The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 16 January 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, City Manager Fryslie, Ass't. City Manager Keyes, City
Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following ProceiQngs were had. I
Authorize Absence of Commissioner Lehrkind
Upon Recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Comm-
issioner Vandeventer, that the absence of Commissioner Lehrkind be authorized in compliance with
Section 11-3245, R.C.M., 1947. The motion was carried . . . . .
Minutes of the Regular Meeting held Wednesday, 9 January 1974 were approved as read.
Consideration of Bids- Tl"actor-Backhoe-Loader
The City Engineer and the Water Superintendent having tabulated the bids for the Tractor-Loader-
Backhoe for the Water Department recommended that the purchase be awarded to Gallatin Equipment Company,
Bozeman, on the basis of their low bid in the amount of $9,888.15, it being the lowest bid received
and equaling or exceeding the specifications as contained in the "Call for Bids."
The Commission concurred in the recommendation of the City Engineer, Water Superintendent, also
concurred in by the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that the award be made to Gallatin Equipment Company, Bozeman, Montana, in the amount of
$9,888.15 and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
AE..e.?intment: of M.S.U. Secur~;ty Personnel;
A letter received from Mr. D. J. Skerritt, Chief of University Police of the Montana State Uni-
versity, requesting that the following members of the University Police be appointed special police
officers of the City of Bozeman for the purpose of issuing City of Bozeman traffic citations for
moving violations with the jurisdiction of the area of the University for a period of one year from
30 Apri 1 1974 to 30 April 1975 without cost to the City of Bozeman was presented. I

It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that they concur with
the recommendation of the Chief of Police, the City Attorney and the City Manager and approve the
above appointments and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, None.
Change Order No. 3, SID No. 512, Paving & Storm Drain Thompson's No.4, Subdivision No. 2.
Change Order No. 3 on SID No. 512 prepared by Thomas, Dean & Hoskins, Inc. , to become a part of
the original contract for paving and storm drain improvements, Thompson's No. 4, Subdivision No. 2,
totaling an additional cost of $941.29 was presented.
The City Manager concurred with the engineers and recommended that Change Order No. 3 be accepted
as presented. It was moved by Commissioner Taylor, seconded by Commissioner Vollmer, that the Cha nge
Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the
City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Change Order No. I, SIn No. 530 , Storm Drain Improvements, North 21st Avenue.
Change Order No. I on SID No. 530 prepared by Thomas, Dean & Hoskins, Inc. , to become a part of
the original contract for storm drain improvements for North 21st Avenue was presented as follows.
Description: The elimination from this contract of the construction of the
1.062 linear feet of drainage ditch. This includes a rip-rap I
protection as shown on Plan Sheet 16 of 19 and covered in the
specification similiar to that in Kirk Park to the south will
be constructed by the property owner.
Purpose: The owner of the property would construct a stream channel
section similar to the above noted existing park section to
the south. Because of existing easements on this property
and under this contract, the contractor is unable to construct
it to a park type section.
Cost: The cost will be a deduction in the amount of 1,062 linear feet
at $5.80 per foot. Total cost of deduction is $6,159.60.

The City Manager concurred with the engineers and recommended that Change Order No. 1 be accepted
and approved as presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer,
that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and directed

