HomeMy WebLinkAbout1974-01-09 52 Bozeman, Montana 9 January 1974 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 9 January 1974, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Comm- issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, City Attorney Berg and the Acting Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held Wednesday, 2 January 1974 were approved as read. I Minutes of the special meeting held Monday, 7 January 1974 were approved as corrected. Open Bids - Tractor-Loader-Backhoe for the Water Department This was the time and place set for the opening of bids on a Tractor-Loader-Backhoe for the Water Departmen t. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bids be opened and read aloud and the motion was carried by the following Aye and No vote: those voting Aye Being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. The following bids were then opened and read: Dorn Equipment Company, Bozeman Net - $11,283.00 Gallatin Equipment Company, Bozeman Net - $ 9,888.15 (Used) Alt. - 7,962.62 Tri State Equipment, Billings Net - $10,000.00 (Used) Al t. - 7,100.00 Western Equipment Company, Billings Net - $13,500.00 The City Manager recommended that the bids be referred to the City Engineer and Water Superinten- dent for a recommended award to be given next week. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Commission concur in the recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vo~lmer and Mayor Sedivy; those voting No, none. Subdivision Review - The Greens, Riverside Development Corporation This was the time and place set for a public hearing to consider the application of the Riverside I Development Corporation for a conditional use permit to develop a residential planned unit development and to rezone a portion of this property located in Section 23, 25 and 26, Township 1 South, Range 5 East, M.P.M., known as the Greens from RS-l to R-3 for that portion lying west of the Springhill Road and from RS-l to R-l for that portion lying east of the Springhill Road. The City Manager read letters from the Planning Board Staff which stated that the Planning Board and Zoning Commission had reviewed the proposed development and recommended approval subject to app- ropriate flood prevention measures being taken along the portion of the East Gallatin River which borders the development, recommendations for which will be made by the City Engineer. The City Manager also read a memorandum from the City Engineer reflecting his concern of possible undercutting during high water of lots 12-16 with the balance of the lots only experiencing minor ponding of flood waters. He therefore recommended and it was concurred in by the City Manager that approval for development on lots 12-16 be withheld at this time and approval of the development of the remaining lots be granted and that an opinion in this matter be solicited from the Department of Natural Resources. Mrs. Donna Hoell was present and stated that the general area had been subject to periodic flood- ing in the past and she also questioned ownership of a portion of this area. The Planning Director was also present and reported that the developer has agreed to modify his request to R-2 instead of R-3. During a discussion between Mr. Donald Benson representing Riverside Development Corporation, Mr. Jim Cummings the consulting engineer, and the City Engineer, the City Attorney questioned whether the flood hazard portion of the zoning code should be waived, or repealed, or amended. It was then moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the appli- I cation be tabled for one week to allow the City Attorney time to review the Zoning Ordinance concerning this question and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Reports The following reports were submitted: Police Court Fire Chief h3 ,j lO" The City Manager commented on these reports and recommended that they be approved and ordered filed. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the reports be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Claims I Claim No's. 17097 through 17290 and 16739 through 16869 inclusive were presented drawn on the various funds as follows: Band $ 18.99 Planning Board $ .79 Cemetery 2,287.93 Police Reserve $ 3,369.73 Garbage 3,796.30 SDS 16,357.80 General $18,110.87 Sid's 108,855.70 Library 1,546.19 Street 5,674.94 Park 2,120.54 Water 10,909.23 Parking Meter 461. 41 Municipal Bldg. 10.38 PERS 2,680.80 Fire Relief Fd. 34,000.00 $210,201.60 The City Manager stated that he had reviewed the claims, found them to be true and lawful claims against the City and recommended approval thereof. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the claims be approved and the Director of Finance instructed to draw warrants in payment and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Appointment of Carl Lehrkind, III - Planning Board Mayor Sedivy announced the appointment of Carl Lehrkind III to the Bozeman City-County Planning Board to fill the vacancy created by the expiration of the term of Mayor Grabow. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Commission concur in this app- ointment and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; Commissioner Lehr- I kind abstained. Adjournment There being no further business to come before the Commission, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. - City Commission I
