HomeMy WebLinkAbout1974-01-02 48 Bozeman, t10ntana 2 January 1974 'rhe Commission of the City of Bozeman met in regular session in the Commission Room, Ii[unicipal Building, 2 January 1974, at 1;15 o'clock p.m. Present were 11ayor Grabow, Commissioner Sedivy, Com- missioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Assistant I City Manaeer Keyes, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held Vlednesday, 26 December 1973 were approved as read. Hearing -':.m~_I.1~_eE.i._~_~oninAs..Q...~-=- This was the time and place set for a public hearing to consider the a.I'1.endment to the existing Bozeman City Zoning Code. Said amendment would clarify yard requirements within the ordinance and define right-of-way width and roads not dedicated for public use. The Bozeman City Zoning Commission having reviewed the amendment recommended the adoption thereof as follows: "For purposes of establishing ~rard spaces all right-of-way lines for streets and roads whether established or proposed shall be considered the lot lines of abutting property. Minimum street and road widths shall comply with the Bozeman Area Comprehensive Plan. In no case, however, shall any future street or road right..of-way be less than 60 feet unless within an approved subdivision." Following a discussion, the City Manager concurred in the recommendation of the Bozeman City Zon- ing Commission also concurred in by the City-County Planning Board recommended approval of the above amendment and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they approve I the amendment to the Zoning Ordinance and instruct the City Attorney to draw up the necessary amendment to the Zoning Ordinance and the motion was carried by the following P~e and No vote: those voting ~ye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. _C_<?"I]._~~..s.~_:r..?:1.ion_,2f-.l.3_i~Q!~vet_and ,PtSEt Mix ~e.lta~e Consideration of the bids for crushed aggregate material in the amount of 4,000 tons and bituminous plant mix material in the amount of 3,800 tons to be used for street and alley maintenance and re- construction having been continued for a period of one week for further study was again presented along with a letter from Bozeman Sand and Gravel agreeing to furnish the 3,800 tons 1/2" bituminous plant mix material at the negotiated price of 07.15 per ton. The City IiIanager also presented an opinion from the City Attorney whereby the City is not pro-- hibited from accepting a negotiated bid of $7.15, since the original bid of $2.30 "Tas an irregular bid due to a typographical error. The bid should have been $12.30 per ton instead of $2.30 per ton. Following a discussion, the Commission concurred with the recommendation of the City ~1anager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer that Bozeman Sand and Gravel be awarded the bid for 4,000 tons gravel on the basis of their low bid in the amount of $1. 80 per ton I and 3,800 tons of bituminous plant mix at a negotiated bid of $7.15 per ton contingent upon receiving wri tten approval from the Hontana State Highway Department and the motion was carried by the follmving Aye and Ho vote; those voting Aye being Commissioner Lehrkind. Following a thorough discussion and in concurrence with the City 11anager's recommendation it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer that they hold off on making a decision on the proposed parking meter plans for another month. Hell, Administrator of Bozeman Medical Arts Center petitioning the City of Bozeman to create a Special Improvement District for pavine; and gutters on Villard Street between North Willson and North Tracy Avenue was presented. It vlaS moved by Commissioner Vollmer, seconded by Commissioner Sedivy that the City Hanager acknow- ledge receipt of the request and that it be referred to the City Staff for study and recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vollmer, Commissioner Lehrkind, Commissioner Vandeventer, and Hayor Grabow; those voting No, none. A'!.t..h.<?.rl:.:!:;L to Attend .Fire Chief Meeting - Chief Hoey and Assi~~!!:pj;_Chief Sil!'1?2_?E---9-11 January J.2J_~ The 110ntana Fire Chiefs Association has scheduled their annual convention to be held in Butte, Montana, 9 to 11 January 1974 and Fire Chief Hoey requested that he and Assistant Fire Chief Simpson be authorized to attend the Convention. In concurrence with the recommendation of the Fire Chief and I also concurred in by the City Manager it llas moved by Commissioner Sedivy, seconded b~r Commissioner Lehrkind, that Fire Chief Hoey and Assistant Fire Chief Simpson be authorized to attend the Convention, and, it being in the public interest their expenses be paid from the General Fund and the motion '-TaS carried by the following Aye and No vote: those voting Aye being Commissioner Sedi~J, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and ~1ayor Grabow; those voting No, none. ~_i_9...~t~o_n__f..or B. 0 . R ~ Grant Funds: Bogert Park Swimminp; Pool '. $1_0-9 ,000.... 00 The City Manager presented an application to be submitted to the Bureau of Outdoor Recreation requesting Federal Assistance in the amount of $100,000.00 for the purpose of renovating an existing swimming pool. The project work will consist of demolition of the bath house, construction of new pool, equipment room and change house, pool structure and decking and the installation of new mechanical equipment (heater, filter, chlorinator, pumps). Design and engineering will also be a part of this project along with some site improvements and relocation of utility services. The commission concurred with the recommendation of the City Hanager and it v!as moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that submission of the ap:plication be approved as pre- sented and the t1ayor and Clerk of the Commission be authorized and directed to sign the application for the City. The contract documents for the construction of the Hulti-Purpose paving which includes reconstruct- ing of some paved tennis areas at Bogert Grove and paved areas on various elementary school sites in the amount of $1+2,136.00 was presented. 'l'he City Manager recommended that the contract documents approved as to form by the City Attorney be approved. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the contract documents be approved and that the Hayor and Clerk of the City Commission be authorized and directed to sign the contract for the City of Bozeman and that Boze- man Blacktop of Bozeman be authorized to proceed with the construction and the motion was carried by the following Aye and Ho vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commis- sioner Vandeventer, Commissioner Vollmer, and 11ayor Grabow; those voting No, none. ,(I.~~h'?E.~.Er._tg_J'J~!.:.cE_a_se .Y_a.,:t~L.1Jet.ers ~ vlater Departmt;.!1..1 The City Manager concurred with the recommendation of the Water Superintendent and requested I authority to purchase 85 water meters for the \later Department at a cost of $3,934.46.
