The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 26 December 1973, at 1:15 o'clock P.M. Present were Mayor Grabow, Commissioner Sedivy, Comm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City
Manager Keyes, Acting City Attorney Morgan and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had.

Consideration of Bids, Bozeman Creek Transmission Line
The Commission was referred tp the opening of bids for the construction of Water Transmission
Lines, Bozeman Creek Supply. The bids having been studied in detail by the consulting engineers,
Thomas, Dean & Hoskins and the city engineer, and having prepared a final tabulation of the bids re-
commended that the bid be awarded to Johnston Excavating, Inc., on the basis of their bid of $87,232.50
it being the lowest bid and equaling the specifications as contained in the "Call for Bids." In con-
currence with the recommendation of the consulting engineers, and the city engineer, also concurred in
by the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the
above bid of Johnston Excavating, Inc., in the amount of $87,232.50 be accepted and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Hearing, Non-Conforming Use Permit, Taylor Construction Company
This was the time and place set for a public hearing to consider the application of Robert A.
Taylor to expand an existing building for storage of construction materials and for a carpentry shop
located in the Southeast one-quarter of the Southeast one-quarter of Section Nine, T2S, R6E and the
Northeast one-quarter of Section Sixteen, T2S, R6E, MPM, Gallatin County, Montana.
The Bozeman City Zoning Commission having reviewed the application interpreted the application
to be for the expansion of a non-conforming use. Said expansion would be approximately 1,500 square feet.
Robert Taylor appeared before the Commission in regard to the area in question.
Following a discussion, the City Manager in concurrence with the recommendation of the Bozeman
City Zoning Commission recommended approval of the application for the expansion of a non-conforming I
use permit. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they
approve the application for the expansion ofa non-conforming use permit as recommended above. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting
No, none.
Consideration of Bids, Gravel & Plant Mix Aggregate
The engineering staff having completed their study on the consideration of bids for crushed
aggregate material in the amount of 4,000 tons and bituminous plant mix material in the amount of
3,800 tons to be used for street and alley maintenance and reconstruction and having found an irre-
gularity in the bids submitted by Bozeman Sand and Gravel, the City Manager recommended continuing
consideration of the bids for a period of one week to allow certain documents to be furnished to the
State Department of Highways and negotiations to be continued with Bozeman Sand and Gravel. The
Commission concurred in the City Managers recommendation and it was moved by Commissioner Vandeventer,
seconded by Commissioner Vollmer, that consideration of the bids for gravel and plant mix aggregate
be continued for a period of one week to be considered on Wednesday, 2 January 1974, and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm-
issioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Reconsideration of Award, Multi Purpose Paving Proiect - Bozeman Blacktop
The bid awarded to Bozeman Blacktop on the basis of their low bid in the amount of $42,136.00
for the construction of the Multi Purpose Paving which includes reconstructing of some paved tennis
areas at Bogert Grove and paved areas on various elementary school sites was brought before the Comm-
ission for reconsideration.
Mr. William Sebena appeared and requested that the City Commission reconsider this award and re-
lease Bozeman Blacktop from its bid.
Following an explanation from the City Manager of the discussion conducted with Mr. Sebena prior
to awarding of the contract during which Mr. Sebena emphatically expressed a desire for Bozeman Black-
top to receive the contract award and upon the advise of the deputy City Attorney and the recommendat-
ion of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that
the award of the contract for this project not be reconsidered. The motion was carried by the follow-

ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy. Commissioner
Lehrkind. Commissioner Vandeventer and Mayor Grabow; those voting No. none.

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy. seconded by
Commissioner Lehrkind, that they approve the above applications and that the application of Karl
Marks Pizza. Knotty Keg. Little Big Men and the Ore House be approved contingent upon receiving the
proper fees and applications for license. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Comm-
issioner Vandeventer. Commissioner Vollmer and Mayor Grabow; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss~
ioner Sedivy. Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