I Renewal Dog Kennel Licenses: Mrs. Dorothy Kenck, 1317 W. Alderson Mr. & Mrs. Rober Lord , 1104 S. Pinecrest
An application received from Mrs. Ralph Kenck, 1317 West Alderson Street and an application
received from Mr. & Mrs. Robert Lord, 1104 South Pinecrest Street requesting a kennel license in acc-
ordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, together with the
required fee~were presented. The City Manager and the Chief of Police stated they were not aware of
any reason to deny the above kennel licenses and it was moved by Commissioner Vandeventer, seconded
by Commissioner Taylor, that the above application be approved and the Director of Finance be instru-
cted to issue a license to Mrs. Ralph Kenck and Mr. & Mrs. Robert Lord in accordance therewith. The
motion was carried by the following aye and no vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Continuation of License Bond - Sign Contractor, Tom Tokarski
In compliance with Chapter 14 of the Bozeman Municipal Code, the continuation of the bond of the
Sign Contractor, Tom Tokarski was presented. The City Manager stated the Building Inspector had re-
commended approval of the above mentioned bond and the City Attorney had approved the bond as to form.
It was moved by Commissioner Taylor, seconded by Commissioner Vollmer, that the continuation of the
aforementioned bond be approved and the motion was carried by following Aye and No vote: those voting
Aye being Commissioner Taylor, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those
voting No, none.
Proclamation "Jaycee Week: 20-26 January 1974. Prayer Breakfast, 21 January 1974
In accordance with the Bozeman Jaycees, Mayor Sedivy proclaimed the week of 20-26 January 1974
as "Jaycee Week" urging all citizens of the community to give full regard to the past services of the
I Bozeman Jaycees. The Bozeman Jaycees have designated Monday, 21 January 1974, at 7:00 o'clock A.M.
as the day for holding the fouth annual Mayor's Prayer Breakfast. It was moved by Commissioner Voll-
mer, seconded by Commissioner Vandeventer, that the Mayors proclamation be endorsed in accordance
with the Bozeman Jaycees and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy;
those voting No, none.
Reports
The following reports were presented:
Director of Public Service Cashier Fluoridation
The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Vandeventer, seconded by Commissioner Taylor, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vandeventer, Commissioner Taylor, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Authority to Fabricate Trailer - Waste Water Treatment Plant
The Waste Water Treatment plant has a need for a grit trailer and after evulating several alt-
ernative methods of grit disposal, it was decided that the most economic method would be to fabricate
a two axle trailer with hydrolic hoist and hinged trailer gate to handle approximately two cubic
yard of grit to be transported to the landfill.
Quotations and designs were required from all welding firms in this area with the apparent best
and lowest price being that of Midwest Welding and Machine Shop in the amount of $3,350.00 which in-
cludes minor modifications to the truck which will pull this unit.
I Following a discussion and in concurrence with the recommendation of the City Manager, it was
moved by Commissioner Taylor, seconded by Commissioner Vollmer, that the quotations of Midwest Welding
and Machine Shop in the amount of $3,350.00 to fabricate a grit trailer be accepted and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Appointment of Milt Vandeventer as Representative of City, Gallatin County BiCentennial Committee
Mayor SediVY announced his appointment of Milt Vandeventer as Official Representative of the

City on the Gallatin County Bicentennial Committee. It was moved by Commissioner Vollmer, seconded
by Commissioner Taylor, that they concur in the Mayors appointment and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Taylor,
Mayor Sedivy, those voting No, None. Commissioner Vandeventer Abstained.
9ubdivision Review, The Greens - Riverside Development Corporation
Consideration of the application of the Riverside Development Corporation for a conditional use
permit for change of Zoning for property located within the Riverside Subdivision having been tabled I
for one week to allow the City Attorney time to review the Zoning Ordinance was again presented.
The City Manager presented Ordinance No. 940 which if adopted will revoke "Section 21 Flood
Plain" of the Bozeman Zoning Code. This ordinance has been drafted by the City Attorney as a result
of staff conference to determine how the City Commission may properly proceed in considering the
request of the Riverside Development Corporation. Following a thorough discussion, it was moved by
Commissioner Taylor, seconded by Commissioner Vollmer, that they refer the ordinance to the Bozeman
Zoning Commission for a public hearing to be held on 29 January 1974 and subsequent consideration of
the ordinance by the City Commission on 30 January 1974. Requests of the Riverside Development
Corporation will be acted upon following action on Ordinance No. 940. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vollmer,
Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Concern of Many Citizens - Safety of Children on Durston Road between 11th and 20th Avenue.
A letter received from Peggy K. Gould in behalf of many concerned citizens regarding the critieal
situation that exists on Durston Road between Eleventh and Twentieth Avenue and the safety of Children
traveling in that area was presented.
The Commission instructed the City Manager to acknowledge receipt of the letter and express the
concern of the City Commission and to refer the letter to the safety Coordinator for study and recomm-
endation.
Letter of Condolence - To the Family of Ralph Armstrong.
Mayor Sedivy called attention to the untime passing of County Commissioner Ralph Armstrong and
directed that a letter of condolence be addressed to the widow and other members of the Armstrong I
family. The Mayor and City Manager also commented upon Mr.Armstrongs status as a leader among
County Officials in the State of Montana.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none.
