HomeMy WebLinkAbout1974-03-27 gO Bozeman, Montana 27 March 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Buildin, 27 March 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm- issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Ass't.City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday. 20 March 1974 were approved as read. I Consideration of Bids SID No. 534 - Watermain, Oak, Hemlock and Fifth Avenue The engineers representing consultants Thomas. Dean and Hoskins, Inc., and the City Engineer having completed their study of the bids submitted for the construction of watermains on Oak Street and Fifth Avenue, SID No. 534 and having prepared a final tabulation of the bids recommended that the bid be awarded to Johnston Excavating, Bozeman, on the basis of the low bid in the amount of $33.484.55. The Commission concurred with the recommendation of the engineers. also concurred in by the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Johnston Excavating, Bozeman, be awarded the bid on the basis of his low bid in the amount of $33,484.55 con- tingent upon the successful sale of the bonds to be held on Wednesday, 3 April 1974. and tha t the bid security of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Consideration of Bids, Recreation Complex Sprinkling System The Commission was referred to the opening of bids for the installation of the sprinkler irriga- tion system at the Bozeman Recreation Complex. The consulting engineers and the City engineering staff having tabulated and completed their study of the bids submitted for the installation of the sprinkler irrigation system at the Bozeman Recreation Complex recommended that the bid be awarded to Rainmaker. Inc.. Billings, on the basis of their low bid in the amount of $29.700.00 it meeting or exceeding the specifications in the "Call for Bids." The Commission concurred in the recommendation of the engineering staff also concurred in by the City Manager and it was moved by Commissioner Vandeventer. seconded by Commissioner Taylor. that Rain- I maker, Inc., Billings, be awarded the bid for the installation of the sprinkler system in the amount of $29,700.00 on the basis of their low bid and the bid bonds of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Open Bids Fencing Material This was the time and place set for opening bids for fencing the recreation complex. Bogert Park tennis courts and various school sites throughout the City. It was moved by Commissioner Taylor. se- conded by Commissioner Lehrkind, that the bids filed with the Clerk of the Commission be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy; those voting No, none The following bids were then opened and read: Kober Construction Company. Bozeman $17.814.45 Mt. States Fence Company, Salt Lake City 18.610.80 Pacific Hide & Fur. Bozeman 16,909.37 Quality Wholesale, Bozeman 16.026.03 It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that they concur in the recommendation of the City Manager, that the bids be referred to the engineering staff for tabulation study and recommendation to be made to the Commission at their next meeting on Wednesday. 3 April 1974 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor and Mayor Sedivy; those I voting No, none. Open Bids Parking Meters This was the time and place set for opening bids for the purchase of "250 parking meters. Affi- davi t of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer. that the bids filed with the Clerk of the Commission be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commiss. ioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. 91 The following bids were then opened and read: Rockwell International, Pittsburgh, Pa. $13,022.50 Traffic Appliance Corporation, Los Angeles, Ca. 14,500.00 The Commission concurred with the recommendation of the City Manager and it was moved by Commiss~ ioner Vandeventer, seconded by Commissioner Taylor, that the bids be referred to the staff for tabu- lation, study and recommendation to be made to the Commission on Wednesday, 3 April 1974 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- I issioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Chamber of Commerce Recommendation - Traffic Control in Construction Areas A letter received from Wes Bressler, Director of Road and Highways Committee of the Chamber of Commerce in regard to working toward improving driving conditions and traffic circulation in Bozeman was presented. One area of concern has been lack of consideration for the driver in the vicinity of construction and maintenance operations within the traveled area. Mr. Bressler along with several other members from the Bozeman Chamber of Commerce Roads and Highways Committee were present to discuss the program and answer any questions that might arise. Following an extensive discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they acknow- ledge the request with gratitude and refer the material to the City Engineering Department for study and a recommendation to be brought before the Commission within a thirty day period. