HomeMy WebLinkAbout1974-02-27 74 Bozeman, Hon l~ana 27 Fcoruary 1971.f The Commission of the City of Bozeman met in regular sessi.on in the Commission Room, Municipal Building, 27 February 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Ci ty Manager Fry~lie, Ass' t. City Manager Keyes, City Attorney Berg and the ClerIc Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 20 February 1974, were approved as read. I Petition Lo Consider Cr~il_~:.:1~BParking_ <;:ommission - 75 Persons A petition signed by Seventy property m-lners and interested businessmen on Main Street, Babcock Street or Mendenhall Street between Rouse Avenue and Grand Avenue petitioning the City of Bozeman to create e Special Improvement District for the purpose of acquiring and/or developing off-street parking authority for the same purpose was presented. Following an extensive rliscussion it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they acknowledge receipt of the petition and take the matter under a~vi~ement for a period of one week. They instructed the City Manager to make an appointment with Mr. John Reichel and Mr. Rohert Evans of the dovmtown area to discuss the possibilities of creating a Special Improve- mpnt District for the p\lrpOSe of acquiring and/or developing off-street parking facilities or to create parking authority for the same purpose. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Van- deventer and Mayor Sedivy; those voting No, none. Commission ReSDlution No. 1655 - Intent to Annex Gas-A-Mat Property ~...-----------....... Commission Resolution No. 1655 declaring the City Commissions intention to extend the boundaries of the said City of Bozeman so as to include 0.96 acres of land to be known and designated as the Gas-A-Mat Annexation to the City of Bozeman, entitled: COMMISSION RESOLUTION NO. 1655 A RESOLUTION OF TIm COffi1ISSION OF THE CITY OF BOZE~\N, MONTANA, DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND TIlE INHABITANTS THEREOF AND OT<' THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO TIlE SAID CITY OF BOZEMAN AND HEREIN MORE PARTI- I CULARLY DESCRIllED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEKAN SO AS TO INCLUDE TI-IE SA ID CONTIGUOUS TPJ\CT ~HTIlIN THE CORPORATE LIMITS THEREOF. as prepared by the City Attorney was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the City Managers recommendation, that Commission Resolut- ion No. 1655 be passed and adopted and that 3 April be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commiss- ioner Vollmer, Commissioner Vandeventer, Commissioner Taylor Bnd Mayor Sedivy; those voting No, none. !iea6l'!&L Re.2_olution No. 1649 - Intent to Vacate Alley, Block 2, North Seventh Addition This was the time and place set in Commission Resolution No. 1649 for the hearing of protests to vacating all alleys in Block 2 of North Seventh Addition to the City of Bozeman, }-'[ontana. A f Bd avit of puhlication of Notice and the Clerks certificate stating that all property owners had been noti- fied as required by law were presented. There were no written protests on file and no one appeared to protest verbally. The Commission concurred in the recommendation of the City Manager and it was moved by Commiss- ioner Vollmer, seconded by Commissioner Vandeventer, that Ordinance No. 941 vacating all alleys in Block 2, North Seventh Addition, entitled Ordinance No. 941 ORDINANCE NO. 9l~1 AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THE ALLEYS IN BLOCK TWO OF NORTH SEVENTH ADDITION TO THE CITY OF BOZEMAN, MONTANA. as prepared by, the City Attorney be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner I Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. R(:~st to.Conduct___a Parade, Lions Club - NIRA, 18 June 197{~. A letter received from Everett Cope on hehalf of the Bozeman Lions Club requesting permission to stage the NIRA Parade on 18 June 197!f was presented. The proposed route is north on 19th, east on Main Street and north on Rouse Avenue to the fairgrounds. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor that the request to stage the parade be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Vollmer, Commissioner Lehrkind and Mayor Sedivy; those votin~ No, none. 75 J:1 Authorization to Attend Hazardous Material Seminar, Billings, Montana, 5-8 Nardt 197tf The Seminar on Hazardous Materials is scheduled to be held in Billings, 5-8 March, at the Billings Vocational-Technical Center and the Fire Chief requested authorization for Al Shearman and Lee Lewis to attend the Seminar. The Commission concurred in the recommendation of the City Manager and it was moved by Commission- er Taylor. seconded by Commissioner Lehrkind, that Al Shearman and Lee Lewis be granted authorization I to attend the Seminar and, it being in the public interest their expenses be paid from the General fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Application for Street and Utility Right-of-way MSU Property, Kagy Blvd. Application made under the provisions of Section 81-801 to 81-805 inclusive, of the R.C.M., 1974, and Acts amendatory thereto by and between the City of Bozeman. Montana, and the Montana State Uni- versity, Bozeman, for an easement for a right-of-way and utility easements for tracts of land located in the South 1/2 of Section 13, T2S, Range 5 East, MPM, Gallatin County. Said tracts being 90' wide and 45' on each side of center line and containing 2.460 acres; 60' wide and 30' on each side of center line and containing 1,773 acres and 80' wide and 80' north of a midsection line and contain- ing 4.98 acres was presented. Following a discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the three utility easements be entered into and the Mayor and Clerk of the Commission be authorized and directed to sign for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those votin3 No, none. Request to Display Banner over Main Streets - DECA Club A letter received from Ron Newville. Distributive Education Coordinator Bozeman Senior High School requesting permission to place a DECA Banner across Main Street at Black Avenue