The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 23 January 197!+. at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm-
issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had
I Minutes of the meeting held on Wednesday, 16 January 1974 were approved as corrected.
Authority to Attend Building Officials Short Course, Ass't. Bldg. Inspector Gene Yde - pocatello
4-8 February 1974
The Intermountain Chapter of International Conference of Building Officials have scheduled their
Annual Short Course to be held in pocatello, Idaho, 4-8 February and the City Manager requested auth-
orization for the Assistant City Building Inspector to attend the Annual Short Course. r t was moved
by Commissioner Vollmer. seconded by Commissioner Vandeventer, that the Ass't. City Building Inspector
be authorized to attend the short course and, it being in the public interest his expenses be paid
from the General fund and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and
Mayor Sedivy; those voting No, none.
Agreement, Gas Tax Proiect - Gravel & Plant Mix, Bozeman Sand & Gravel
Project Agreement No. 212(28) for construction over and upon designated streets of Bozeman and
including the purchase of 4,000 tons of 3/4" gravel at $1.80 per ton and 3,800 tons of 1/2" bituminous
plant mix at $7.15 per ton from Bozeman Sand and Gravel, Inc. , of Bozeman was presented. The Comm-
ission concurred with the recommendation of the City Manager and it was moved by Commissioner
Vandeventer, seconded by Commissioner Taylor, that the contract documents be approved as presented
and that the Mayor and Clerk of the Commission be authorized and directed to sign the Agreement for
the City and the motion was carried by the following Aye and No Vote: those voting Aye being Comm-
:lssioner Vandeventer. CommissionerTaymor, Commissioner Lehrkind, Commissioner Vollmer and Mayor
Sedivy; those voting No, none.
I Bond Sale - $900,000.00 Park-Recreation Issue
The Mayor announced that this was the time and place for the receipt of, opening and consider-
ation of sealed bids followed by public auction for the purchase of $900,000.00 General Municipal
Obligation Bonds for park and recreation purposes. The Clerk of the Commission presented affidavits
showing publication and mailing of the Notice of Sale of $900,000.00 General Municipal Obligation
Bonds of the City of Bozeman which notice was directed to be published by resolution of the Comm-
iss:lon adopted 24 November 1973. The Affidavit of the Notice of Sale was examined, approved and
ordered filed.
The City Manager itemized the various changes in the Notice of Sale of the General Obligation
Bonds as suggested by the Bonding Attorneys as follows:
1. Time Change from Mountain Standard Time to Mounta:ln Daylight Time. \
2. That said bonds whether amortization or serial bonds, will bear the
date of the 1st day of January 1974 in place of the 1st day of March
1974, and that they will be redeemable in full, at par and accrued inte-
re s t , on the 1st day of January, 1984, and on any interest payment
date thereafter in place of the 1st day of July, 1984, and on any in-
terest payment due thereafter.
3. That in accordance with the Bonding Attorneys, the amended Notice of
Sale of the General Municipal Obligation Bonds of the City of Bozeman
be accepted as correctly advertised in the Bozeman Daily Chronicle on
the 10th and 17th of January 1914.
Having explained the above changes and in concurrence with the suggestion of the Bonding
Attorneys. the City Manager asked all bidders if they were in agreement with the stipulation stated
in item three whereby they accept the Notice of Sale as correctly advertised in the Bozeman Daily
I Chronicle on the 10th and 17th of January 1974. It was moved by Commissioner Taylor, seconded by
Commissioner Lehrkind, that the records show that all prospective bond buyers present were agreeable
to the stipulated changes as presented above and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrk:lnd, Commissioner Vandeventer,
Commissioner Vollmer and Mayor Sedivy; those voting No, none.
The Clerk then announced that no sealed bids for the purchase of said bonds had been received.
It was then announced that oral bids for the purchase of the bonds in accordance with the notice
of sale would be received. The following bidders, having presented good faith checks as prescribed

by the notice of sale. then submitted oral bids and the final and bes t oral bid submitted by each
of said bidders was as follows:

