The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 13 March 1974, at 1:15 o'clock p.m. Present were ~1ayor Sedivy, rommissioner Vollmer, rom-
I missioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Assistant
City Manager Keyes, City Attorney Berg and the rlerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held on Hednesday, 13 March 1974 were approved as corrected.

The Commission was referred to the opening of bids for the reconstruction of the Bogert Muni-
cipal Swimming Pool and the ad,1oining Bath House and the installation of new mechanical equipment
together with design and engineering of the project.
The City Engineer, the Park Superintendent and the Park Recreation Director having completed
their study of the bids submitted for Contract No.1, construction of the swimming pool shell,
equipment and filter tank, found that the low bid of B & H Pools, Helena, Montana, in the amount of
$79,450.00 and the low bid of Westgate, Inc., Bismark, N. D. in the amount of $106,000.00 failed
in many respects to meet with the "Call for Bids" and since Alpha Vlestern Pools, Bellingham, Hash-
ington, did not have their Montana License at the time of the bid onening their bid in the amount
of $104,663.00 would be considered invalid and therefore they recommended that the bid be awarded
to Intermountain Specialty of Salt Lake City, lJtah, in the amount of $113,869.00 it being the only
I bid submitted that equalled or exceeded the specifications in every resnect with the "Call for
Bids."
The City }1anager concurred in the recommendation of the City Engineer and other staff members
and recommended they reject the bids of B & Vl Pools, Helena, ~10ntana, Alpha Western Pools, Bellingham,
Washington and Westgate, Inc., Bismark, N. D. on the basis as stated above and that Intermountain
Specialty of Salt Lake City, Utah be awarded the bid in the amount of $113,869.00 on the basis of
their bid equalling or exceeding the specifications contingent upon the completion and closing in
connection with the $900,000.00 General Obligation Bonds. It .ras moved by Commissioner Vandeventer,
seconded by Commissioner Taylor, that they aMard the bid to Intermountain Specialty of Salt Lake
City, Utah on the basis of their bid in the amount of $113,869.00, it being or exceeding the specifica-
tions in the call for bids as stated above contingent upon the completion and closing in connection with
the $900,000 General Obligation Bonds and B.O.1:t. approval and the bid bonds- of the unsuccessful bidders
be returned and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and
Mayor Sedivy; those voting No, none.
The City Engineer, the Park Superintendent and the Park Recreation Director having completed

Building recommended that the bid be awarded to Bruce-Anderson, Bozeman, on the basis of their low
bid in the amount of $75,190.00 including Alternate No.1 in the amount of t,3,612.00 for a total
of $78,802.00 it meeting or exceeding the specifications in the "Call for Bids."
The Commission concurred in the recommendation of the engineering staff also concurred in by
the City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that
Bruce-Anderson, Bozeman, be awarded the bid for Contract No. 2 for the construction of Bogerts

Grove Pool building on the basis of their lo~r bid including Alternate No.1 in the total amount of
$78,802.00 contingent upon the completion and closing in connection with the $900,000. General Obligation
Bonds and BOR appro:val and the Bid bonds of the unsuccessful bidders be returned and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. I

This was the time and place set for a public hearing to consider the issuance of a Conditional
Use Permit to Pacific Hide and Fur on a portion of Lots 9-12 in Block C of Rouse's Addition to the
City of Bozeman. The Conditjonal Use Permit ~rould permit wholesale and on premises retail sales
in the B-2 Zone.
A letter received from the Bozeman ZoningCoJl1JYlj.ssion 1vhereb:,' the~f favorably recommended the
issuance of a Conditional Use Permit was read by the Ci ty '~anager.
Mr. LeRoy Stevens, Vice President of Pacific Hide and Fur and Mr. R. G. Christensen also of
Pacific Hide and Fur of Great Falls were present to explain the situation and answer any questions
that arose.
Following a discussion and in concurrence with the recommendation of the Cit~r Hanager, j.t was
moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that action on the issuance of
a Conditional Use Permit be tabled for a period of one week for a view of the area in question,
further stUdy and recommendation. The motion was carried by the following ~ye and No vote: those
voting Aye being Commissioner Lehrkind, Commj.ssioner Vollmer, Commissioner Taylor, Commissioner I
Vandeventer, and Hayor Sedivy; those voting No, none.

The Community Recreation Board having completed their review of possible sites for the new
covered fifty meter swimming nool recommended to the City of Bozeman and School District No.7,
that the new swimming pool be located west of and adjacent to the Bozeman Senior High School ~nn.
'!'he City Hanager recommended that the City Commission approve this site at this time to allOlT
for initial discussions to proceed with an inter-local cooperation agreement concerning use of this
site.
Following a discussion, the Commission concurred in the recommendation of the Community Re-
creation Board also concurred in by the City Hanager, and it was moved by Commissioner VOllmer,
seconded by Commissioner Van~eventer, that theJ' approve the site west of and adjacent to the Bozeman
Senior High.School gym for the new covered fifty-meter swimming pool. The motion was carried by
the following Aye and No vote: those voting Aye being Comm.issioner Vollmer, Comm.issioner Vandeventer,
Commissioner Lehrkind, Commissioner Taylor, and Hayor Grabow; those voting No, none.

The City Manager requested authorization to call for sealed bids for the construction of a COnt- I
bination equipment-storage building and maintenance shop to be located at the City of Bozeman Land-
fill with an opening date of 3 April.
It waS moved by Commissioner Vandeventer, seconded by Commissioner ':!laylor, that they authorize
the "Call for Bids" for construction of the buildinp: and maintenance shop for the landfill and the
Clerk of the Commission be directed to issue a !!Call for Bids" to be opened 3 April 1974 and the
motion was carried by the following ^ye and No vote: those voting P~fe being Commissioner Vandeventer,

In compliance with Chapters 14, 15 and 16 of the Bozeman r1unicipal Code, the sign bond of Epcon
I Company in the amount of $2,000.00, the Electricians bond of New Mannix Electr:i.c and the plumbi.ng
and heating bonds of New Budd Plumbing and Heating and Claude "Tilson and Company in the amount of
$5,000 were presented.
The City Manager stated the Building Inspector had recommended approval of the Bonds and the
City Attorney approved the Bonds as to form. It was moved by Commissioner Taylor, seconded by Com-
missioner Lehrkind, that the above bonds be approved and the motion was carried by the following Aye
and No vote: those voting Aye being Comm:i.ssioner Taylor, Commiss:i.oner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those votin/2; No, none.

An easement and right-of-way agreement by and between Anna Fridle;, and the City of Bozeman
for the purpose of installing, operating, using, repairing, replacing, maintaining and removing
a water transmission line thereto upon and across a portion of the El/2, NE1/4, Pection 7, T3S,
R6E, M.P.H., lying within the County of Gallatin, Montana, .Tas presented.
The City Manager recommended that the City enter into the agreement approved as to form by
the City Attorney and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that
the Easement Agreement be entered into by the City of Bozeman and the r~ayor and Clerk of the Com-
I mission be authorized and directed to sign for the City and the motion was carried by the fol10.rinp,

Ma,yor Sedivy proclaimed 16 March 1971~ as "Bozeman Scout Exposition Day!! and encouraged all
ci tizens of Bozeman to give and wholeheartedly support the Bozeman Scout Exposi ti.on to be held at
the Montana State University Field House from 2:00 to 7:30 o'clock p.m. on Saturday, 16 March 1974.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they endorse the
Mayors proclamation and the motion was carried by the following Aye and No vote: those voting l'We
being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor,
