & Proclamation
A letter received from the Montana State University Spurs and Fangs requesting permission to
place a banner across Main Street for the purpose of advertising a fund drive for "Kidney Day" was
presented.
The Commission concurred in the recommendation of the City Manager and it was moved by Commiss-
ioner Lehrkind, seconded by Commissioner Vollmer, that their request to place the banner across Main
Street be approved contingent upon having permission from the owners of the buildings to which the
sign is attached, the permit fee to be waived contingent upon meeting the requirements of the Bozeman
Sign Code with the understanding that the sign be removed on Wednesday, 25 April and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
In accordance with the Montana State University Fangs and Spurs, Mayor Sedivy proclaimed Sunday,
21 April 1974, as "Kidney Day" and called upon all Citizens of Bozeman to take an active part in I
"Kidney Day" and help other Montanans who are not so fortunate. It was moved by Commissioner Vollmer,
seconded by Commissioner Vandeventer, that they endorse the Mayors Proclamation and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
Change Order No. 1 - SID No. 526, Water Main - Figgins & Grafs Third Addition
The Change Order No. 1 on SID No. 526 prepared by Thomas, Dean and Hoskins, Inc., to become a
part of the original contract for construction of improvements in the project described was presented
as follows:

Description: Three fire hydrants along South Third Avenue at stations 3+25.
5+90 and 12+80 requires extensions along with the auxiliary
valve boxes. The required extensions are 2.5 feet. one foot
and one foot respectively.
Cost: The cost is proposed as lump sum by the contractor for a total
of 4.5 feet of hydrant and valve box extensions - - $374.63
The City Manager concurred with the consulting engineers and recommended that Change Order
I No. 1 be accepted and approved as presented. It was moved by Commissioner Vandeventer. seconded by
Commissioner Taylor. that the Change Order No. 1 be approved and the Mayor and Clerk of the Commiss-
ion be authorized and directed to sign for the City of Bozeman and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Taylor.
Commissioner Lehrkind. Commissioner Vollmer and Mayor Sedivy; those voting No. none.
Reports- Building Inspector
The City Manager commented on the report of the Building Inspector and recommended approval
thereof. It was moved by Commissioner Taylor. seconded by Commissioner Lehrkind. that the report of
the Building Inspector be approved and ordered filed and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Taylor. Commissioner Lehrkind. Commissioner Vande-
venter. Commissioner Vollmer and Mayor Sedivy; those voting No. none.

There being no further business to come before the Commission at this time. it was moved by
Commissioner Lehrkind. seconded by Commissioner Vollmer. that the meeting be adjourned and the motion
