HomeMy WebLinkAbout1973-12-19 I I I 43 Bozeman, Montana 19 December 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 19 December 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held Wednesday, 12 December 1973, were approved as read. Open Bids, Gravel and Plant Mix Aggregate This was the time and place set for opening bids for crushed aggregate material in the amount of 4,000 tons and bituminous plant mix material in the amount of 3,800 tons to be used for street and alley maintenance and reconstruction to be paid out of Gas Tax HB-254 funds. Affidavit of publication of "Notice to the Bidders" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids filed with the Clerk of the Commission be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. The following bids were then opened and read: Bozeman Sand & Gravel, Bozeman - 4,000 tons gravel - $1. 80 per ton 3,800 tons bituminous mix - $2.30 per ton Figgins & Sons, Bozeman - 4,000 tons gravel - $2.35 per ton Pioneer Ready Mix, Bozeman - 4,000 tons gravel ~ $2.45 per ton 3,800 tons bituminous mix .. $9.90 per ton The Commission concurred with the recommendation of the City Manager and it was moved by Commiss- ioner Lehrkind, seconded by Commissioner Vandeventer, that the bids be referred to the engineering staff for their study and final recommendation on Wednesday, 26 December 1973 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow, those voting No, none. Open Bids, Bozeman Creek Transmission Line This was the time and place set for opening bids for construction of Water Transmission Lines, Bozeman Creek Supply. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bids filed with the Clerk of the Commission be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. The following bids were then opened and read: Bozeman Sand & Gravel, Bozeman $lOl,5l3.00 Felton Construction, Missoula l23,838.95 Johnston Excavating, Inc., Bozeman 87,232.50 Rain Maker, Inc., 88,594.20 W. D. Construction, Bozeman 97,915.60 The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Vollmer, seconded by Commissioner Sedivy, that the bids be referred to consulting engineers Thomas, Dean & Hoskins, and the City Engineer for study and final tabulation and recommendation to be made to the Commission at their next meeting on Wednesday, 26 December. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commiss- ioner Vandeventer, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Preliminary Plat Crossroads Subdivision The preliminary plat mf the Crossroads Subdivision was presented along with the favorable re- commendation of the City-County Planning Board subject to the Planning Staff's recommendation that access to the lots fronting on the county road to the north be limited to two-one each servicing Lots 1 and 2 and Lots 3 and 4 and that these access points be so labeled on the plat with an accompanying notation to this effect. The Commission concurred in the recommendation of the City County Planning Board also concurred in by the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they approve the preliminary plat as stated above and the City Manager be directed to sign the plat as the Director of Public Service and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer and Mayor Grabow; those voting No, none. Bozeman Downtown Plan Representatives of the downtown development association approaced the City as to soliciting a 44 favorable response to the downtown plan as presented. Following a thorough discussion, the Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the City Manager be instructed to address a letter to the representatives of the development association expressing the concurrence of the City Commission in the concept for the redevelopment of downtown Bozeman, but also calling attention to areas of City concern which will need to be resolved before the plan can be im- plemented. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Commission Resolution No. 1641 - Application for St. reimbursement, Sanitary Sewer tx Waste Water Treatment Plant, $463,819.00 Commission Resolution No. 1641 authorizing the filing of an application with the State of Montana for a reimbursement grant for the construction of Sanitary Sewer and Waste Water Treatment Plant, Project No. l25 in the amount of $463,819.00 was presented. Following a thorough discussion, it was moved by Commissioner Vandeventer, seconded by Commiss- ioner Vollmer, that Commission Resolution No. l64l be passed and adopted and that Harold A. Fryslie City Manager, be authorized to execute and file an application on behalf of the City of Bozeman and to furnish such information as the Montana Department of Health and Envi~onmental Sciences may reason- ably request in connection with such application and to sign all necessary documents and receive payment. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Authority to Call for Bids - Tractor-Loader-Backhoe, Water Department The Water department has need for a new Tractor-mounted Front-end Loader and Backhoe and the City Manager requested authority to call for bids for the purchase of the tractor-loader and backhoe. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the purchase of the tractor- mounted, frontend loader and backhoe be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase to be received and opened 9 January 1974 and the D;totion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Parking Meter Program The proposed parking meter plan consisting of three phases was presented. If adopted in its entirety, this plan would replace all existing obsolete parking meters and expand the metered area to provide for additional two and four hour parking meters. The presentation was merely to inform the Commission of the proposed parking meter plan. Reports The following reports were presented: Director of Public Service Cemetery Water Collector Director of Finance Library Cashier The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Sani.tary Sewer Easements - Mr. & Mrs. Arthur R. Munson, Mr. & Mrs. Donald L. Peterson Easement and Right-of-Way Agreements for a Sanitary Sewer Line by and between Arthur R. and Phyllis E. Munson and the City of Bozeman for the purpose of construction and installation of a Sani- tary Sewer Line with necessary appurtenances to serve various properties located within Lot 7, Block 1 of Westridge Subdivision and by and between Donald L. and Ann M. Peterson and the City of Bozeman for the purpose of construction and installation of a Sanitary Sewer Line with necessary appurten- ances to serve various properties located with Lot 6, Block 1, Westridge Subdivision lying within the City of Bozeman, County of Gallatin, State of Montana, was presented. The City Manager recommended that the City enter into the Agreements approved as to form by the City Attorney and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the Easement and Right-of-Way Agreements be entered into by the City and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Van- deventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. I I I I I I 45 Notice of Sale of General Municipal Obligation Bonds of the City of Bozeman The City Manager presented a Notice of sale of General Municipal Obligation Bands of the City of Bozeman in the amount of $900,000.00. It was moved by Commissioner Lehrkind, that the Clerk of the Commission be authorized and dirw ected to advertise "Notice of Sale of General Municipal Obligation Bonds" of the City of Bozeman to be held on 23 January 1974, at the hour of 1:30 o'clock p.m. as provided by Resolution No. 1636, to wit: Section l. That Tuesday, the 23rd day of January 1974, at a regular meeting of the City Commission "All bids shall be addressed to the City Commission of the City of Bozeman, and delivered to the Clerk of the said Commission. Adjourment There being no further busdness to come before the Commission at this time1. it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. ~.