After consideration of all bids received. Commissioner Vollmer introduced the following written
resolution and moved its adoption:

RESOLUTION AWARDING SALE OF $9~Q.000.00 GENERAL OBLIGATION BONDS
The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Van-
deventer. and upon vote being taken thereon. the following voted in favor thereof: Commissioner
Vollmer. Commissioner Vandeventer. Commissioner Taylor. Commissioner Lehrkind and Mayor Sedivy and
the following voted against the same: None. whereupon said resolution was declared duly passed and
adopted. signed by the Mayor in approval thereof. and attested by the Clerk.

Selection and Appointment of Architects: Fire Substation ~ George Mattson

The Commission having interviewed Architects to draw the plans and specifications for the Fire
Subs ta tion, the City Shop and the Recreation Complex Building for the last three weeks concurred in
the recommendation of the City Manager and it was moved by Commissioner Taylor. seconded by Commiss-
ioner Lehrkind. that George Mattson be appointed as Architect to design the proposed Fire Substation
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor. Commissioner Lehrkind. Commissioner Vandeventer. Commissioner Vollmer and Mayor Sedivy; those
voting No, none.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Berg-Grabow and
Partners be appointed as Architect for the purpose of designing the proposed City Shop and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commiss-
ioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
It was moved by Commissioner Vollmer. seconded by Commissioner Vandeventer, that Don McLaughlin
and Peters Kommers be selected and appointed as Architects to design the proposed Recreation Complex
Building and the motion was carried by the following Aye and No vote: those voting Aye being Commiss~ I
ioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy;
those voting No, none.
Request to Vacate Alley, Block 2. North Seventh Addi~ion
A letter received from T. G. Haggerty of the Aspen Plaza Trust requesting that the City vacate
the alley located between Aspen and Tamarack Streets and running parallel to North 5th and North 7th
Avenues was presented.
Following a thorough discussion and in response to the recommendation of the City Manager. it was
moved by Commissioner Vandeventer, seconded by Commissioner Taylor. that the City Attorney be instructed-

to draw a Resolution of Intention to vacate the above alley reserving unto the City of Bozeman. Mont-
ana, public easements for all existing utilities in the north-south alley over and across which no
structures may be constructed. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer
and Mayor Sedivy; those voting No, none.
Contracts for Execution - Bozeman Creek Supply Line, Johnston Excavating, Inc. :
I The contract documents for the construction of the Water Transmission Line Bozeman Creek Supply
was presented. The City Manager recommended that the contract documents be approved as presented.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the contract do~uments
in the amount of $87,232.50 be approved and that the Mayor and Clerk of the Commission be authorized
and directed to sign the contract for the City of Bozemaand that Johnston Excavating, Inc.. of Bozeman
be authorized to proceed with the construction and the pledge for bid security be returned to Johns ton
Excavating, Inc. , and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor
Sedivy; those voting No. none.
Petition Suggesting Litter Receptacles - Junior High Schools Students
A petition signed by 145 interested students of the Bozeman Junior High School suggesting that
trash cans be placed along the streets in the down-town area (Main Street. North Seventh Avenue,
Mendenhall and Babcock Street) was presented.
Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer,
that the Commission take the matter under advisement and consider it and if possible take some action.
The motion was carried by the following Aye and No vote: those votin~ Aye being Commissioner Lehrkind,
and ahor Sedivy.

I The City Manager commented on the reports and called upon non Noyes and Joe Steiner to comment
on the Annual Waste Water Treatment Plant report. It was moved byCommissioner Vollmer, seconded by
Commissioner Vandeventer. that the reports be approved and ordered filed and Don Noyes and Joe Steiner
be commended on their comprehensive report and the amount of work they had done at the Waste Water
Treatment Plant. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer. Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind; and
Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer. seconded by Commissioner Taylor, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No,