on 3 March I 197/+, to be removed on 10 March 197~ was presented. The DECA Club has written permission from the First National Bank and McDonald's Clothing for hanging the banner from their building. The Commission concurred in the recommendation of the City Manager and it was moved by Commiss- ioner Vollmer, seconded by Commissioner Vandeventer, that their request to place a two-sided banner across the Main Street of Bozeman during the week of 3-10 March be approved and the permit fee waived contingent upon meeting the requirements of the Bozeman Sign Code with the understanding that the sign be removed as stated above and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Authority To Call for Bids - SID No. 534. Watermain for K-Mart, Open 20 ~arch Plans and Specifications covering the proposed improvement in Special Improvement District No. 534 for the construction of Watermains on Oak Street, Hemlock Street and Fifth Avenue as prepared by Thomas, Dean & Hoskins, Inc. , consulting engineers was placed before the Commission. The City Manager recommended that the plans and specifications be approved and tha t a "Ca 11 for Construction Bids" and sale of the bonds for SIn No. 534 in the approximate amount of $52,000.00 be authorized. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the plans and speci- fications be approved and the Clerk of the City Commission be authorized and directed to pub1.ish a "Call for Bids" for the construction of Special Improvement District No. 534 with an opening date of 20 March and to advertis~ for the sale of the bonds in the approYirnatr amount of $52,000.00 to be received 3 April 197/1. Mayor's Proclamation: a) Bridger Ski Club Week 4-10 March b) Distributive EduCf~J:..i()D_Ye_et 3-10 tbrch c) Save Your Vision Week 4-10 March Mayor Serliby proclaimed the week of 4-10 March as "Bridger Ski Club" Heek and urged all citi- zens to support the Bridger Ski Club so as to allow the racing pro~ram to continue in an effective and worthwile way. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they endorse the Mayor's proclamation as requested by the Bridger Ski Club and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkin~, Commissioner Vollmer, C:ommissioner Vandeventer and Mayor Sedivy; those votin~ No, n_on0. 76 Mayor Sedivy proclaimed the week of 3-9 March as "Distributive Education t-Jeek" in accordance with the request of the DECA Club of Do~eman Distributive Ed\\cation. It was moved by Commissioner Lehrkind, s('conded by Commissioner Vollmer, that the Mayor's proclamation be endorsed as presented and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commi_ssioner Taylor and Mayor Sedivy; those votinp; N', none. Mayor Sedivy proclaimed the week of 6-10 March 1974 as "Save Your Vision" week and strongly I urged each member of the community to participate in the program and activities designed to place great emphasis on vision care. It vlaS moved by Commissioner Vollmer, seconded by Commissioner Van- deventer, that they endorse the Mayor's proclamation as emphasi~ed annually by the President of the United States and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Va Umer, Commissioner Vandeventer, Commissioner Taylor, Commiss ioner Lehrldnd and Mayor Sedivy; those voting No, none. Reconvened: 2:10 o'clock p.m. !ransfer of Captain Rex :-1. Duncan to Police Reserve Effective I Harch 1974. " ------....-.__._- ^ lettC'r dpj'ed 1L1 February 197/+ from Captain Rex M. Duncan and addressed to the Chief of Police of the Bozeman Police Department requesting that he be passed from the active to the Police Reserve in Accordance with Section 11-1818 R.C.M., 1947. was presented. The Board of Trustees of the Police Reserve Board at their meeting held during the recess re- commended that Captain Duncan's request to be placed on the inactive Police Reserve starting 1 March be approved by the Commission. Mayor Sedivy on behalf of the Commission paid tribute to Captain Duncan for his outstanding EJervi ceEJ awl the courteous manner in which he carried out his work as an officer and his ability to I meet the public. The City Manager concurred in the Mayors tribute, stating the fact that Captain Duncan was willing and capable to work almost entirely on the evening shift was depply appreciaterl. Captain Duncan had the patience of jobb and this alone was very gratifying to everyone and more important the citizens of Bozeman. Chief of Police Robert Johnson stated he appreciated more than ;:\Dyone the capabilities of Captain Duncan. Captain Duncan was always courteous and accepted his responsibilities which made him an outstanding officer in the pdlice department and extended his thanks for a job well done. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that they concur in the recommend- ation of the Board of Trustees of the Police Reserve fund, that Captain dorman be passed from the Active Police to the Inactive Police Reserve effective 1 March 19711 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Grabow; those voting No, none. The Announcement ()f Promotion of Police Officers - Se!}i.eant George Ta te to Captain -~_.., . Officer Ernie Cox to Sergeant The City Manager announced his promotion of Sergeant George Tate to Captain of the Police Dep- artment effective 1 March 1974. The Commission concurred in the City Managers appointment and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the City Manager's app- ointment be concurred in and that Captain Tate be congratulated. The motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Teylor and Mayor Sedivy; those voting No, being Commissioner Vollmer. I The City Manager announced his promotion of Officer Ernie Cox to Sergeant on a temporary basis effective 1 March 1 9 7 l!_ , or until Sergeant Taylor returns to the force. The Commission concurred in the City Manager appointment and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer that the City Managers appointment of Officer Ernie Cox to Sergeant on a temporary basis effective 1 March 1974 be concurred in and that Sergeant Cox be congratulated on his promotion.