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Mr. Kenneth Baldwin - "ACTION" The Field of City and County Government Kenneth Baldwin appeared before the Commission to present "ACTION" program. He explained that it was connected with City and County Government and should be considered on a three county basis. Following a discussion and in concurrence with the recommendation of the City Manager it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they thank Mr. Baldwin for appearing to present the proposed program and that they acknowledge receipt thereof. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner I Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Mr. Baldwin also mentioned the desire of Senior Citizens to establish garden plots in this area. Ordinance Proposal - License Bonds, Building Contractors It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the City Manager instruct the City Attorney to draw up an ordinance proposal whereby Building Contractors would be re- quired to purchase a Building Contractor License Bond in the amount of $10,000 or $20,000 dependent upon requirements to qualify for the bonds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commiss- ioner Lehrkind and Mayor Sedivy; those voting No, none. Ordinance Proposal - Going out of Business Sales A proposal for an Ordinance which would make certain that a Going Out of Business Sale would re- sult in going out of Business was discussed and taken under advisement by the City Commission. A bus~ iness seeking a going out of business sale must apply for a thirty day license which could be renewed for no more than two additional thirty day periods. It was moved by Commissioner Vandeventer, se- conded by Commissioner Taylor, that the City Attorney be instructed to draw up an ordinance to be presented to the Commission for action at the earliest practical date. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Ordinance No. 943 - Amend Zoning Code (Radio Stations) Ordinance No. 943 amending Section 23.5 of the Bozeman Area Zoning Code as prepared by the City Attorney was presented, entitled: I ORDINANCE NO. 943 AN ORDINANCE AMENDING SECTION 23.5 OF THE BOZEMAN AREA ZONING CODE TO PROVIDE FOR RADIO AND TELEVISION BUILDINGS IN A-S (AGRICULTURE DISTRICT) AND B-~ (CENTRAL BUS lNESS DISTRICT) AND PROVIDING FOR AN EFFECTIVE DATE. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that Ordinance No. 943 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. , Commission Resolution No. 1656, Intent to Create SILD No. 539 - Hearing 17 April 1974 92 COMMISSION RESOLUTION NO. 1656 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID CITY COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 539 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT SOUTH GRAND AVENUE BETWEEN LINCOLN STREET AND SOUTH THIRD AVENUE, SOUTH THIRD AVENUE BETWEEN LINCOLN STREET AND THE C.M. St. P & P. RAILROAD RIGHT-OF~WAY, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA I POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMANCE WITH SECTIONS 11-2245 to 11-2257, INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Lehrkind, seconded by Commissioner Vollmer, that Commiss- ion Resolution No. 1656 be passed and adopted and Wednesday, 17 April 1974, be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Commission Resolution No. 1657, Request Department of Highways to Ban Parking on No. Seventh Avenue Commission Resolution No. 1657 requesting that the Montana Highway Department eliminate and prohibit parking on North Seventh Avenue from West Main Street to North City Limits of the City of Bozeman was presented, entitled COMMISSION RESOLUTION NO. 1657 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, RECOMMENDING THE ELIMINATION OF MOTOR VEHICLE PARKING ON NORTH SEVENTH AVENm; :j:N THE CITY OF BOZEMAN, MONTANA. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1657 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Request for Sign Code Variance - 3 South Tracy Avenue Businesses A letter received from Mr. Mack's Beauty College, The Emporium Shirt Works and Trophy and En- I graving Specialties requesting a variance to the sign code was presented. The three signs installed are all metal signs bolted to the brick wall located at 3 South Tracy Avenue but are not the regula- tion 10' above the sidewalk. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor that since the signs are posted securely and do not protrude into the street the sign code variance be granted and the motion was carried by the following Aye and No vote: those voting Ay_ being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Reports The following reports were presented: Cemetery Chief of Police Librarian Water Collector The City Manager commented on the reports and recommended approval thereof. I t was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commiss- ioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor No, none.
